Busan Metropolitan City Ordinance for Enhancement of City Brand Value

    Article 1(Purpose)
  • The purpose of this Ordinance is to prescribe necessary matters for enhancing the city brand value, upgrading the status and dignity of Busan Metropolitan City domestically and internationally and strengthening the competitiveness of the city.
    Article 2 (Definitions)
  • The terms used in this Ordinance shall be as follows:
    • 1. The term "city brand" means tangible and intangible assets of Busan Metropolitan City (hereinafter referred to as "Si") such as economy, culture, environment, citizens, infrastructure, and leisure.
    • 2. The term "brand slogan" means a slogan that implicatively expresses the identity and future of a Si, and shall be as in the attached Table.
    Article 3 (Duty of Si)(1) A Si shall formulate and promote a comprehensive and systematic strategy and policy to enhance the city brand value.
  • (2) A Si shall make every effort to build a socially common sentiment on activities to enhance the city brand value and increase citizens' participation.
    Article 4 (Basic Plan for City Brand)(1) Busan Metropolitan City Mayor (hereinafter referred to as the "Mayor") shall formulate and promote a basic plan for the city brand every three years to enhance the city brand value.
  • (2) The basic plan for the city brand shall include each of the following subparagraphs:
    • 1. Matters concerning the current status and prospects of the city brand;
    • 2. Matters concerning the basic purpose and strategy to promote the city brand;
    • 3. Promotional task of overriding priority and detailed business by year;
    • 4. Matters concerning cooperation between public and private sectors to enhance the city brand value;
    • 5. Other necessary matters to enhance the city brand value.
    Article 5 (Implementation Plan by Year)(1) The Mayor shall formulate and carry out an implementation plan by year to efficiently achieve the basic plan for the city brand.
  • (2) An implementation plan by year shall include each of the following subparagraphs:
    • 1. The purpose and strategies for promotion of the relevant year;
    • 2. The promotional task of overriding priority and detailed business of the relevant year;
    • 3. The plan for check-up and assessment on the implementation plan by year.
    Article 6 (Management and Use of Brand Slogan)(1) The Mayor shall manage the brand slogan so that it may be used properly for its purpose and its dignity may be maintained.
  • (2) The brand slogan shall be used for the public purpose of developing a Si and increasing its publicity, and it may be used free of charge.
  • (3) When a person uses the brand slogan pursuant to paragraph (2), he/she shall use it as prescribed by the Trademark Act.
    Article 7 (Establishment of the City Brand Committee)
  • The City Brand Committee for Busan Metropolitan City (hereinafter referred to as the "Committee") shall be established in order to deliberate or consult on matters necessary for enhancing the values of the city brand of a Si
    Article 8 (Functions of the Committee)
  • The Committee shall deliberate or consult on each of the following matters:
    • 1. Matters concerning formulation and adjustment of the basic plan for the city brand;
    • 2. Matters concerning adjustment of major policies and business of the city brand;
    • 3. Matters concerning formulation of the implementation plan and assessment of the results of promoting the city brand tasks;
    • 4. Matters concerning collection of citizens' consensus on the city brand and citizens' participation;
    • 5. Matters concerning publicity of the city brand domestically and internationally and cooperation between public and private sectors;
    • 6. Other matters concerning the city brand that the Chairperson brings up to a meeting.
    Article 9 (Composition of the Committee)(1) The Committee shall be composed of not more than 20 members, including one Chairperson.
  • (2) A Chairperson of the Committee shall be elected by the Committee among its members, and the Mayor shall appoint or commission members from those who fall under any of the following subparagraphs. In such cases, the number of members falling under subparagraph 3 shall be not less than a half of the total number of members:
    • 1. Public officials of the third level or higher who are engaged in the businesses related to the city brand of a Si
    • 2. A person recommended by the Council of Busan Metropolitan City;
    • 3. A person of learning and experience in the field related to city branding.
  • (3) The term of the commissioned member shall be two years and he/she may be reappointed only once: Provided, That the term of a substitute member for filling a vacancy shall be the remaining period of the predecessor.
    Article 10 (Duties of Chairperson)(1) The Chairperson shall represent the Committee and shall exercise overall control of the affairs of the committee.
  • (2) When the Chairperson is unable to perform his/her duties due to unavoidable reasons, a person nominated by the Chairperson shall perform the duties on behalf of him/her.
    Article 11 (Meeting of the Committee)(1) A Chairperson shall convene a meeting of the Committee and be the speaker of the meeting.
  • (2) When a Chairperson intends to convene a meeting of the Committee, he/she shall notify the members of the date, place, and agenda of the meeting seven days before holding the meeting: Provided That, this shall not apply to cases of urgency.
  • (3) Each meeting of the Committee shall require the attendance of a majority of incumbent members, and each resolution shall be passed by a majority vote of those present.
    Article 12 (Administrative Secretary of Committee)(1) The Committee shall have one administrative secretary to take care of the business of the Committee, and he/she shall be the director of the businesses of the city brand.
  • (2) An administrative secretary shall take care of the business of the Committee and write and manage a meeting record.
    Article 13 (Subcommittees)(1) The Committee may have the subcommittees of the following subparagraphs in order to perform the business of the Committee:
    • 1. Subcommittee of Knowledge and Economy;
    • 2. Subcommittee of Culture and Tourism;
    • 3. Subcommittee of International Cooperation;
    • 4. Subcommittee of Global Citizen.
  • (2) A Chairperson of a subcommittee shall be elected by the subcommittee among its members, and the subcommittee shall be composed of not more than five members nominated by the Chairperson of the Committee from among its members.
  • (3) A subcommittee shall deliberate or consult on the agenda entrusted from the Committee, and the chairperson of the relevant subcommittee shall convene a meeting.
  • (4) Matters resolved by the subcommittees shall be deemed to be resolved by the Committee.
  • (5) Provisions related to management of the Committee shall apply mutatis mutandis to management of a subcommittee, unless otherwise prescribed in this Article.
    Article 14 (Joint Meeting)(1) If necessary, the Chairperson of the Committee may hold a joint meeting in which more than two subcommittees participate.
  • (2) The speaker of a joint meeting shall be the Chairperson of the Committee or shall be nominated by the Chairperson of the Committee.
    Article 15 (Request for Assistance to Related Organizations)
  • If necessary for the deliberation, the Committee and subcommittees may request necessary assistance such as inviting related public officials or experts to a meeting to hear their opinions or asking related organizations and groups to offer their materials or opinions.
    Article 16 (Allowances)
  • When commissioned members or related experts attend a meeting, allowances may be granted within budgetary limits.
    Article 17 (Detailed Regulations on Management)
  • Necessary matters for managing the Committee and subcommittees other than those prescribed by this Ordinance shall be determined by the Chairperson of the Committee, following a resolution by the Committee.
    Article 18 (Financial Support)
  • The Mayor may support necessary matters such as increasing publicity of the city brand home and abroad and expanding the businesses of the city brand in order to enhance the values of the city brand within budgetary limits.
    Article 19 (Providing Information and Collecting Citizens' Consensus)(1) The Mayor shall make every effort to provide citizens with information on the knowledge on the city brand and on the promotion of the city brand.
  • (2) The Mayor may, if necessary for the efficient promotion of the business of enhancing the values of the city brand, conduct a survey of public opinions to collect citizens' consensus.
