Busan Metropolitan City Ordinance on Promotion of Social Enterprises

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to contribute to the enhancement of social unity and the quality of life of citizens by fostering and supporting social enterprises in the expansion of social services and the creation of new job opportunities.
  • Article 2 (Definition)
  • For the purpose of this Ordinance, the following terms shall have the meaning as set forth below:
    • 1. The term "social enterprise" refers to a social enterprise as provided under subparagraph 1 of Article 2 of the Social Enterprise Promotion Act (hereinafter referred to as the "Act");
    • 2. The term "preparatory social enterprise" refers to an enterprise, notwithstanding the fact that it has not yet been certified as a social enterprise, preparing to convert into a social enterprise, with a nature as a social enterprise by providing social services or job opportunities to the vulnerable social groups, etc. and appointed pursuant to Article 5;
    • 3. The term "social enterprise, etc." refers to social enterprise and preparatory social enterprise;
    • 4. The term "vulnerable social group" refers to a vulnerable social group as provided under subparagraph 2 of Article 2 of the Act;
    • 5. The term "social services" refers to social services as provided under subparagraph 3 of Article 2 of the Act;
    • 6. The term "associated enterprise" refers to an associated enterprise as provided under subparagraph 4 of Article 2 of the Act.
  • Article 3 (Establishment ‧ Implementation of Fosterage Plan) (1)The Busan Metropolitan City Mayor (hereinafter referred to as the "Mayor") shall establish the Busan Metropolitan City Social Enterprise Fosterage Plan (hereinafter referred to as the "Fosterage Plan") for every five years in order to foster and systematically support social enterprises.
  • (2)The Fosterage Plan shall include the matters falling under each of the following subparagraphs:
    • 1. Direction for the promotion for the fosterage and support of social enterprises, etc.;
    • 2. Matters concerning the infrastructure for revitalization of social enterprises, etc.;
    • 3. Matters concerning support for the operation of social enterprises, etc.;
    • 4. Matters concerning the appointment of preparatory social enterprises;
    • 5. Matters concerning the prioritized fosterage of local specialized businesses; and
    • 6. Other matters necessary for the fosterage and support of social enterprises, etc.
  • (3)The Mayor shall establish ‧ implement an annual implementation plan in accordance with the Fosterage Plan.
  • Article 4 (Social Enterprise Fosterage Committee) (1)The Mayor shall have the Busan Metropolitan City Social Enterprise Fosterage Committee (hereinafter referred to as the "Committee") to deliberate on the matters falling under each of the following subparagraphs concerning social enterprises:
    • 1. Matters concerning the establishment of Fosterage Plan and annual implementation plan as provided under Article 3;
    • 2. Matters concerning the appointment, etc. of the preparatory social enterprises as provided under Article 5;
    • 3. Matters concerning the support of operation of social enterprises, etc.; and
    • 4. Other matters concerning the fosterage of social enterprises, etc. referred by the Mayor to the meeting of the Committee.
  • (2)The Committee shall be composed of fifteen members including one Chairperson and one Vice Chairperson.
  • (3)The Chairperson of the Committee shall be the Economy Industry Director, and the Vice Chairperson shall be elected from the Committee members. Persons falling under each of the following subparagraphs who are appointed or commissioned by the Mayor shall be the Committee members:
    • 1. A public official of Grade IV belonging to Busan Metropolitan City and the relevant administrative agencies;
    • 2. A person recommended by the Busan Metropolitan Council; and
    • 3. A person who has knowledge and experience in social enterprises, etc.
  • 4.The term of office of a commissioned Committee member shall be two years, provided that it may be renewed for another two years. The term of office of a member filling a vacancy shall be the remaining term of office of the predecessor.
  • 5.The Chairperson shall represent the Committee and be in charge of the overall operation of the Committee. The Vice Chairperson shall act on behalf of the Chairperson in case the Chairperson is unable to perform his duties owing to unavoidable circumstances.
  • 6.The meeting of the Committee shall be commenced upon attendance of a majority of the registered Committee members. The Committee shall adopt a decision with the approval of a majority of the attending Committee members.
  • 7.The Committee shall have one Secretary to carry out the affairs of the Committee, provided that the Secretary shall be the assistant junior official in charge of social enterprises.
  • 8.Payment of the allowances and travel expenses may, within limits of budget, be provided to the commissioned Committee members.
  • 9.Matters other than those provided under this Ordinance that are necessary for the operation of the Committee shall be determined by the Chairperson through a resolution of the Committee.
  • Article 5 (Appointment of Preparatory Social Enterprises) (1)In order to promote(facilitate) the conversion of an enterprise that wishes to be appointed as preparatory social enterprise into a social enterprise, the Mayor may appoint preparatory social enterprises through the deliberation of the Committee.
  • (2)Matters necessary for the conditions for appointment, appointment procedures and cancellation of appointment of preparatory social enterprises shall be separately determined by the Mayor through the deliberation of the Committee. Such matters shall be announced on the Busan News and an internet homepage of Busan Metropolitan City.
  • Article 6 (Support of Working Expenses, etc.) (1)The Mayor may, within limits of budget, support or finance(lend/provide loan) the working expenses such as site purchase costs ‧ equipment costs to a person who intends to establish social enterprises, etc.
  • (2)The Mayor may, within limits of budget, support social enterprises, etc. with part of the operating costs.
  • Article 7 (Management Support, etc.) (1)The Mayor may provide various supports such as professional consultation(advise) and information on management ‧ legal ‧ technology ‧ tax ‧ labor ‧ accounting, etc. that are necessary for the establishment and operation of social enterprises, etc.
  • (2)The Mayor may entrust the duties as provided under Paragraph 1 to Busan Metropolitan City-contributed(invested) agencies(institutions), private organizations, etc.
  • (3)The Mayor may, within limits of budget, support a person who has been entrusted with the duties pursuant to Paragraph 2 with all or part of the necessary expenses.
  • Article 8 (Support of Preferential Purchase, etc.) (1)The Mayor may preferentially purchase the goods or services produced by social enterprises, etc.
  • (2)The Mayor shall put an effort to develop the market for the goods or services produced by social enterprises, etc. such as by encouraging private consumption.
  • Article 9 (Expansion of Participation of Enterprises, etc.)
  • In order for enterprises(corporations) ‧ organizations, etc. to participate in the establishment and operation of social enterprises, etc., the Mayor shall actively carry out the policy measures falling under each of the following subparagraphs:
    • 1. Support for the establishment ‧ operation of the exchange ‧ cooperation network between enterprises(corporations) ‧ organizations;
    • 2. Expansion of support for participating corporations for the revitalization of associated enterprises; and
    • 3. Creation of fund for supporting the establishment and self-reliance of social enterprises, etc.
  • Article 10 (Advertisement, etc.)
  • In order to promote(enhance) the understanding of local residents on social enterprises, etc., the Mayor shall actively carry out the policy measures falling under each of the following subparagraphs:
    • 1. Support for discovery and expansion of exemplary models of social enterprises, etc.;
    • 2. Support for the quality improvement and advertisement of products and service of social enterprises, etc.; and
    • 3. Expansion of awareness on social enterprises, etc. through expert(professional) forums, workshops, etc.
