Busan Metropolitan City Ordinance on Mutual Cooperation within Distribution Industry and Protection of Small Commercial and Industrial Businessmen

    Article 1 (Purpose)
  • The purpose of this Ordinance is to promote the balanced development of the local distribution industry and contribute to the development of the local economy by strengthening the mutual cooperation among large distribution enterprises, small and medium distribution enterprises and small commercial and industrial businessmen, and by protecting small commercial and industrial businessmen through support for the enhancement of the competitiveness of small commercial and industrial businessmen.
    Article 2 (Definition)
  • For the purpose of this Ordinance, the following terms shall have the meaning as set forth below:
    • 1. The term "large distribution enterprises" refers to superstores ‧ specialty stores and department stores as provided under the Attached Table I of the Enforcement Decree of the Distribution Industry Development Act.
    • 2. The term "small and medium distribution enterprises" refers to small and medium business proprietors as provided under Article 2 of the Framework Act on Small and Medium Enterprises who are engaged in the distribution industry.
    • 3. The term "small commercial and industrial businessmen" refers to small commercial and industrial businessmen as provided under subparagraph 2 of Article 2 of the Act on Special Measures for Support to Small Enterprises and Small Commercial and Industrial Businessmen who are engaged in the distribution industry.
    • 4. The term "mutual cooperation" refers to joint businesses or activities carried out to promote the mutual benefit among large distribution enterprises, small and medium distribution enterprises and small commercial and industrial businessmen with regard to sectors such as manpower ‧ fund ‧ purchase ‧ market ‧ advertisement, etc.
    Article 3 (Establishment ‧ Implementation of Mutual Cooperation Plan) (1)The Busan Metropolitan City Mayor (hereinafter referred to as the "Mayor") shall establish ‧ implement the Busan Metropolitan City Mutual Cooperation Plan for the Distribution Industry (hereinafter referred to as the "Mutual Cooperation Plan") to promote the growth of large distribution enterprises, small and medium distribution enterprises and small commercial and industrial businessmen by promoting the mutual cooperation.
  • (2)The Mutual Cooperation Plan shall include the matters falling under each of the following subparagraphs:
    • 1. Basic direction and strategy of policy measures on mutual cooperation;
    • 2. Matters concerning the protection of small commercial and industrial businessmen through mutual cooperation;
    • 3. Matters concerning the promotion and support of mutual cooperation projects;
    • 4. Matters concerning the discovery and fosterage of excellent enterprises; and
    • 5. Matters concerning the contribution and cooperation of large distribution enterprises to the community.
    Article 4 (Distribution Industry Mutual Development Council) (1)The City shall have the Distribution Industry Mutual Development Council (hereinafter referred to as the "Council") to deliberate on the matters falling under each of the following subparagraphs concerning mutual cooperation among large distribution enterprises, small and medium distribution enterprises and small commercial and industrial businessmen:
    • 1. Matters concerning the establishment of the Mutual Cooperation Plan as provided under Article 3;
    • 2. Matters concerning on the support for the enhancement of the competitiveness of small commercial and industrial businessmen as provided under Article 5;
    • 3. Matters concerning the contribution and cooperation of large distribution enterprises to the community as provided under Article 6;
    • 4. Matters concerning the support of working expenses as provided under Article 7;
    • 5. Matters concerning the investigation and research for balanced development of distribution industry; and
    • 6. Matters concerning the institutional improvement for advancement of distribution industry.
  • (2)The Council shall be composed of twenty-five members including one Chairperson and one Vice Chairperson.
  • (3)The Chairperson of the Council shall be the Economy Industry Director, and the Vice Chairperson shall be elected from the Council members. Persons falling under each of the following subparagraphs who are appointed and commissioned by the Mayor shall be the Council members:
    • 1.Heads of departments in charge of supporting distribution industry and small commercial and industrial businessmen;
    • 2. A person recommended by the Busan Metropolitan Council;
    • 3. Representatives of large distribution enterprises;
    • 4. Representatives of small and medium distribution enterprises;
    • 5. Representatives of small commercial and industrial businessmen;
    • 6. Representatives of traditional markets;
    • 7. Representatives of civic groups; and
    • 8. Any other person who has knowledge and experience in distribution industry.
  • (4)The term of office of a commissioned Council member shall be two years, provided that it may be renewed for another two years. The term of office of a member filling a vacancy shall be the remaining term of office of the predecessor.
  • (5)The Chairperson shall represent the Council and be in charge of the overall operation of the Council. The Vice Chairperson shall act on behalf of the Chairperson in case the Chairperson is unable to perform his duties to unavoidable circumstances.
  • (6)The meeting of the Council shall be commenced upon attendance of a majority of the registered Council members. The Council shall adopt a decision with the approval of a majority of the attending Council members.
  • (7)The Council shall have one Secretary to carry out the affairs of the Council, provided that the Secretary shall be the assistant junior official in charge of supporting distribution industry.
  • (8)Payment of the allowances and travel expenses may, within limits of budget, be provided to the commissioned Council members.
  • (9)Matters other than those provided under this Ordinance that are necessary for the operation of the Council shall be determined by the Chairperson through a resolution of the Council.
    Article 5 (Support for Enhancement of Competitiveness of Small Commercial and Industrial Businessmen)
  • In order to enhance the competitiveness of small commercial and industrial businessmen, the Mayor shall establish policy measures concerning the matters falling under each of the following subparagraphs:
    • 1. Matters concerning support of the funds for business improvement;
    • 2. Matters concerning support of the funds for small facility improvement;
    • 3. Matters concerning support of the joint logistics center for small and mediumdistribution;
    • 4. Matters concerning support of business administration consulting;
    • 5.Matters concerning support for the education of advanced distribution techniques; and
    • 6. Matters concerning support for the exhibition of excellent local products.
    Article 6 (Contribution and Cooperation of Large Distribution Enterprises to Community, etc.) In order for the balanced development of local distribution industry and revitalization of the local economy, the Mayor may request proprietors of large distribution enterprises to cooperate for the matters falling under each of the following subparagraphs:
    • 1. Matters concerning the promotion of employment of local residents;
    • 2. Matters concerning the facilitation of moving in and supply of enterprises having business office in the community;
    • 3.Matters concerning the promotion of use of financial institutions having head office in the community; and
    • 4. Matters concerning the participation of local enterprises in services or construction.
  • (2)The Mayor shall actively carry out the policy measures such as by appointing and advertising large distribution enterprises that have contributed to mutual cooperation as excellent enterprises.
    Article 7 (Support for Mutual Cooperation Projects)
  • The Mayor may support working expenses within limits of budget through the deliberation of the Council to those who will do businesses or activities for the mutual cooperation.
