CHAPTER Ⅰ GENERAL PROVISIONS

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to establish the Busan Metropolitan Small and Medium Business Development Fund for the sound development of local SMEs in accordance with Article 62-17 of the Act on the Promotion of Small and Medium Enterprises, and to stipulate matters necessary for the efficient management and operation of the Busan Metropolitan Small and Medium Business Development Fund. <Amended on Dec. 28, 2000; Feb. 16, 2005; May 10, 2006; Jan. 1, 2008; Jul. 7, 2008; Dec. 28, 2011; Aug. 1, 2018; Sep. 9, 2018; May 29, 2019; Jan. 1, 2020; Jan. 13, 2021 >
  • Article 2 (Definitions)

    • 1. "Small and medium-sized enterprises(SME)" means small and medium-sized enterprises pursuant to Article 2 of the Framework Law on Small and Medium Enterprises; <Amended on Feb. 16, 2005; Dec. 28, 2011>
    • 2. "Knowledge industry" means an industry pursuant to Article 2 ② of the Act on Industrial Location and Development; <Amended on Feb. 16, 2005; May 10, 2006; Dec. 28, 2011>
    • 3. "Venture investment association" means a cooperative registered in accordance with Article 50 of the Act on the Promotion of Venture Investment;
    • 4. "Factory land leasing business" means a person who has signed a tenant contract with a management agency in accordance with Article 38 ② of the Act on Industrial Agglomeration and Factory Establishment; <Amended on Feb. 16, 2005; Dec. 28, 2011>
    • 5. "Knowledge industry center construction business" means a person who establishes an apartment-type factory with establishment approval and building permit in accordance with Article 28-2 of the Act on Industrial Agglomeration and Factory Establishment; <Amended on Dec. 28, 2000; Feb. 16, 2005; Dec. 28, 2011>
    • 6. "Market improvement project implementer" means a person who implements market improvement projects in the market maintenance area approved and announced by the Busan Metropolitan Mayor (hereinafter referred to as the "Mayor") in accordance with Article 37 of the "Special Act for the Development of Traditional Markets and Shopping Streets"; <Amended on Dec. 28, 2000; May 10, 2006; Jul. 7, 2008; Dec. 28, 2011>
    • 7. "Store facility improvement business" means a business operator that improves the facilities or structure of an existing store and converts it into a modern facility or structure.<Amended on Dec. 28, 2011>
    • 8. "Joint warehouse construction business" refers to a business that builds a joint warehouse so that organized medium-sized enterprises can reduce logistics costs;<Amended on Dec. 28, 2011>
    • 9. "Busan Economic Promotion Agency (hereinafter referred to as the "Promotion Agency")" means a foundation corporation established in accordance with Article 54-31 of the Enforcement Decree of the Act on the Promotion of Small and Medium Enterprises and the Ordinance on Establishing and Operating the Busan Economic Promotion Agency;
    • 10. "Port logistics industry" refers to the port related service industry, which is engaged in arranging cargo transportation, supplying ship goods, refueling ships, port services, and ship repair; <Amended on Feb. 16, 2005; May 10, 2006; Dec. 28, 2011>
    • 11. "Financial institution" means any one of the following:
      • A. Banks under the Banking Act
      • B. Korea Development Bank under the Korea Development Bank Act
      • C. Export-Import Bank of Korea under the Export-Import Bank of Korea Act
      • D. Small and medium-sized enterprise banks under the Small and Medium-sized Banks Act
      • E. Nonghyup Bank under the Agricultural Cooperatives Act
      • F. Suhyup Bank under the Fisheries Cooperatives Act
      • G. Saemaul Geumgo under the Saemaul Geumgo Act
    • 12. "Busan Credit Guarantee Foundation" means a corporation established pursuant to Article 9 of the Regional Credit Guarantee Foundation Act and the Ordinance on the Operation of the Busan Credit Guarantee Foundation;
    • 13. "Social finance" means financial activities pursuant to Article 2 ⑤ of the "Ordinance on Fostering and Supporting the Social Economy of Busan Metropolitan City";
    • 14. "Social finance implementation institution" means an institution pursuant to Article 2 ⑥ of the Ordinance on Fostering and Supporting the Social Economy of Busan Metropolitan City.

