BUSAN METROPOLITAN CITY ORDINANCE ON THE PROMOTION OF GROWTH AND THE STRENGTHENING OF COMPETITIVENESS OF MIDDLE-STANDING ENTERPRISES

- Article 1 (Purpose)
- The purpose of this Ordinance is to establish a business ecosystem with growing circulation which enables a harmonious development of small and medium enterprises into middle-standing enterprises and middle-standing enterprises into global specialized enterprises and to contribute to facilitation of creation of quality jobs and development of local economy by prescribing matters necessary for the promotion of growth and the strengthening of competitiveness of middle-standing enterprises.
- Article 2 (Definitions)

The definitions of terms used in this Ordinance shall be as follows:
- 1. The term “middle-standing enterprise” means an enterprise defined in subparagraph 1 of Article 2 of the Special Act on the Promotion of Growth and the Strengthening of Competitiveness of Middle-Standing Enterprises, which has the head office in the Busan Metropolitan City (hereinafter referred to as “City”);
- 2. The term “enterprise with potential to become a middle-standing enterprise” means an enterprise with a high possibility to grow into a middle-standing enterprise and an innovation capability, which has the head office in the City;
- 3. The term “middle-standing entrepreneur” means a person who runs a middle-standing enterprise.
- Article 3 (Responsibility) (1) The City shall formulate and implement policies to create a social and economic environment which enables small and medium enterprises to develop into middle-standing enterprises harmoniously and middle-standing enterprises to grow into global specialized enterprises with global competitiveness (hereinafter referred to as “middle-standing enterprise policies”), and allocate resources, such as budget or human resources, necessary for the implementation of such policies.
- (2) Where the City formulates and implements middle-standing enterprise policies, it shall ensure that the support for small and medium enterprises does not decrease and shall endeavor to attract or promote a voluntary investment by middle-standing enterprises.
- Article 4 (Responsibility of Middle-Standing Entrepreneurs) (1) Each middle-standing entrepreneur shall show an entrepreneurial spirit and endeavor to improve global competitiveness by continuous innovation, as well as fulfill social responsibility of enterprises, such as transparent management and mutually beneficial cooperation with small and medium enterprises, thereby contributing to a sustainable growth of the national and local economy and an improvement of welfare of citizens.
- (2) Each middle-standing entrepreneur shall proactively cooperate with the middle-standing enterprise policies conducted by the City.
- Article 5 (Formulation and Implementation of Action Plans) (1) The Mayor of the Busan Metropolitan City (hereinafter referred to as “Mayor”) shall formulate and implement an action plan for the promotion of growth and the strengthening of competitiveness of middle-standing enterprises (hereinafter referred to as “action plan”).

(2) The action plan referred to in paragraph (1) shall include the following:
- 1. The basic directions setting for middle-standing enterprise policies;
- 2. Matters regarding the regional status and growth prospect for middle-standing enterprises and enterprises with potential to become middle-standing enterprises (hereinafter referred to as “middle-standing enterprises, etc.”);
- 3. Matters regarding the elimination of systems and policies that hinder the development of small and medium enterprises into middle-standing enterprises;
- 4. Matters regarding the finance, technological innovation, creation of domestic and foreign markets, cultivation of human resources and cooperation of industries, universities, research institutes and governments to promote the middle-standing enterprise policies;
- 5. Other matters necessary for the promotion of harmonious development of middle-standing enterprises, etc.
- (3) The Mayor may request the submission of data and other cooperation from the institutions and organizations, and Gus/Guns relevant to medium standing enterprises, etc., if necessary to formulate and implement actions plans described in paragraph (1).
- Article 6 (Securing, Etc. Foundation for Growth) (1) The Mayor may preferentially nurture medium standing enterprises, etc. to enable them to secure a foundation to grow into global specialized enterprises, in connection with strategic industries of the City and national projects of the Government.
- (2) To nurture medium standing enterprises, etc. pursuant to paragraph (1), the Mayor may provide necessary support for each growth stage, size of enterprise and business type.
- Article 7 (Support for Technology Innovation of Middle-standing Enterprises, Etc.)

