BUSAN METROPOLITAN CITY ORDINANCE ON YOUTH DEVELOPMENT AND SUPPORT

  • Article 1 (Purpose)
  • The ordinance aims at stipulating the requirements for the sound nurturing and support for the youth delegated by the Framework Act on Youth.
  • Article 2 (Responsibilities of the Mayor)
  • ① The Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor“) shall prepare development plans for nurturing youth, such as the establishment and implementation of comprehensive policies necessary for the growth of youth
  • ② The Mayor shall cooperate with the Busan Metropolitan Office of Education, the Gu/Gun, related institutions and organizations to nurture and support youth.
  • Article 3 (Formulation of Master Plans for Youth Policy in Busan Metropolitan City)
  • ① The Mayor shall formulate a five-year master plan for youth policy in busan metropolitan city (hereinafter referred to as the “Master plan”) considering the conditions and circumstances of youth policy in Busan Metropolitan City (hereinafter referred to as the “City”) based on the master plan for youth development under Article 13 of the Framework Act on Youth.
  • ② The master plan shall include matters referred to in the subparagraphs of Article 13
  • ② of the Act and matters necessary for Youth policy.
  • Article 4 (Formulation and Implementation of an Annual Implementation Plan)
  • The Mayor shall formulate and implement an annual implementation plan under the master plan under Article 3 ①.
  • Article 5 (Establishment of the Busan Metropolitan City Youth Development Committee)
  • The Busan Metropolitan City Youth Development Committee (hereafter called “Committee”) shall be in place to deliberate on the major policies of the city on the youth development, pursuant to Article 11 of the Act.
  • Article 6 (Composition of the Committee)
  • ① The Committee shall consist of up to 20 members, including one chairperson and one vice chairperson, respectively.
  • ② The Administration Deputy Mayor shall act as the chairperson of the Committee, and the vice chairperson shall be elected out of the members.
  • ③ The director general in charge of Youth affairs shall be ex officio members, and the Mayor shall appoint or commission members in consideration of gender from among the following persons:
    • 1. Person recommended by the Busan Metropolitan City Council;
    • 2. Relevant agency official pertaining to youth development;
    • 3. Youth leader pursuant to the Act Article 3 Paragraph 7;
    • 4. Person recommended by the youth organization pursuant to the Act Article
    • 3 Paragraph 8;
    • 5. Person highly knowledgeable of youth development with an abundance of experiences;
    • 6. Youth who has abundant experience in activities related to youth policies, etc.
  • Article 7 (Functions of the Committee)
  • The Committee shall deliberate on the following matters:
    • 1. Establishment of a master plan and annual implementation plans for the nurture, etc. of youth;
    • 2. Coordination of policies on the nurture, etc. of youth of relevant administrative agencies and cooperation among them;
    • 3. Establishment and management of youth training facilities and support therefor;
    • 4. Promotion of and support for youth organizations;
    • 5. Evaluation and systematic improvement of youth nurture policies;
    • 6. Matters on the subparagraphs of the Busan Metropolitan City Out-of-school Youth Support Ordinance Article 6 Paragraph 1;
    • 7. Other matters deemed necessary by the Mayor for youth development.
  • Article 8 (Term of Office of Member)
  • ① The appointed members shall serve the term of two years with one consecutive term allowed.
  • ② A supplementary member shall serve the remaining term of a predecessor member.
  • Article 9 (Duties of Chairperson)
  • ① The Chairperson shall exercise general supervision and control over the affairs of the Committee and represent it when required.
  • ② The vice chairperson shall act on behalf of the chairperson if the chairperson is unable to carry out his/her duties due to unavoidable reasons, and a member designated in advance by the Chairperson shall act for the chairperson if both the chairperson and vice chairperson are unable to fulfill the duties.
  • Article 10 (Meeting)
  • ① A meeting of the Committee shall be convened by the Chairperson.
  • ② The meeting of the Committee shall convene with the attendance of a majority of the registered members and reach a decision with the consent of a majority of the attending members.
  • Article 11 (Secretary)
  • The Committee shall have one administrative secretary in place, and the head of the department in charge of the youth-related works shall act as the administrative secretary.
  • Article 12 (Minutes)
  • The Committee shall prepare and keep the minutes of each meeting.
  • Article 13 (Opinion Hearing, etc.)
  • The Chairperson may, if deemed necessary, have relevant public officials or experts, interested persons, or local residents present themselves before the Committee and give their opinions concerning the matters on the agenda therefor.
  • Article 14 (Allowances)
  • The Committee may pay allowance and travel expense, within the budget, to the appointed members, relevant specialists, and concerned persons for attending the meeting.
  • Article 15 (Founding of the Busan Metropolitan City Youth Organization Council)
  • ① The Mayor may authorize to found the Busan Metropolitan City Youth Organization Council (hereafter called “Council”), pursuant to Act Article 41, to promote the desirable youth development activities, which suits the local characteristic, and contribute to the local development via mutual partnership and exchanges by and between the national and city youth organizations.
  • ② The Council shall be founded as a corporation.
  • ③ The Council shall constitute with the incorporation registered at the location of its main office. In such cases, the office of the Council shall be located in any district under the jurisdiction of the City.
  • ④ The stipulation on a corporation in the Civil Code shall be applied, except for the stipulations on the Council in the ordinance.
  • Article 16 (Projects of the Council)
  • The Council shall implement those projects which fall under any of the following subparagraphs:
    • 1. Cooperation and assistance in projects and activities of member organizations;
    • 2. Cooperation and exchange with domestic and foreign youth;
    • 3. Issue and publicity of youth-related books and publications;
    • 4. Investigation, research, and collection of data on youth problems and activities;
    • 5. Provision of information on youth training and service activities;
    • 6. Awarding of prizes to excellent member organizations and exemplary youth leaders and youth;
    • 7. Consigned activity from the City;
    • 8. Other projects necessary for the development of youth and support for youth organizations.
  • Article 17 (Duty of Cooperation)
  • The Council shall strive to establish the partnership and support system with the National Council for Youth Organizations in Korea, pursuant to the Act Article 40 Paragraph 1 Subparagraph 9.

Addenda

  • Article 1 (Enforcement Date)
  • Article 2 (Transitional Measures for Committee and members)
  • ① The Committee established pursuant to the previous regulations and the members appointed and commissioned shall be deemed to be the committee established pursuant to Articles 5 and 6, respectively, and the members appointed and commissioned.
  • Article 3 (Transitional Measures for the Council)
  • The council established pursuant to the previous provisions shall be deemed to be the council established pursuant to Article 15
    • ①. This Ordinance shall enter into force on the date of its promulgation.
    • ② The term of office of a member commissioned pursuant to paragraph ①shall be calculated based on the commencement date of his/her term of office prior to the enforcement of this Ordinance.
