BUSAN METROPOLITAN CITY ORDINANCE ON THE PROMOTION OF LIFELONG EDUCATION

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to contribute to the improvement of the quality of life of the citizenry by prescribing matters mandated by the Lifelong Education Act and other matters necessary for the promotion of lifelong education.
  • Article 2 (Definitions)
  • The terms used in this Ordinance are defined as follows:
    • 1. The term "lifelong education" means all types of systematic educational activities other than regular school curriculums, including supplementary education to upgrade educational attainment, literacy education for adults, occupational education for ability enhancement, humanities and liberal arts education, culture and art education, and civic participation education;
    • 2. The term "lifelong educational institution" means any establishment, corporation, or organization falling under any of the following categories:
      • (a) Establishments, corporations, or organizations authorized by, registered according to, or reported in the Lifelong Education Act (hereinafter referred to as the "Act");
      • (b) Private teaching institutes that provide lifelong vocational training other than those providing supplementary education for school curriculums among private teaching institutes under the Act on the Establishment and Operation of Private Teaching Institutes and Extracurricular Lessons;
      • (c) Establishments, corporations, or organizations established mainly for lifelong education under other statutes and regulations;
    • 3. The term "literacy education" (hereinafter referred to as "literacy education") means a systematic education program that enables people to attain basic living capabilities, including literacy capability, that are socially and culturally required to lead a daily life.
    • 4. The term "educationally disadvantaged class" means persons who experience inconvenience at home, at work, or in society due to the lack of basic capabilities necessary to lead a daily life, such as persons with disabilities, adults with low educational attainment, immigrants by marriage, foreign workers, and residents escaping from North Korea and other similar persons.
  • Article 3 (Responsibilities of Citizens)
  • (1) Busan Metropolitan City (hereinafter referred to as the "City") shall establish and implement policies for the promotion of lifelong education to ensure that citizens can be given opportunities for lifelong education.
  • (2) The City shall establish and implement policies for lifelong education for educationally disadvantaged classes to ensure that they can be given opportunities for lifelong education.
  • (3) The City shall actively encourage the founders of organizations, establishments, places of business, etc. under its jurisdiction to conduct lifelong education.
  • Article 4 (Relationship to Other Statutes and Regulations)
  • Except as otherwise provided in statutes and regulations or other Ordinances of the City, this Ordinance shall apply to the promotion of lifelong education.
  • Article 5 (Formulation and Implementation of Implementation Plans for Promotion of Lifelong Education)
  • (1) The Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") shall formulate and implement a yearly implementation plan for lifelong education promotion (hereinafter referred to as "implementation plan") including the following matters, pursuant to Article 11 of the Act. In such cases, the Mayor shall consult with the Superintendent of Busan Metropolitan City schools:
    • 1. Matters regarding direction-setting for the promotion of lifelong education and the implementation goals thereof;
    • 2. Matters regarding the provision of a foundation for lifelong education and the facilitation of lifelong education;
    • 3. Matters regarding the expansion of investment in the promotion of lifelong education and financial resources required therefor;
    • 4. Matters regarding support and coordination for the promotion of lifelong education;
    • 5. Matters regarding the analysis and evaluation of policies for the promotion of lifelong education;
    • 6. Matters regarding lifelong education for educationally disadvantaged classes;
    • 7. Matters regarding the evaluation and system improvement of policies for the promotion of lifelong education for educationally disadvantaged classes;
    • 8. Other matters necessary for the promotion of lifelong education.
  • (2) If deemed necessary to formulate and implement the implementation plan under paragraph (1), the Mayor may request the provision of relevant data from the head of a relevant administrative agency or the head of any other institution or organization, who shall comply with such request unless there is a compelling reason not to do so.
  • (3) The Mayor shall secure financial resources necessary to promote the implementation plan under paragraph (1).
  • Article 6 (Submission of Implementation Plans)
  • The Mayor shall submit an implementation plan under Article 5 to the competent standing committee of the Busan Metropolitan Council.