CHAPTER Ⅱ ESTABLISHMENT OF FUN, ETC

  • Article 3 (Establishment of Fund)
  • ① The Mayor shall establish the Busan Metropolitan City Small and Medium Business Development Fund (hereinafter referred to as the "Fund") in accordance with Article 159 of the Local Government Act to secure and support the funds necessary for the development of small and medium-sized enterprises. <Amended on Jul. 7, 2008; Apr. 13, 2022>
  • ② Funds established pursuant to paragraph ① shall be managed outside the revenue and appropriation budget in accordance with Article 34 ③ of the Local Finance Law. <Amended on Dec. 28, 2011; Jan. 13, 2021>
  • Article 4 (Financial resources of the Fund)
  • ① The financial resources of the SME development account are as follows: <Amended on Sep. 29, 2021>
    • 1. Transfers from the general accounts of Busan Metropolitan City (hereinafter referred to as the "City") and contributions from the districts and counties and the Busan and Jinhae Free Economic Zone Authority;
    • 2. Deposits and contributions to the Small and Medium Venture Business Startup and Promotion Fund pursuant to Article 63 of the Act on the Promotion of Small and Medium Enterprises;
    • 3. Operating income of SME Development Account;
    • 4. Other revenues.
  • ② The financial resources of the fund investment account are as follows:
    • 1. Recovery of fund investment account contributions;
    • 2. Transfer from General Accounting;
    • 3. Fund Investment Account Management Income;
    • 4. Other revenues.
  • ③ The financial resources of the Social Economy Development Account are as follows:
    • 1. Transfer from General Accounting;
    • 2. Deposits and contributions to the Small and Medium Venture Business Startup and Promotion Fund pursuant to Article 63 of the Act on the Promotion of Small and Medium Enterprises;
    • 3. Transfer from SME Development Account;
    • 4. Donations from corporations, organizations, or individuals;
    • 5. Operating income of the Social Economy Development Account;
    • 6. Other revenues.

  • Article 5 (Pre-deposits or Contributions of the Small and Medium Venture Business Startup and Promotion Fund)
  • ① Pursuant to Article 4 ① 2, the Mayor may get pre-deposits or contributions from Small and Medium Venture Business Startup and Promotion Fund by entering into a contract with Chairman of the Small and Medium Venture Business Promotion Corporation.

CHAPTER Ⅲ ESTABLISHMENT OF FUND ACCOUNTS

  • ② The Mayor shall establish an SME Development Account, a Fund Investment Account, and a Social Economy Development Account in the Busan Metropolitan City Treasury designated pursuant to Article 38 of the Local Accounts Law in order to clarify the income and expenditure of the Fund. <Amended on Dec. 28, 2000; Jul. 7, 2008; May 31, 2017; Jan. 1, 2020>

  • ③ Social Economy Development Account may be provided to the following persons having a place of business in the municipality: <ewly Inserted on Jan. 1, 2020>
    • 1. Social economy enterprises under Article 2 ③ of the Busan Metropolitan Government Ordinance on the Promotion and Support of Social Economy;
    • 2. Shared organizations and shared enterprises under Article 2 of the Busan Metropolitan Government Ordinance on the Promotion of the Shared Economy;
    • 3. Housing-related social economic entities under Article 2 ③ of the Busan Metropolitan Government Ordinance on Support for the Revitalization of Social Housing;
    • 4. Social finance institutions;
    • 5. Other persons who engage in projects deemed necessary by the Mayor for fostering the social economy.
  • Article 8 (Usage of Fund)
  • ① The SME Development Account shall be used for each of the following purposes: <Amended on Jan. 1, 2008; Dec. 28, 2011; May 31, 2017>
    • 1. Project to foster SME and support operating funds; <Amended on May 31, 2017>
    • 2. Compensation for the difference in interest on loans to small and medium-sized enterprises and low-interest loans of financial institutions; <Amended on Dec. 28, 2011>
    • 3. Improvement of distribution industry for small and medium enterprise and market upgrade project;
    • 4. Loan or subsidy for promotion of knowledge industry and harbor transport business;
    • 5. Loan, contribution, or subsidy for promotion of local co-brand;
    • 6. Support for Promotion Agency or Busan Credit Guaranty Foundation; <Amended on Jan. 11, 2008>
    • 7. Reimbursement to the Fund for Development and Industrial Foundation of Small and Medium Enterprises;

    • 11. Other loan or subsidy for necessary projects to promote small and medium enterprises.

    • 1. Investment in venture investment associations, fund-of funds associations, and new technology business investment associations pursuant to Article 71 ④ of the Act on the Promotion of Venture Investment;
    • 2. Investment in agri-food investment associations pursuant to Article 13 of the Act on the Formation and Operation of Agriculture, Fisheries and Food Investment Associations;
    • 3. Expenses required for the operation and management of the fund investment account.
  • ③ Social Economy Development Account shall be used for each of the following purposes: <Newly Inserted on Jan. 1, 2020>
    • 1. Loans, contributions, and support projects for fostering persons eligible for support falling under any one of Article 7 ③;
    • 2. Social investment projects to improve social, environmental, and cultural issues;
    • 3. Expenses necessary for the operation and management of the Social Economy Development Account;
    • 4. Other projects that the market recognizes as necessary for fostering the social economy.

