BUSAN METROPOLITAN CITY ORDINANCE ON PROMOTION OF AND SUPPORT FOR FESTIVALS

Ordinance No. 4793, Aug. 8, 2012

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to improve the qualify of cultural lifestyles of citizens and contribute to the promotion of tourism and the invigoration of regional economies by providing for matters necessary for the promotion of festivals and support for outstanding festivals.
  • Article 2 (Definitions)
  • "Festival" in this Municipal Ordinance means an event held periodically with participation of many citizens in the Busan Metropolitan City (hereinafter referred to as the "City") for the promotion of tourism, the promotion of unique local culture, the promotion of local specialities, etc: Provided, That none of the following events shall be deemed a festival:
    • 1. Events in which only specified persons participate, such as contests, song festivals, and memorial ceremonies;
    • 2. Artistic events, such as music concerts, exhibitions, art festivals, movie festivals;
    • 3. Other events less festive than general festivals, such as parties in honor of senior citizens.
  • Article 3 (Responsibilities)
  • The City shall create systems and conditions necessary for promoting festivals and shall formulate and implement policies necessary therefor.
  • Article 4 (Establishment of Festival Promotion Committee)
  • The Mayor of the Busan Metropolitan City (hereinafter referred to as the "Mayor") shall establish the Festival Promotion Committee within the Busan Metropolitan City (hereinafter referred to as the "Committee") in order to deliberate on the following matters regarding the promotion of festivals:
    • 1. Promotion of festivals;
    • 2. Support for festivals;
    • 3. Consolidation and rearrangement of similar festivals and recommendation thereof;
    • 4. Recommendation of festivals eligible for assistance from central administrative agencies, etc.;
    • 5. Other matters tabled by the Mayor for deliberation.
  • Article 5 (Formation of Committee, etc.)(1) The Committee shall be comprised of not more than 15 members, including one chairperson and one vice chairperson.
  • (2) The chairperson and vice chairperson shall be elected by and from among Committee members, and Committee members shall be appointed or commissioned by the Mayor from among the following persons:
    • 1. Persons recommended by the Busan Metropolitan Council;
    • 2. Grade-IV or higher-ranking public officials of the Busan Metropolitan City;
    • 3. Persons who have abundant knowledge and experience regarding festivals.
  • (3) The term of office of each commissioned Committee member shall be two years, but may be renewed consecutively only once: Provided, That the term of office of a Committee member commissioned to fill a vacancy shall coincide with the remaining term of office of his/her predecessor.
  • (4) The Committee shall have one secretary who shall take charge of executing administrative affairs of the Committee, and the secretary shall serve as the Grade-V officer in charge of festivals.
  • Article 6 (Chairperson's Duty)(1) The chairperson shall represent the Committee and shall administer all administrative affairs of the Committee.
  • (2) The vice chairperson shall assist the chairperson and shall act on behalf of the chairperson if the chairperson is unable to perform any of his/her duties.
  • Article 7 (Meetings of Committee)(1) The chairperson shall convene meetings of the Committee and shall preside such meetings.
  • (2) A meeting of the Committee shall be duly formed with the attendance of a majority of current Committee members, and resolution at the meeting shall be adopted by concurring votes of a majority of the Committee members present at such meeting.
  • Article 8 (Exclusion, Challenge, and Avoidance of Committee Members)(1) In any of the following cases, a member of the Committee shall be excluded from deliberation with the Committee:
    • 1. If the Committee member is a party to the case on the agenda;
    • 2. If the Committee member has provided service with regard to the case on the agenda or has been involved in the case on the agenda in any other manner;
    • 3. If the Committee member is a relative to a party to the case on the agenda;
    • 4. If the Committee member has served the institution or any other entity involved in the case on the agenda during the latest three years.
  • (2) If a party to a case on the agenda has a ground to believe that it is impracticable to expect impartiality from a Committee member in deliberation, the party may file a petition for challenge with the Committee.
  • (3) If a Committee member has a ground specified in paragraph (1) or (2), he/she may voluntarily abstain from deliberation on the case on the agenda.
  • Article 9 (Request to Related Institutions, etc. for Cooperation)
  • If the Committee deems it necessary for performing its duties, it may summon related public officials or experts to attend its meeting to hear their opinions or may request related institutions, organizations, etc. to cooperate with it as necessary, such as submission of data or opinion, etc.
  • Article 10 (Detailed Operating Rules, etc.)
  • Except as otherwise provided for in this Ordinance, matters necessary for the operation of the Committee shall be determined by the chairperson, subject to prior resolution by the Committee.
  • Article 11 (Evaluation of Festivals)(1) The Mayor shall evaluate contents of each festival, the capability of managing each festival, the results of festivals held, etc. each year for the promotion of and support for festivals.
  • (2) In order to ensure the impartiality and objectiveness of the evaluations conducted pursuant to paragraph (1), a festival evaluation team shall be organized and operated for evaluation with not more than 15 experts from the private sector, who have abundant knowledge and experience in festivals, or such evaluation may be entrusted to an institution specializing in festivals.
  • (3) The festival evaluation team or the institution specializing in festivals shall conduct evaluations in accordance with the list of evaluation items prescribed by the City by visiting festival sites, conducting surveys, and analyzing data, etc. during the period of each festival and shall report the results thereof to the Mayor.
  • (4) The Mayor shall disclose the evaluation items and the results of evaluations under paragraph (3) on the web-site of the City.
  • (5) Other matters necessary for the evaluation of festivals shall be prescribed separately by the Mayor.
  • Article 12 (Support of Festivals)
  • In order to promote festivals, the Mayor may fully or partially subsidize persons hosting a festival for expenses incurred in hosting the festival, within budgetary limits, according to each person's evaluated rating.
  • Article 13 (Allowances and Travel Expenses)
  • The Mayor may provide allowances and reimburse travel expenses to commissioned Committee members and related experts, who attend a meeting of the Committee under Article 4, and members of the festival evaluation team under Article 11, who participate in activities of the evaluation team, within budgetary limits.
  • Article 14 (Entrustment of Administrative Affairs) (1) In order to enhance expertise and efficiency in festivals, the Mayor may entrust administrative affairs relating to the planning and management of festivals to a non-profit legal entity or organization specializing in cultural and artistic activities or programs relating to festivals.
  • (2) When the Mayor entrusts administrative affairs to a person pursuant to paragraph (1), he/she may subsidize the person, to whom the administrative affairs are entrusted, for expenses incurred in carrying out the affairs, within budgetary limits.
  • ADDENDUM
  • This Municipal Ordinance shall enter into force one month after the date of its promulgation.
