BUSAN METROPOLITAN CITY ORDINANCE ON SUPPORT FOR VOLUNTEER SERVICE ACTIVITIES

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to provide for matters mandated by the Framework Act on Volunteer Service Activities and the Enforcement Decree thereof and to encourage volunteer service activities, thereby contributing to building a happy community in which people help each other.
  • Article 2 (Responsibilities of the City)
  • Busan Metropolitan City (hereinafter referred to as the "City") shall formulate policies for promoting volunteer service activities in order to encourage and support popular engagement in volunteer service activities.
  • Article 3 (Scope of Volunteer Service Activities)
  • This Ordinance applies to the following volunteer service activities:
    • 1. Activities that promote social welfare and public health;
    • 2. Activities that develop and improve communities;
    • 3. Activities that preserve the environment and protect nature;
    • 4. Activities that promote the rights and interests of the socially vulnerable and that foster and protect youths;
    • 5. Activities related to education and counseling;
    • 6. Activities related to human rights advocacy and peace-keeping;
    • 7. Activities related to crime prevention and proper guidance;
    • 8. Activities related to traffic order and guidance as to basic order;
    • 9. Activities related to disaster and calamity control and relief;
    • 10. Activities that promote culture, tourism, arts, and sports;
    • 11. Activities related to anti-corruption and consumer protection;
    • 12. Activities related to fair elections;
    • 13. Activities related to international cooperation and overseas volunteer activities;
    • 14. Activities related to support for office workers in the public administration sector;
    • 15. Other activities necessary in order to perform public projects and to promote the welfare of residents.
  • Article 4 (Establishment and Functions)
  • (1) The Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") shall establish a Busan Metropolitan City's Volunteer Service Development Committee (hereinafter referred to as the "Committee") in order to formulate policies for developing volunteer service activities and to encourage and support popular engagement in volunteer service activities.
  • (2) The Committee shall deliberate and decide on the following matters:
    • 1. The establishment of fundamental policies for volunteer service activities;
    • 2. Agreement on and adjustment of policies for volunteer service activities;
    • 3. Matters concerning the implementation of public projects related to volunteer service activities;
    • 4. Other matters the Mayor submits to a meeting regarding volunteer service activities.
  • Article 5 (Composition)
  • (1) The Committee shall be composed of not more than 20 members including one Chairperson.
  • (2) Members of the Committee shall consist of the Chief of the Administrative Management Bureau, the Chief of the Welfare and Health Bureau, the Chief of the Women and Family Affairs Bureau, the Director of the Busan Metropolitan City Volunteer Center, and civilians who are commissioned by the Mayor, taking into consideration of their gender, from among those with profound knowledge and experience in volunteer service activities; and the Chairperson shall be elected by and from among the civilian members of the Committee.
  • (3) The term of office for commissioned members shall be two years, and members may be recommissioned only once.
  • (4) In order to deal with general affairs, the Committee shall have one secretary and that secretary shall be the director in charge of volunteer service affairs.
  • Article 5-2 (Dismissal of Members)
  • The Mayor may dismiss a member under any of the following circumstances:
    • 1. Where the member becomes unable to perform his or her duties due to his or her mental or physical disorder;
    • 2. Where it is found that the member engages in any misconduct in connection with his or her duties;
    • 3. Where the member is deemed unfit to serve as a member due to neglect of duty, loss of dignity, or any other reason;
    • 4. Where the member voluntarily declares that it is difficult to perform his or her duties.
  • Article 6 (Duties of the Chairperson)
  • (1) The Chairperson shall represent the Committee and exercise general supervision and control over its affairs.
  • (2) Where the Chairperson is unable to perform his or her duties due to any unavoidable cause, a member appointed in advance by the Chairperson shall act on his or her behalf.
  • Article 7 (Meetings)
  • (1) The Chairperson shall convene and preside over meetings of the Committee.
  • (2) Meetings of the Committee shall be convened with the attendance of a majority of all incumbent members, and resolutions shall be adopted by the affirmative vote of a majority of those present.
  • Article 8 (Allowances)
  • Allowances and travel expenses within budgetary limits may be paid to the commissioned members.
  • Article 9 (Operating Rules)
  • Except as provided for in this Ordinance, the Chairperson shall decide matters necessary for the operation of the Committee based on resolutions passed by the Committee.
  • Article 10 (Establishment)
  • The Mayor shall establish the Busan Metropolitan City Volunteer Service Center (hereinafter referred to as the "Center") pursuant to Article 19 of the Framework Act on Volunteer Service Activities, in order to efficiently support and encourage volunteer service activities.
  • Article 11 (Major Projects)
  • The Center shall perform the following projects:
    • 1. Establishment of a regular cooperative system among organizations and groups in a community;
    • 2. Training programs for managers and leaders of volunteer services;
    • 3. Development and deployment of volunteer service programs;
    • 4. Surveys and research as to volunteer services;
    • 5. Operation of an information archive of volunteer services;
    • 6. Cooperation, arrangements, and support for information and projects between volunteer centers of Gus and Guns;
    • 7. Other projects that can contribute to the promotion of volunteer services in a community.
  • Article 12 (Appointment of the Head of the Center)
  • (1) The head of the Center established under Article 10 (hereinafter referred to as the "head of the Center") shall be appointed by the Mayor via open recruitment of those qualified under Article 14 (1) of the Enforcement Decree of the Framework Act on Volunteer Service Activities (hereinafter referred to as the "Decree"): Provided, That where a corporation operates the Center, the head of the Center shall be appointed by the corporation.
  • (2) The head of the Center pursuant to the proviso of paragraph (1) shall be appointed by the chief director of the corporation after undertaking open recruitment and following a resolution by the corporation's board of directors at a general meeting based on a recommendation by the chief director; and the Mayor shall be notified as to the result.
