Busan Metropolitan City Ordinance on Settlement Support of the Residents Escaping from North Korea
- Article 1 (Purpose)
- The purpose of this Ordinance is to provide for the matters necessary for the settlement support of the residents escaping from North Korea to help them to live a life worth living as members of the society and stably settle down in a community.
- Article 2 (Definition)
- The term "residents escaping from North Korea" refers to the residents escaping from North Korea as provided under subparagraph 1 of Article 2 of the Act on the Protection and Settlement Support of Residents Escaping from North Korea who have their address and residence in Busan Metropolitan City.
- Article 3 (Policy Measures on Settlement Support of Residents Escaping from North Korea)(1) In order for the residents escaping from North Korea can stably settle
down in a community, the Busan Metropolitan City Mayor (hereinafter referred to
as the "Mayor") shall establish ‧ implement policy measures concerning the
settlement support of the residents escaping from North Korea, including those
falling under each of the following subparagraphs:

- 1. Social adaptation education and economics education;
- 2. Counseling for difficulties with settlement processes;
- 3. Support for vocational training and adaptation to work after employment; and
- 4. Other projects necessary for self-reliance ‧ settlement of the residents escaping from North Korea
- (2) The Mayor may investigate on the status, actual condition of settlement, etc. of the residents escaping from North Korea to carry out the policy measures concerning the settlement support of the residents escaping from North Korea.
- Article 4 (Support of Private Organizations, etc.)(1) In case of having a corporation
or organization carry out the support projects for self-reliance ‧ settlement of the
residents escaping from North Korea, the Mayor may, within limits of budget,
support all or part of the expenses necessary for carrying out the projects.
- (2) This Ordinance shall apply provisions of the Busan Metropolitan City Ordinance on Subsidy Management with regard to the procedures, methods, etc. of application for support of the expenses as provided under Paragraph 1.
- Article 5 (Establishment of Residents Escaping from North Korea Support Council,
etc.) (1) The Mayor shall have a Residents Escaping from North Korea Support
Council (hereinafter referred to as the "Council") to deliberate ‧ discuss the matters
concerning the settlement support of the residents escaping from North Korea
falling under each of the following subparagraphs:

- 1. Matters concerning the private ‧ public cooperation on settlement of the residents escaping from North Korea;
- 2. Matters concerning carrying out of the support projects for self-reliance ‧ settlement as provided under Paragraph 4;
- 3. Matters concerning the development of programs for self-reliance ‧ settlement of the residents escaping from North Korea; and
- 4. Other matters concerning self-reliance ‧ settlement of the residents escaping from North Korea referred by the Chairperson to the meeting of the Council.
- (2) The Council shall be composed of fifteen members including one Chairperson and one Vice Chairperson.
- (3) The Chairperson and Vice Chairperson shall be elected from the Council
members. Persons falling under each of the following subparagraphs shall be the
Council members:
- 1. Women and Family Policy Bureau Official;
- 2. Each of public officials of Grade III belonging to the Busan Metropolitan City Office of Education, Busan Metropolitan Police Agency and Busan Local Labor Office who is appointed by the heads of the relevant agencies; and
- 3. Persons commissioned by the Mayor among those who fall under any of the
following subparagraphs:
- (A) A person recommended by the Busan Metropolitan Council;
- (B) A person who is the head of an agency or corporation ‧ organization carrying out duties concerning the settlement support of the residents escaping from North Korea; or
- (C) A person who has knowledge and experience in the settlement support of the residents escaping from North Korea.
- (4) The term of office of a commissioned Committee member shall be two years, provided that it may be renewed for another two years. The term of office of a member filling a vacancy shall be the remaining term of office of the predecessor.
- Article 6 (Operation of the Council, etc.)(1) The Chairperson shall represent the Council and be in charge of the overall operation of the Council.
- (2) The Vice Chairperson shall assist the Chairperson and act on behalf of the Chairperson in case the Chairperson is unable to perform his duties due to unavoidable circumstances.
- (3) The meeting of the Council shall be convened by the Chairperson in case recognised by the Chairperson as necessary or requested by one third of the registered Council members.
- (4) The meeting of the Council shall be commenced upon attendance of a majority of the registered Council members. The Council shall adopt a decision with the approval of a majority of the attending Council members.
- (5) The Council shall have one Secretary to carry out the affairs of the Council, provided that the Secretary shall be the assistant junior official in charge of the duties concerning the residents escaping from North Korea.
- (6) Payment of the allowances and travel expenses may, within limits of budget, be provided to the commissioned Committee members.
- (7) Matters other than those provided under this Ordinance that are necessary for the operation of the Council shall be determined by the Chairperson through a resolution of the Council.