The Mayor may implement the following support projects to enhance the technology innovation
capability of middle-standing enterprises, etc.:
- 1. Support for technology development for the advancement of ongoing projects and creation of new projects, etc.;
- 2. Support for technology development through joint research by industries, universities and research institutes;
- 3. Support for technology development in connection and cooperation with public institutions relocated in the City;
- 4. Support for technology innovation strategy consulting;
- 5. Other matters necessary to improve the technology innovation capability of middle-standing enterprises, etc.
- Article 8 (Support for Entry into Overseas Markets by Middle-Standing Enterprises, Etc.)

The Mayor may implement the following support projects for the entry into overseas markets by
middle-standing enterprises, etc.:
- 1. Providing consulting services for the entry into a new overseas market, and supporting participation in export fairs or exhibitions;
- 2. Securing overseas bases or providing strategic consulting services for the global marketing of exemplary products and technologies;
- 3. Providing consulting services for the protection of intellectual property right and the prevention of divulgence of technologies;
- 4. Other matters necessary for the entry into overseas markets by middle-standing enterprises, etc.
- Article 9 (Support for Securing, Etc. Human Resources by Middle-Standing Enterprises, Etc.)

The Mayor may implement the following support projects to attract and secure highly talented
persons and to develop human resources of middle-standing enterprises, etc.:
- 1. Support for hiring experts with specialized technology experience for the development projects of such technology;
- 2. Publicity and job placement for middle-standing enterprises, etc. to attract domestic and foreign human resources;
- 3. Awarding scholarship linked to employment in cooperation with the public institutions relocated in the City;
- 4. Strengthening capabilities of employees through education of specialized technology and business innovation;
- 5. Other matters necessary for middle-standing enterprises, etc. to secure talented persons and develop human resources.
- Article 10 (Subsidization for Middle-Standing Enterprises, Etc.)

The Mayor may subsidize the following matters to create an enabling environment for the
financing of middle-standing enterprises, etc.:
- 1. Matters regarding loan support for middle-standing enterprises, etc. by credit guarantee, etc.;
- 2. Matters regarding the revitalization of direct financing, such as the issuance of corporate bonds;
- 3. Other matters necessary for creating an environment for the financing of middle-standing enterprises, etc.
- Article 11 (Reinforcement of Cooperative Systems among Middle-standing Enterprises, Etc.)

Article 11 (Reinforcement of Cooperative Systems among Middle-standing Enterprises, Etc.)
The Mayor may implement the following matters to reinforce the cooperative system among
middle-standing enterprises, etc.:
- 1. Holding conferences, forums, etc. to improve systems and develop policies;
- 2. Establishing and operating cooperative systems to create mutually beneficial relationships among middle-standing enterprises, etc.;
- 3. Establishing and operating cooperative systems among industries, universities, research institutes and governments;
- 4. Other matters necessary for reinforcing cooperative systems among middle-standing enterprises, etc.
- Article 12 (Entrustment of Duties) (1) The Mayor may entrust some of his/her duties to the agency, organization, etc. conducting the affairs relevant to the support for middle-standing enterprises, etc., in order to effectively implement the support projects specified in Articles 6 through 10.
- (2) Except as otherwise expressly provided for in this Ordinance, the Busan Metropolitan City Framework Ordinance on Contracting-out shall apply to the duties entrusted under paragraph (1).
- Article 13 (Financial Support) (1) The Mayor may support all or some of expenses incurred in the support projects for an agency, organization, etc. implementing such projects pursuant to Articles 6 through 10, within budgetary limit.
- (2) The Busan Metropolitan City Ordinance on Management of Local Subsidies shall apply to the method, procedure, etc. of supporting expenses pursuant to paragraph (1).
- ADDENDA
- This Ordinance shall enter into force one month after the date of its promulgation.