CHAPTER Ⅳ FUND MANAGEMENT DELIBERATION COMMITTEE

    Article 8-2 (Fund Management Deliberation Committee)
  • ① The Mayor shall establish the Busan Metropolitan Government Deliberation Committee on the Operation of the Small and Medium Business Fund (hereinafter referred to as the "Committee") to deliberate on the following matters concerning the management and operation of the Fund:
    • 1. Establishment and modification of fund management plan;
    • 2. Preparation of Fund Settlement Report;
    • 3. Analysis of the performance of fund management;
    • 4. Other important matters concerning the management and operation of the fund to be submitted to the meeting by the mayor.
  • ② The committee shall consist of not more than 20 members, including one chairperson. <Amended on Jan. 1, 2020>
  • ③ The chairperson of the committee shall be the fund management officer, and the members shall be the director of the department in charge of each account ex-officio, and shall be appointed or commissioned by the Mayor in consideration of gender from among the following persons: <Amended on Jan. 1, 2020>
    • 1. Public servants of level 4 or above belonging to the city;
    • 2. Person recommended by the Busan Metropolitan City Council;
    • 3. Directors of small and medium-sized enterprises, fund investment, social economy-related institutions, corporations or organizations;
    • 4. A person who has abundant knowledge and experience in the fields related to SME development, fund investment, and social economy.
  • ④ Commissioned members may be recommended by the department in charge of affairs for each account.
  • ⑤ The term of office of commissioned members shall be two years, and they may be reappointed only once. However, the term of office of a by-election member shall be the remaining period of the predecessor's term of office. [Amended on May 29, 2019]
  • Article 8-3 (Dismissal of Members)
  • In case a member falls under any of the following subparagraphs, the Mayor may dismiss the relevant member:
    • 1. In the case of being unable to perform his/her duties due to mental and physical disability;
    • 2. In case there is a misconduct related to the job;
    • 3. In case it is deemed inappropriate as a member due to neglect of duty, impairment of dignity, or other reasons;
    • 4. In case the committee member expresses his or her intention that it is difficult for him or her to perform his or her duties;

  • Article 8-4 (Duties of the Chairperson)
  • ① The Chairperson shall represent the Committee and preside over the affairs of the Committee.
  • ② If the chairperson is unable to perform his or her duties for unavoidable reasons, a member appointed in advance by the chairperson shall act on his behalf.

  • Article 8-5 (Meeting)
  • ① The chairperson of the committee shall convene a meeting and be its chairman.
  • ② Meetings of the Committee shall be held with the attendance of a majority of the incumbent members, and resolutions shall be made with the consent of a majority of the members present.

  • Article 8-6 (Secretary)
  • In order to handle the affairs of the Committee, the Committee shall have one executive secretary for each account, and the officer in charge of affairs for each account shall be the executive secretary.

  • Article 8-7 (Allowances, etc.)
  • Allowances and travel expenses may be paid to commissioned members who attend meetings of the Committee within the scope of the budget.

  • Article 8-8 (Operational Rules)
  • Matters necessary for the operation of the committee, other than those provided for in this ordinance, shall be determined by the chairperson after a vote of the committee.

CHAPTER Ⅴ LOAN OF FUND

  • Article 10 (Public Notice of Loan Service)
  • The Mayor must establish and publicly announce loan service plan(including the amount of loan, the eligible business, the limitation, terms, and procedure of loan) every year before the Mayor actually implements the plan.
  • Article 11 (Application for Loan)
  • ① A person who wants to obtain a loan from the Fund may apply for the loan. <Amended on May 10, 2006>
  • ② The application procedure and necessary documents, etc. must be prescribed by rule of Busan.
  • Article 12 (Selection of Eligible Enterprise)
  • ① When the Mayor receives the application document for loan under Article 11, she/he must decide the eligible enterprise and the amount of loan: In this case, field inspections may be conducted if necessary. <Amended on May 29, 2019>
  • ② All or part of the work under Article 11 and Article 12 ① may be managed by the Promotion Corporation, the Promotion Agency, and the Busan Credit Guarantee Foundation or by a social finance agency through a loan agreement. <Amended on Dec. 28, 2000; Jan. 1, 2008; Jan. 1, 2020>
  • ③ In the case a person who acts on behalf of or performs duties pursuant to paragraph ② recommends at least KRW 5 billion per business entity, he/she shall determine the business entity subject to the loan and the amount of the loan after deliberation by the relevant institution's Loan Deliberation Committee.<Newly Established on May 10, 2006; Amended on Jan. 1, 2008; Dec. 28, 2011; Jan. 1, 2020&>

  • Article 13 (Terms of Loan, etc.)
  • Necessary matters for the maximum of each loan service, interest rate, maturity, etc. may be prescribed by rule of Busan.
  • Article 14 (Reimbursement of Loan)
  • ① The Mayor may request the reimbursement of loan or take necessary measures before maturity when any causes under each of the following subparagraphs has occurred: <Amended on Dec. 28, 2000; Dec. 28, 2011>
    • 1. When an enterprise misappropriates the loan; <Amended on Dec. 28, 2000>

CHAPTER Ⅵ OPERATION AND MANAGEMENT OF THE FUND

  • Article 17 (Inspection)
  • ① The Mayor may, if deemed necessary, inspect how enterprises obtaining a loan manage it or require them to submit relevant materials, and the enterprises must comply therewith. <Amended on Dec. 28, 2000; Dec. 28, 2011>

  • Article 18 (Inspection of agency affairs, etc.)

  • At the time of the enactment of this Ordinance, the Busan Metropolitan Small Business Development Fund and loan funds pursuant to the previous regulations shall be deemed to be the Busan Metropolitan Small Business Development Fund and loan funds pursuant to this Ordinance.