  • (3) The term of office of the head of the Center shall be three years.
  • (4) Matters concerning the open recruitment of the head of the Center shall be published in the Official Gazette of Busan Metropolitan City and the website of the City.
  • Article 13 (Administrative Office)
  • The administrative office, pursuant to Article 15 of the Decree, shall have one director and other employees necessary for its work.
  • Article 14 (Operation Committee)
  • (1) The operation committee, pursuant to Article 15 of the Decree, shall be composed of 15 members including the chairperson.
  • (2) The chairperson of the operation committee shall be the head of the Center; and the members shall consist of a public official in charge of volunteer services and persons who are commissioned by the chairperson, from among the following persons. In such cases, those falling under subparagraph 2 shall be civilians, and the number of civilians on the committee shall be such as to put civilians in the majority on the committee:
    • 1. Persons with profound knowledge and experience in volunteer service activities;
    • 2. Representatives of the volunteer service groups registered with the Center.
  • (3) The provisions of Articles 6 through 9 shall apply mutatis mutandis to the operation of the operation committee.
  • Article 15 (Entrusted Operation)
  • Where the Center is operated by entrusting it to a non-profit corporation pursuant to Article 19 of the Framework Act on Volunteer Service Activities, the period of operation shall be three years.
  • Article 16 (Termination of Entrustment Contract)
  • The Mayor may terminate an entrustment contract in any of the following circumstances:
    • 1. Where a contractor violates the provisions of the related statutes, regulations, or this Ordinance;
    • 2. Where a contractor violates the conditions of an entrustment contract;
    • 3. Where there arises a cause to discontinue an operation based on an entrustment contract to protect the public interest.
  • Article 17 (Subsidy for the Center)
  • The Mayor may subsidize necessary expenses for the operation, etc. of the Center within budgetary limits.
  • Article 18 (Budgets and Settlements)
  • (1) Where the Center intends to be subsidized under Article 17, it shall submit its project plan and budget plan for the fiscal year to the Mayor no later than three months prior to the commencement of the relevant fiscal year. The same shall apply to any modification of such plan.
  • (2) The Center shall formulate an account statement as to revenues and expenses and a balance sheet for every fiscal year and submit them to the Mayor no later than the end of February of the next fiscal year.
  • (3) The Center shall preserve accounting data including all account statements as to revenues and expenses and including all balance sheets created pursuant to paragraph (2) for five years after the close of a fiscal year.
  • Article 19 (Support for Volunteer Service Groups)
  • The Mayor may provide administrative assistance for the activities of volunteer service groups and subsidize their operation expenses within budgetary limits, as prescribed in the Assistance for Non-Profit, Non-Governmental Organizations Act.
  • Article 20 (Volunteers' Day and Volunteer Service Week)
  • The Mayor may hold any of the following events to commemorate Volunteer Service Week, which takes place for a week starting from Volunteers' Day, which falls on December 5 every year:
    • 1. Commemorative events;
    • 2. Research presentations and international exchange events;
    • 3. Events to encourage volunteer contributors and worthwhile organizations;
    • 4. Promotion via mass media, etc.;
    • 5. Other events to raise people's interest in promoting volunteer services.
  • Article 21 (Career Recognition)
  • (1) Where a volunteer has consistently performed volunteer work in a certain field over a certain period, the Mayor may recognize the volunteer's career.
  • (2) Matters necessary for career recognition pursuant to paragraph (1) shall be separately decided by the Mayor.
  • Article 22 (Procedure and Method of Insurance Subscription)
  • (1) The Mayor may subscribe to insurance or to mutual aid in order to protect the volunteers belonging to the Center or to registered groups pursuant to the Assistance for Non-Profit, Non-Governmental Organizations Act.
  • (2) The Mayor may allow the Center to perform the following actions concerning subscription to insurance or mutual aid pursuant to paragraph (1):
    • 1. Applying for a subscription;
    • 2. Concluding contracts and payment requests.
  • (3) When subscribing to insurance or to mutual aid under paragraph (1), the Mayor may partially or wholly subsidize insurance premiums or mutual-aid fees within budgetary limits.
  • Article 23 (Payment of Actual Expenses)
  • The Mayor may supply volunteers with supplies and expenses necessary for providing volunteer services.
  • Article 24 (Awards)
  • Pursuant to the Busan Metropolitan City Ordinance on Awards, the Mayor may give awards to volunteers, volunteer groups, public officials and other persons whose volunteer efforts have made significant contributions to the community.
  • Article 25 (Selection of Excellent Volunteers and Courtesies Extended to Same)
  • (1) The Mayor may issue a certification card by selecting a volunteer with excellent volunteer performance for recognition as an excellent volunteer. In such cases, matters necessary to the selection and issuance of a certification card to an excellent volunteer shall be separately decided by the Mayor.
  • (2) The following awards may be given to volunteers selected under paragraph (1):
    • 1. Invitation to major festivals and events held by the City;
    • 2. Provision of tickets for cultural events and performances hosted by the City;
    • 3. Posting a list of excellent volunteers in various print media published by the City including the Official Gazette of Busan Metropolitan City, the City website, etc.
    • 4. A reduction in parking fees in public parking lots installed and operated by the City or in parking lots the operation of which has been entrusted to others by the City;
    • 5. Other matters deemed necessary by the Mayor as a courtesy to excellent volunteers.
  • (3) The Mayor may create a walk of fame for volunteers (including a cyber space installation on the City's website) in a specific place in order to inspire volunteer pride and spread the culture of volunteer services.

  • Article 1 (Enforcement Date)
  • This Ordinance shall enter into force on the date of its promulgation.
