Busan Metropolitan City Ordinance on the Operation of Youth Centers

    Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe necessary matters on the effective operation of the youth centers which Busan Metropolitan City established in order to develop the youth's sound view point of the world and sentiment, and to support the activities of the youth.
    Article 2 (Names and Locations)
  • The youth centers (hereinafter referred to as the "Center") established by Busan Metropolitan City shall be named and located as belows.

    Busan Metropolitan City Gumjeong Youth Center Bugok-dong 200-62, Gumjeong-gu, Busan Metropolitan City
    Busan Metropolitan City Comprehensive Youth Support Center Duckpo-dong 247-6, Sasang-gu, Busan Metropolitan City
    Article 3 (Use of the Center, etc.)(1) Anyone falling under any of the following subparagraphs may use the Center.
    • 1. The youth pursuant to Article 3, Subparagraph 1 of the Framework Act on Juveniles;
    • 2. Anyone falls under Article 1 and Subpargraphs of Article 2 of the Juvenile Activity Promotion Act; or
    • 3. Anyone falls under Article 13, Subparagraph 2 of the Enforcement Decree of the Juvenile Activity Promotion Act.
    Article 4 (Service Hour)(1) The Center opens from 6:00 AM to 9:00 PM. However, the Mayor may extend or limit the service hour if he/she chooses to set otherwise according to the characteristics of the Center or the program.
  • (2) The Center closes on Sulnal(Lunar New Year's Day) and Chuseok(Traditional Thanksgiving Day).
    Article 5 (Payment of Service Fee, Etc.)(1) Anyone who wants to use the Center shall pay the service fee and service charge in accordance with the standard in the attached Table 1 and Table 2.
  • (2) The Mayor may collect the actual expense of electricities, city gas, air-conditioning and heating notwithstanding Article 6.
    Article 6 (Exemption of Service Fee, Etc.)(1) The Mayor may exempt service fee and service charge for anyone that falls under the following subparagraphs:
    • 1. When the State or the local government uses the Center to host an event;
    • 2. When youth-related organizations, etc host events which are suitable for their establishment purposes; or
    • 3. When a family member of "Families with Many Children" pursuant to the Busan Metropolitan City Ordinance on the Measure to Low Birth Rate and the Encouragement and Support of Childbirth uses the Center.
  • (2) The Mayor shall reduce the service fee by 10% to women from 13 years to 55 years old who use the swimming pool of the Center pursuant to the Attached Table 1.
    Article 7 (Return of Service Fee, Etc.)(1) The Mayor shall return the service fee collected pursuant to Article 5 in whole or in part in cases that fall under the following subparagraphs.
    • 1. When the user tried to use for one-time or one-night and requests the refund before the designated using time;
    • 2. When the user tried to use on monthly bases falls under the following items:
      • (A) In cases of the Busan Metropolitan City events or circumstances of the Center that disable use of the Center;
      • (B) When the user requests the refund due to his/her reason;
      • (C) In cases of natural disasters or other inevitable causes that disables use;
  • (2) The Mayor may return the service charges collected pursuant to Article 5 in whole or in part in cases that fall under the following subparagraphs.
    • 1. In cases of the Busan Metropolitan City events or circumstances of the Center that disable use of the Center;
    • 2. When the user who already got the permission to use requests the refund due to his/her reason;
    • 3. In cases of natural disasters or other inevitable causes that disables use.
  • (3) Returning of the service fee and service charge pursuant to Paragraph 1 and 2 shall follow the standard of the attached Table 3.
    Article 8 (Approval for Utilization)(1) Those who wishes to use the Center shall get permission from the Mayor, and the same shall apply when changes are to be made. However, this shall not apply when they participate programs which the Mayor or the head of the Center operate by themselves.
  • (2) Those who have permission for using facilities (hereinafter referred to as the “Center user”) may install suitable facilities at their own expense with the approval of the Mayor.
    Article 9 (Suspension of Use)(1) The Mayor may order suspension of use in cases that fall under the following subparagraphs:
    • 1. When approval was obtained through false or illegal measures;
    • 2. When the provisions of this Ordinance are violated;
    • 3. When the terms of utilization approval are not kept;
    • 4. When there is a natural disaster or any other extraordinary cause that disables use.
  • (2) The Mayor shall not be responsible for damages of users due to the suspension of use in cases prescribed in from Subparagraph 1 to Subparagraph 3 of Paragraph 1.
    Article 10 (Recovery to the Original State)(1) When the Center user completes or suspends utilization, the facilities installed pursuant Article 8, Paragraph 2 shall be removed immediately.
  • (2) In case the Center user does not remove pursuant to Paragraph 1, the Mayor may remove by himself/herself or have a third person remove on his/her behalf, and the cost may be collected from the Center user.
    Article 11 (Compensation)
  • If a Center user damages or harm the facilities of the Center, he/she shall compensate for the loss.
    Article 12 (Entrustment of Operation)(1) The Mayor may entrust the management and operation of the Center for the effective management and professional operation pursuant to laws regarding the youth.
  • (2) Agreement shall be reached with the consignee (hereinafter referred to as the "consignee") when the Mayor entrusts the management and operation pursuant to Paragraph 1, and the term of entrustment shall be 3 years.
  • (3) When the management and operation is entrusted pursuant to Paragraph 1, the operational costs that entail entrustment management shall be appropriated through service charge, service fee and other facility operation related revenues that are incurred. In this case, the Mayor may subsidize the insufficient operational cost within the scope of the budget.
    Article 13 (Duties of the Consignee)(1) The consignee shall take caution and dutifully manage the Center as a good intentioned manager.
  • (2) The consignee shall not transfer his/her right of the management and operation of the Center to a third party or lease the Center without the approval of the Mayor.
  • (3) If the consignee wants to prepare an operation rule on necessary matters for the management and operation of the Center, he/she shall have it approved by the Mayor.
    Article 15 (Cancellation of Entrustment)
  • The Mayor may cancel the entrustment contract in any case of the following subparagraphs:
    • 1. When the consignee violates related laws and this Ordinance;
    • 2. When the consignee breaches the terms of entrustment contract;
    • 3. When the establishment approval is canceled if the consignee was a juristic person or an organization;
    • 4. When there is other reason that hinders the normal operation of the Center due to the consignee's fault.