  • Article 7 (Operation of and Support for Lifelong Education Promotion Projects)
  • (1) The Mayor may implement the following lifelong education promotion projects or subsidize relevant corporations, organizations, etc. within budgetary limits pursuant to Article 16 of the Act:
    • 1. Establishment and operation of a lifelong educational institution;
    • 2. Development of lifelong education programs;
    • 3. Other projects to be conducted for the participation of citizens in lifelong education.
  • (2) The Mayor may conduct or support education for educationally disadvantaged classes to improve literacy education, communication abilities, problem-solving abilities, informatization abilities, etc.
  • (3) Where deemed necessary for the smooth implementation of lifelong education promotion projects, the Mayor may conduct lifelong education promotion projects jointly with the Busan Metropolitan City Office of Education, lifelong educational institutions, universities or colleges, companies, etc.
  • Article 8 (Establishment of Cooperative System)
  • The Mayor may establish a regular cooperative system with the Busan Metropolitan City Office of Education, universities or colleges, lifelong educational institutions, companies, etc. in order to efficiently facilitate the promotion of lifelong education.
  • Article 9 (Establishment)
  • The Mayor shall establish the Busan Metropolitan City Lifelong Education Council (hereinafter referred to as the "Council") to deliberate and decide on matters necessary to formulate and implement an implementation plan under Article 12 of the Act.
  • Article 10 (Functions)
  • The Council shall deliberate and decide on the following matters:
    • 1. Formulation and implementation of an implementation plan under Article 5;
    • 2. Evaluation and improvement of lifelong education promotion projects;
    • 3. Cooperation and coordination with institutions related to lifelong education;
    • 4. Deleted;
    • 5. Matters regarding the establishment of lifelong education facilities for persons with disabilities or the designation and operation thereof;
    • 6. Other matters that the chairperson deems necessary regarding the promotion of lifelong education.
  • Article 11 (Organization)
  • (1) The Council shall be comprised of not more than 20 members, including the chairperson and the vice chairperson.
  • (2) The Mayor shall serve as the chairperson of the Council, and the Deputy Superintendent of the Busan Metropolitan City Office of Education shall serve as the vice chairperson.
  • (3) The members of the Council shall be appointed or commissioned by the Mayor, from among the following persons, with due consideration given to gender equality. In this case, the number of commissioned members shall not be less than a majority of the total number of members:
    • 1. Public officials of Grade IV or higher related to the affairs of lifelong education;
    • 2. The operators of lifelong educational institutions;
    • 3. The operators of lifelong education facilities for persons with disabilities;
    • 4. Persons recommended by the Busan Metropolitan Council;
    • 5. Other persons who have extensive expertise and experience in lifelong education or in lifelong education for persons with disabilities.
  • (4) The Council shall have one executive secretary and one clerk, and the head of a division in charge of lifelong education affairs shall be the executive secretary and the deputy director in charge of lifelong education affairs shall be the clerk.
  • Article 12 (Term of Office)
  • (1) The term of office of a Council member appointed or commissioned as an ex officio member shall be the period of his or her service in the position, and other members shall hold office for a term of two years and may be appointed consecutively only once: Provided, That the term of office of a council member for filling a vacancy shall be the remaining term of his or her predecessor.
  • (2) Where a commissioned member becomes incapable of performing the duties due to imprisonment without labor or a heavier punishment declared by a court or due to a disease requiring long-term treatment, or where such member is deemed unsuitable to serve as a Council member due to non-attendance for a long time or other similar circumstances, the Council chairperson may dismiss such member from his or her office.
  • Article 13 (Duties of the Chairperson)
  • (1) The chairperson shall represent the Council and exercise general supervision over its affairs: Provided, That where the chairperson is unable to perform his or her duties due to any unavoidable cause, the vice chairperson shall act on his or her behalf.
  • (2) Where both the chairperson and the vice chairperson are unable to perform the duties due to any unavoidable cause, a member designated in advance by the chairperson shall act on their behalf.
  • Article 14 (Meetings)
  • (1) The chairperson shall convene meetings of the Council; and a majority of the members of the Council shall constitute a quorum and any decision thereof shall require the concurring vote of a majority of those present.
  • (2) Council members who have a direct interest in the agenda presented to the meetings shall not participate in deliberations and decisions on the relevant agenda.
