Busan Metropolitan City Ordinance on Fire Prevention and Fire Training Support

  • Article 1 (Purpose)
  • The purpose of this ordinance is to protect the lives and property of citizens and contribute to public safety by stipulating the matters mandated in the "Basic Law on Fire-Fighting" and the "Enforcement Decree of the Basic Law on Fire Fighting" and matters necessary for their implementation, and by strengthening the safety management system for fire-fighting objects and preventing fires.
  • Article 2 (definition)
  • The meanings of the terms used in this Ordinance shall be as follows:
    • 1. The term "fire-fighting object" means buildings, vehicles, ships, shipbuilding structures, forests, and other artificial structures or objects under Article 2 ① of the Basic Law on Fire Protection (hereinafter referred to as the "Act");
    • 2. The term "specific fire-fighting object" means a fire-fighting object to be installed under Article 2 ① 3 of the Fire Prevention, Fire-fighting Facility Installation, Maintenance and Safety Management Act, which is prescribed by Presidential Decree;
    • 3. The term "related person" means the owner, manager, or occupant of a fire-fighting object under Article 2 ③ of the Act.
  • Article 3 (Responsibility)
  • The Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") shall formulate and implement policies necessary to protect the lives and property of citizens from fire.
  • Article 4 (Detailed Management Standards for Facilities Using Fire)
  • Detailed management standards for facilities using fire under Article 15 ① of the Act and Article 5 ② of the Enforcement Decree of the same Act shall be as specified in the attached Table.
  • Article 5 (Notification of Fires to be Mistaken for a Conflagration, etc.)
  • ① Anyone who intends to light fire or to perform smoke-screen sterilization in the area or in the place falling under any of the following subparagraphs under Article 19 ② of the Framework Act on Fire Services, which is feared to be mistaken for a conflagration shall make a report orally (including telephone) or in writing (including mail, fax, computer communication) the date and time, the place, the reason, etc to the chief of Busan Fire Department or the fire chief before doing it. In this case, the chief of the Busan Fire Department or the fire chief shall record and manage the matters reported.
  • ② Other area and place that are prescribed by the Municipal Ordinance of the City/Do under Article 19 ② 6 of the Act shall be the area and place falling under any of the following subparagraphs:
    • 1. Business places of public use facilities prescribed in the subparagraphs of Article 2 of the Indoor Air Quality Control in Public Use Facilities, etc. Act;
    • 2. Construction sites of buildings;
    • 3. Surroundings of the immediate area of the forest;
    • 4. Areas populated with many vinyl greenhouses;
    • 5. Religious facilities inside forests and other similar facilities;
    • 6. Housing pursuant to Article 2 ① of the Housing Act.
  • Article 6 (Imposition and Collection of Fine for Negligence)
  • ① The chief of the fire department shall impose and collect a fine for negligence of 200,000 won on a person who fails to make a report under Article 3 ①, which calls for fire engines to report to the scene of an alleged fire.
  • ② A fine for negligence under paragraph ① may be reduced by half considering the reason and result of the violation activities by the chief of fire department.
  • ③ Procedures for the imposition and collection of fines under paragraphs ① and ② shall be governed by the Act on the Regulation of Violation of Order.
  • Article 7 (Support for Fire-Fighting Training)
  • The Mayor shall annually formulate and implement a fire-fighting training support plan, including the following matters, to strengthen the initial fire response capabilities of persons related to specific fire-fighting objects pursuant to Article 22 of the Act on Fire Prevention, Installation, Maintenance and Safety Management of Fire-fighting Facilities.
    • 1. Methods and procedures for supporting fire-fighting training;
    • 2. Support for workers and equipment necessary for fire-fighting training;
    • 3. Other matters deemed necessary for supporting fire-fighting training.
  • Article 8 (Fire-fighting Training Contest)
  • ① The Mayor may hold a Fire-fighting Training Contest (hereinafter referred to as the "Contest") to compete or announce the competencies for Fire-fighting Training Contest such as fire extinguishing, evacuation, and notification conducted by persons related to specific fire-fighting objects in order to strengthen the autonomous safety management system of specific fire-fighting objects.
  • ② The Mayor may separately determine detailed operational matters such as the target of participation in the contest and the evaluation method, and may request the relevant persons of the specific fire-fighting object to participate in the contest.
  • ③ The Mayor may give awards and prizes to relevant persons to certain fire-fighting objects with excellent results in the contest.
  • Addendum
  • This ordinance shall take effect one month after its promulgation.
