BUSAN METROPOLITAN CITY ORDINANCE ON MEASURES TO BOOST LOW BIRTH RATE AND SUPPORTING CHILDBIRTH AND CHILD REARING

    Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe matters necessary for creating a favorable environment for childbirth and child rearing, to actively respond to the low birth rate, thereby advocating the social responsibility for childbirth and child rearing and contributing to make a sustainable development of our society and improve life quality of its citizens.
    Article 2 (Definitions)
  • The terms used in this Ordinance are defined as follows:
    • 1. The term “measures to boost low birth rate” means policies established and implemented recognize the social importance of pregnancy, childbirth and child rearing and to respond effectively to low birth rates;
    • 2. The term "multi-child family" in this Ordinance means a family having a domicile in Busan Metropolitan City (hereinafter referred to as the "City") and with at least three children by birth or adopting (Provided, That only referring to the cases where at least one of the children are under 19 years old).
    Article 3 (Responsibility of the City)
  • The City shall actively develop and implement policies for solving low birth rate problems and supporting childbirth and child rearing and shall duly perform responsibilities prescribed by Framework Act On Low Birth Rate In An Aging Society.
    Article 4 (Responsibility of Citizens)
  • Every citizen shall recognize the importance of childbirth and child rearing and endeavor to respond to low birth rates; and business entities and institutions, etc. located in the City shall actively endeavor to support childbirth and child rearing of their employees and to create a favorable local environment for child birth and child rearing.
    Article 5 (Relationship to Other Municipal Ordinances)
  • Where the City enacts or amends other municipal ordinances regarding the measures for the low birth rate problems and the support of childbirth and child rearing, it shall ensure that such municipal ordinances conform to the purpose of this Ordinance.
    Article 6 (Establishment and Implementation of Comprehensive Plan for Solving Low Birth Rate Problems)
  • ① The Busan Metropolitan City Mayor (hereinafter referred to as the "Mayor") shall establish and implement a comprehensive plan for solving low birth rate every five years based on the basic plan on low-birthrate in an aging society referred to in Article 20 of the Framework Act on Low-Birthrate in an Aging Society.
  • ② The comprehensive plan for solving low birth rate shall include the following matters:
    • 1. The objective and direction of the comprehensive plan for solving low birth rate;
    • 2. The plan for providing more healthcare to mothers and children;
    • 3. The policy for creating a pro-childbirth and child rearing social environment such as childbirth and co-parenting;
    • 4. The plan for strengthening child care services;
    • 5. The policy for giving preferential treatment to multi-child households;
    • 6. Other matters for solving low birth rate.
    Article 7 (Establishment and Implement of Yearly Implementation Plans)
  • The Mayor shall establish and implement an yearly implementation plan every year based on the comprehensive plan for solving low birth rate problem referred to in Article 6. In such cases, the yearly implementation plan may be incorporated into the yearly implementation plan on low-birthrate in an aging society referred to in Article 21 of the Framework Act on Low-Birthrate in an Aging Society.
    Article 8 (Childbirth Impact Assessment)
  • ① The Mayor may systematically analyze the impact on childbirth at the stage of establishing and implementing policies, etc. related to childbirth and conduct a childbirth impact assessment to reflect them in policies related to low birth rates.
  • ② Where the Mayor conducts a childbirth impact assessment, he/she may include it in the analysis of the impact of population policy under Article 6 ② and Article 8
  • ③ of the Framework Ordinance on Population Policy in Busan Metropolitan City.
    Article 9 (Supporting for Childbirth and Child rearing)
  • If a household member of a multi-child family, at least 19 years of age, applies, the Mayor shall issue a family love card identifying that a household is a multi-child family to support the encouragement of childbirth.
    Article 9 (Day of Multi-Child Families)
  • (1) The Mayor may provide each of the following supports to parents who gave birth and are rearing children within the budget. In such cases, the father or mother of a child must have the resident registration in the City on the day of reporting the birth of the child:
    • 1. Subsidy for childbirth;
    • 2. Subsidy for child rearing, child care, and education;
    • 3. Insurance premium of children;
    • 4. Other matters necessary for supporting childbirth and child rearing.
  • ② The Mayor may support newly married couple or pregnant women with expenses for welfare within the budget. In such cases, the newly married couple or she must have the resident registration in the City at the time of the payment of such expenses.
  • ③ The Mayor shall formulate and implement a detailed supporting plan for the specific standards and procedures, etc. of supporting the childbirth and child rearing every year.
    Article 10 (Support for couple’s and father’s parenting)
  • ① The Mayor may implement the following projects to create a parenting environment in which couples and fathers actively participate in parenting:
    • 1. Educational projects necessary for couples’ and fathers’ parenting;
    • 2. A project to support the operation of couples’ and fathers’ parenting programs;
    • 3. Projects such as counseling, mentoring, and networking related to couples’ and fathers’ parenting;
    • 4. Other projects deemed necessary by the Mayor to support couples’ and fathers’ parenting.
    • ② The Mayor may, if necessary for the efficient implementation of projects under paragraph ①, entrust all or part of the projects to the relevant corporation or organization.
    Article 11 (Support for Caring Grandchildren) Encouragement Policies)
  • The Mayor may provide each of the following supports to grandparents aged 65 or over who take care of grandchildren aged 5 or under:
    • 1. Education necessary for caring grandchildren;
    • 2. Arts or sports programs for grandparents accompanying grandchildren;
    • 3. Psychology counseling for difficulties in caring grandchildren;
    • 4. Other matters deemed necessary by Mayor for caring of grandchildren.
    Article 12 (Support for Institutions and organizations, etc.)
  • The Mayor, in order to respond to low childbirth-rate may provide the administrative and financial support to citizens, corporations, institutions and organizations that cooperate with policies for creating a childbirth and child rearing-friendly environment.
    Article 13 (Education and promotion, etc.)
  • ① The Mayor shall provide citizens with education to improve their understanding and awareness of the actual conditions of low birth rates and measures and carry out promotions using various media, etc.
  • ② The Mayor may distribute policy promotional materials, promotional items, etc. within budgetary limits in order to actively promote education and promotion under paragraph 1 to cope with low birth rates.
    Article 14 (Prize)
  • The Mayor may award prizes to any of the following persons pursuant to the Busan Metropolitan City Ordinance on Prizes to implement support policies for childbirth, child rearing, etc. to cope with low birth rates:
    • 1. Persons who contributed to solving the low birth rate problems and supporting childbirth and child rearing;
    • 2. Exemplary families from among multi-child families;
    • 3. Business entities that supported childbirth and child rearing among their employees and contributed to forming a local pro-childbirth and child rearing environment.

    Article 1 (Enforcement Date)
  • This Ordinance shall enter into force one month after the date of its promulgation.
    Article 2 (Expiration Date)
  • Articles 12 through 18 shall be effective until December 31, 2019.

    Article 2 (Transitional Measures concerning Comprehensive Plans for Solving Low Birth Rate Problems and Yearly Implementation Plan)
  • The comprehensive plan for solving low birth rate problems and the yearly implementation plan formulated by Busan Metropolitan City at the time this Ordinance enters into force shall deemed the comprehensive plan for solving low birth rate problems and the yearly implementation plan formulated under Articles 5 and 6 of this Ordinance.
