BUSAN METROPOLITAN CITY ORDINANCE ON THE SUPPORTING FOR THE STABLE LIVING AND SELF-SUPPORTING OF LOW-INCOME CITIZENS

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe matters necessary to support stable-living conditions for low-income residents, who have difficulties in their lives.
  • Article 2 (Beneficiaries)
  • The beneficiaries to be supported by this Ordinance shall be as follows: Provided, That those who receive benefits under the provisions of statutes or regulations other than the National Basic Living Security Act (hereinafter referred to as the "Act") shall be excluded:
    • 1. Recipients of livelihood benefits and medical benefits pursuant to subparagraphs 1 and 3 of Article 7 of the Act;
    • 2. Those under the second-lowest income bracket pursuant to subparagraph 10 of Article 2 of the Act;
    • 3. Those deemed necessary by the Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") to support among low-income residents who are struggling financially but who do not fit within the recipient categories pursuant to subparagraph 2 of Article 2.
  • Article 3 (Details of Support)
  • (1) The Mayor may provide those falling under subparagraphs 1 and 2 of Article 2 with any of the following support:
    • 1. Educational encouragement money to students who are enrolled in middle and high schools pursuant to Article 2 of the Elementary and Secondary Education Act;
    • 2. Educational encouragement money to students who are enrolled in universities and colleges pursuant to Article 2 of the Higher Education Act;
    • 3. Money to prepare for the winter season;
    • 4. Allowance for the rehabilitation of the handicapped;
    • 5. Holiday bonus and other necessary additional allowances;
    • 6. Other matters deemed necessary by the Mayor.
  • (2) The Mayor may provide female youths under the age of 19 falling under subparagraph 1 of Article 2 with sanitary products.
  • (3) The Mayor may provide those falling under subparagraph 3 of Article 2 with the following:
    • 1. Living benefits;
    • 2. Other matters deemed necessary by the Mayor.
  • (4) Support given pursuant to the provisions of paragraphs (1) through (3) shall be executed by the heads of the Gus and Guns having jurisdiction over the place of residency of the beneficiaries, with any standards for and scope of support separately decided by the Mayor for each beneficiary within the budgetary limit: Provided, That support given pursuant to paragraphs (1) and (2) shall be executed by the Mayor.
  • Article 4 Deleted.
  • Article 5 (Application for Support and Decision)
  • Where a person intends to be supported under Article 3 (3), he or she shall apply to the head of a Gu and Gun, and the heads of a Gu and Gun shall decided thereon.
  • Article 6 (Termination of Support)
  • Where a beneficiary meets any of the following conditions, the support may be terminated:
    • 1. Where a beneficiary has been supported by fraud or any other wrongful means;
    • 2. Where a beneficiary rejects support.
  • Article 7 (Examination and Report)
  • The heads of Gus and Guns shall examine the beneficiaries prescribed in Article 2 more than once a year and report the result to the Mayor.

  • This Ordinance shall enter into force on the date of its promulgation.
