BUSAN METROPOLITAN CITY RULE ON THE DISCLOSURE OF INFORMATION

(Enforcement Regulations for Ordinance on the Establishment of Administrative Organizations)
- Article 1 (Purpose)
- The purpose of this rule is to stipulate matters necessary for the implementation of the "Busan Metropolitan City Information Disclosure Ordinance".
- Article 2 (Definitions)
- The definitions of terms used in this Ordinance shall be as follows:
- 1. The term "general affairs department" means a department in charge of information disclosure, such as receipt and distribution of information disclosure requests, management of processing records, and operation of the Busan Metropolitan City Information Disclosure Council (hereinafter referred to as the "Council");
- 2. The term "department-in-charge" means the department that produces, retains and manages the information, and to deal with the information opening affairs.
- Article 3 (Installation and operation of guidance and reception counters)
- ① The Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") shall establish and operate a guidance and reception counter in the civil service center so that citizens may easily request information disclosure.
- ② The mayor shall keep the following documents at the information and reception desk pursuant to paragraph ① for citizens to use or view conveniently:
- 1. Information List and Advance Information Disclosure List;
- 2. Information Disclosure Manual including information disclosure requests, processing procedures, fees, etc;
- 3. Information disclosure request ceremony, computer terminal, etc. for the convenience of the claimant.
- Article 4 (Procedures for Disclosure of Prior Information, etc.)
- ① In case the mayor intends to disclose information in advance pursuant to Article 4 of the Busan Metropolitan City Information Disclosure Ordinance, the mayor shall establish a list of preliminary information disclosure after deliberation by the council in advance, and disclose it so that citizens can easily learn it through the Busan Metropolitan City Internet homepage, etc.
- ② In case the contents of prior information disclosure include information subject to non-disclosure pursuant to Article 9 ① of the Act on Disclosure of Information by Public Institutions, it shall be disclosed except thereof.
- ③ Prior information disclosure shall be carried out by the head of the department in charge of producing, retaining, and managing the information. However, if the department in charge is unclear or multiple departments are involved, the head of the general department shall designate the department in charge.
- Article 5 (Procedures for Disclosure of Information, etc.)
- ① The head of the department in charge of submitting a bill to the Deliberation Council shall submit a request for deliberation in attached Form 1 or attached Form 2 to the head of the general affairs department by not later than five days before the deliberation council is held.
- ② The head of the general affairs department shall send a bill to the members by not later than two days before the meeting of the Council.
- ③ The head of the department in charge shall attend a meeting of the Deliberation Council and explain the details of the bill.
- ④ The executive secretary of the deliberation council shall prepare minutes and a written resolution for deliberation of the information disclosure council in attached Form 3.
- ⑤ The head of the general affairs department shall notify the head of the department in charge of submitting the relevant bill of results resolved by the deliberation council.
- Article 6 (Designation of Information Disclosure Officer)
- The Busan Metropolitan City Information Disclosure Officer pursuant to Article 11-2 of the Enforcement Decree on the Disclosure of Information by Public Institutions shall be the Director of the Administrative and Autonomous Bureau and shall perform the following duties related to the disclosure of information. <Amended on Jul. 10, 2013; Jan. 1, 2015; Aug. 1, 2018; Jan. 9, 2019>
- 1. Affairs of Article 11, paragraphs 2 ① to 4 of the 「Enforcement Decree on the Disclosure of Information by Public Institutions」;
- 2. Comprehensive and systematic management of information disclosure business.
- Addenda (Implementing Regulations for the Establishment of Administrative Organizations) <Jan. 9, 2019>
- Article 1 (Effective Date)
- These rules shall take effect from the date of their promulgation.
- Article 2 (Amendments to Other Rules)

- ⑩ Part of the Enforcement Rules of the Busan Metropolitan City Information Disclosure Ordinance shall be amended as follows: Article 6 Among the parts other than each subparagraph, the "Director of the Administrative Support Bureau" shall be the "Director of the Administrative Autonomy Bureau".
