Busan Metropolitan City Ordinance on the Operation of the Women's Hall Facilities

    Article 1(Purpose)
  • The purpose of this Ordinance is to prescribe necessary matters on the operation of the Women's Hall Facilities which Busan Metropolitan City established in order to develop women's ability and enhance the welfare of women.
    Article 2(Scope of Application)
  • This ordinance shall apply to the Women's Hall Facilities (hereinafter referred to as the "Hall") as follows;
    • 1. Busan Metropolitan City Women's Hall;
    • 2. Busan Metropolitan City Women's Cultural Hall.
    Article 3(Use of the Hall) (1) The following users can use the Hall.
    • 1. Female residents of Busan Metropolitan City and her family in her company;
    • 2. Other people who the Busan Metropolitan City Mayor (hereinafter referred to as the "Mayor") approves to be necessary within the boundary of inflicting no harm to the operation of the Hall.
  • (2) The Mayor may limit the use of facility or dismiss persons from the facility for those who fall under the following subparagraphs.
    • 1. Persons who have dangerous or odorous items;
    • 2. Persons who interfere with other's use of Hall due to loud noise, etc;
    • 3. Other persons who the Mayor deems necessary to limit usage for the protection of other users and facilities of Hall.
    Article 4(Payment and Exemption of Tuition) (1) Anyone who wants to participate lessons, etc of the Hall shall pay the tuition in accordance with the standard in the attached Table 1.
  • (2) The Mayor may exempt the tuition for anyone that falls under the following subparagraphs:
    • 1. Beneficiaries of the National Basic Living Security Act or the Single-parent Family Welfare Act who take part in technical education to earn skills;
    • 2. Patriots and Veterans and their bereaved family or family pursuant to Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Services to the State;
    • 3. The handicapped with the Level 3 or higher who has enrolled pursuant to the Welfare of Disabled Persons Act and who support them;
    • 4. A family member with more than 3 children due to the childbirth after the year of 2000;
    • 5. Other persons who take part in education hosted by the Hall in areas of public relations, job training, business start-up, volunteering and etc.
    Article 5(Return of Tuition) (1) The Mayor shall return the tuition in whole or in part in cases that fall under the following subparagraphs.
    • 1. When natural disasters or other inevitable reasons that disable, cancel or suspend education;
    • 2. When those who applied for education, etc give up attending lectures.
  • (2) Returning of tuition pursuant to Paragraph 1 shall follow the standard of the attached Table 2.
    Article 6(Approval for Utilization) (1) Those who wishes to use facilities of the Hall shall get permission from the Mayor. The same shall apply when changes are to be made. However, this shall not apply when they participate a business according to the business plan of the Hall itself.
  • (2)Those who have permission for using facilities (hereinafter referred to as the “facility user”) may install suitable facilities at their own expense for use within the scope of permission and with the approval of the Mayor.
    Article 7(Collection and Exemption of Service Charge) (1) Anyone who wants to use facilities of the Hall shall pay the service charge in accordance with the standard in the attached Table 3. If the Table 3 does not exactly match, the service charge shall be decided according to the similar item in the Table 3.
  • (2) The Mayor may exempt service charges for anyone that falls under the following subparagraphs:
    • 1. When the State or the local government uses the facility to host an event;
    • 2. When a corporation or an organization that promotes women's ability and welfare uses the facility to open an event that corresponds with the purpose of establishment;
    • 3. When an user who applied to use the wedding facility falls under the following items:
      • A. Anyone prescribed in from Article 3, Paragraph 2, Subparagraph 1 to Subparagraph 3:
      • B. Needy couples of de facto marriage status who were recommended by the head of local authority (Eup, Myeon and Dong);
      • C. Immigrants of marriage who did not have formal wedding ceremonies.
      Article 8(Matters to be Observed by Users)
    • In terms of using the facility, the facility users shall duly conduct their duty as a well-intentioned manager and shall not do any of followings without approval from the Mayor.
      • 1. Usage of facilities for other purposes out of the range of approval;
      • 2. Transfer or lease of the right of use to a third person;
      • 3. Transformation or addition to the original state of the facilities.
      Article 9(Suspension of Use) (1) The Mayor may order suspension of use in cases that fall under the following subparagraphs:
      • 1. When approval was obtained through false or illegal measures;
      • 2. When the provisions of this Ordinance are violated;
      • 3. When the terms of utilization approval are not kept;
      • 4. When there is a natural disaster or any other extraordinary cause that disables use.
    • (2) The Mayor shall not be responsible for damages of users due to the suspension of use in cases prescribed in from Subparagraph 1 to Subparagraph 3 of Paragraph 1.
      Article 10(Return of Service Charge) (1) The Mayor shall return the service charges in whole or in part in cases that fall under the following subparagraphs.
      • 1. In cases of natural disasters or other inevitable causes that disables use;
      • 2. In cases of City events or extraordinary circumstances of the Hall that disables use;
      • 3. When the user asks to cancel the approval of use.
    • (2) Returning of the service charge pursuant to Paragraph 1 shall follow the standard of the attached Table 4.
      Article 11(Recovery to the Original State) (1) When the facility user completes or suspends utilization, the facilities shall be restored to the original state according to Article 6, Paragraph 2.
    • (2) In case the facility user does not comply with the duties of Paragraph 1, the Mayor shall personally conduct or have a third person conduct on his/her behalf, and the cost may be collected from the facility user.
      Article 12(Compensation)
    • If a facility user damages or harm the facilities of the Hall, he/she shall compensation shall be made:
      Article 13(Operation of Entrustment) (1)The Mayor may partially or fully entrust operation of the Hall to those that fall under the following subparagraphs for efficiency:
      • 1. Non-profit corporations or organizations that promote women's ability and welfare;
      • 2. Other non-profit corporations or organizations that the Mayor deems suitable for operation
    • (2) Agreement shall be reached with the consignee (hereinafter referred to as the "consignee") when the Mayor consigns businesses pursuant to Paragraph 1. The term shall be 3 years.
    • (3) The operational costs that entail entrustment management shall be appropriated through tuition, service charges and other facility operation related revenues that are incurred.
      Article 14(Supervision and Management) (1) The Mayor shall conduct supervision and management on the consignee at least once a year, and if necessary, the Mayor may make the consignee report on the consigned operation or may make the related public officers examine and check the operation of facilities, related documents, etc.
    • (2) The Mayor shall take necessary measures immediately if there are cases that need to corrected in the result of examination prescribed in Paragraph 1.
      Article 15(Cancellation of Operation Entrustment) (1) The Mayor may cancel the entrustment contract in any case of the following subparagraphs:
      • 1. When the consignee violates related laws and this Ordinance;
      • 2. When the consignee breaches the terms of entrustment
      • 3. When the establishment approval is canceled if the consignee was a juristic person;
      • 4. When there is other reason that hinders the normal operation of the Hall due to the consignee's fault.
    • (2) The Mayor shall conduct a hearing when the entrustment contract is to be cancelled pursuant to Paragraph 1.
      Article 16(Delegation of Right)
    • The Mayor shall delegate the rights prescribed in from Article 4 to Article 7, from Article 9 to Article 11 to the Director of Busan Metropolitan City Women's Hall and the Dircector of Busan Metropolitan City Women's Cultural Hall.