  • (3) If deemed necessary for the meetings, the chairperson may have relevant experts, public officials, and other relevant persons attend the meetings of the Council to hear their opinions or may request the provision of data.
  • Article 15 (Allowances and Travel Expenses)
  • Allowances and travel expenses may be paid to Council members, experts, other relevant persons who attend the Council meetings within budgetary limits.
  • Article 16 (Operating Rules)
  • Except as provided in this Ordinance, the chairperson shall determine matters necessary for the operation of the Council following decision by the Council.
  • Article 17 (Establishment, etc.)
  • (1) The City shall establish the Busan Institute for Talent and Lifelong Education (hereinafter referred to as the "Institute") to perform projects for personnel training and lifelong education promotion.
  • (2) The Institute shall be an incorporated foundation under Article 32 of the Civil Act.
  • Article 18 (Executive Officers, etc.)
  • Matters regarding the executive officers, operation, etc. of the Institute shall be prescribed by the articles of incorporation.
  • Article 19 (Projects)
  • (1) The Institute shall perform the following projects pursuant to Article 20 (2) of the Act:
    • 1. Provision of opportunities for lifelong education and relevant information;
    • 2. Consultation on lifelong education;
    • 3. Operation and development of lifelong education programs;
    • 4. Construction of a system to connect lifelong educational institutions;
    • 5. Provision of education and information to improve the expertise of persons engaged in lifelong education;
    • 6. Matters regarding the management and operation of literacy education;
    • 7. Affairs entrusted pursuant to the Act or any other statute or regulation;
    • 8. Affairs entrusted by the Mayor to train personnel and promote lifelong education;
    • 9. Support for the establishment and operation of lifelong education courses for persons with disabilities by lifelong educational institutions;
    • 10. Other projects deemed necessary for personnel training and the promotion of lifelong education.
  • (2) The Institute may engage in profit-making business within the extent of its purpose of establishment in order to smoothly perform the projects under paragraph (1), as prescribed by the articles of incorporation.
  • Article 20 Deleted.
  • Article 21 (Formation, etc. of Financial Resources)
  • (1) Financial resources necessary for the establishment and operation of the Institute shall be created through the following funds:
    • 1. Contributions or subsidies from the City;
    • 2. Grants from the Government;
    • 3. Voluntary contributions from the private sector, including universities, colleges, and companies;
    • 4. Other profits generated from the operation of basic assets and projects of the Institute.
  • (2) The Mayor may contribute to or subsidize expenses incurred in the establishment and operation of the Institute within budgetary limits.
  • Article 22 (Submission of Project Plans, etc.)
  • (1) The Institute shall prepare a project plan and a budget plan for each business year and submit them to the Mayor before each business year begins.
  • (2) The Institute shall prepare a statement of accounts of revenues and expenditures for each business year, undergo an audit by a certified public account, and submit such statement of accounts and the project outcomes to the Mayor no later than three months after the end of each business year.
  • (3) The business year of the Institute shall coincide with the fiscal year of the general accounts of the City.
  • Article 24 (Dispatch of Public Officials)
  • The Mayor may dispatch public officials under his or her jurisdiction to the Institute in accordance with related statutes or regulations in order to ensure the smooth performance of Institute projects.
  • Article 25 Deleted.
  • Article 26 (Safety Measures for Learners)
  • The founder of a lifelong educational institution shall take the following necessary safety measures, such as subscribing to insurance or joining a mutual-aid business, pursuant to Article 28 (3) of the Act:
    • 1. At least one hundred million won compensation money per person;
    • 2. At least one billion won compensation money per accident.
  • Article 27 (Guidance and Supervision)
  • The Mayor shall check, guide, and supervise whether the budgets provided to lifelong educational institutions and corporations, organizations, etc. related to lifelong education are used for their original purposes.
  • Article 28 (Awards)
  • The Mayor may grant an award to individuals or institutions, organizations, etc. that significantly contributed to the promotion of lifelong education pursuant to the Busan Metropolitan City Ordinance on Awards.

  • Article 1 (Enforcement Date)
  • This Ordinance shall enter into force on the date of its promulgation.
