Busan Metropolitan City Ordinance on Establishment And Operation of Busan Metropolitan City's Internet Homepage

CHAPTER Ⅰ GENERAL PROVISIONS

  • Article 1(Purpose)
  • The purpose of this Ordinance is to provide high-quality services to the users of the Busan Metropolitan City Internet homepage and to contribute to encouraging Busan citizens' participation in the City's municipal affairs by prescribing matters necessary for establishing and operating the Busan Metropolitan City Internet homepage.
  • Article 2 (Definitions)
  • The terms used in this Ordinance shall be defined as follows:
    • 1. The term "Internet" means a global system of interconnected information and communications networks, which makes it possible for various kinds of information to be exchanged between its users;
    • 2. The term "Internet homepage" (hereinafter referred to as "homepage") means an Internet utilization space established to provide Internet services to its users;
    • 3. The term "homepage system" generically means the hardwares, software, databases, networks, security systems, etc., established to operate a homepage and systems related thereto;
    • 4. The term "Internet civil petition" means a civil petition received or processed through the homepage, which belongs to the category of civil petitions under Article 2 of the Civil Petition Treatment Act;
    • 5. The term "data-management department" means a department (referring to an organizational unit classified as an office/section; hereinafter the same shall apply) responsible for managing data, such as inputting, updating and deleting administrative information on the homepage, intended to be publicized to Busan citizens.
  • Article 3 (Scope of Application)
  • This Ordinance shall apply to the homepages being operated by the main Office, directly controlled agencies and business establishments of the Busan Metropolitan City (hereinafter referred to as the "City").

CHAPTER II ESTABLISHMENT AND OPERATION OF HOMEPAGE

  • Article 4 (Establishment and Operation of Homepage)The Mayor of the Busan Metropolitan City (hereinafter referred to as the "Mayor") shall establish a homepage system and provide the following information through the homepage:
    • 1. Major policies of the City, local information related to Busan citizens' life, and administrative information;
    • 2. Services for civil petitions such as operating a window for electronic civil petitions, disclosing the processing of civil petitions, and Internet counselling about civil petitions;
    • 3. Assurance and encouragement of Busan citizens' participation in the City's municipal affairs such as questionnaire surveys and bulletin boards;
    • 4. Domestic and overseas publicity for the City and exchange of information;
    • 5. Links to the homepages of other agencies;
    • 6. Other information, etc. deemed by the Mayor necessary for improving the quality of life and right-to-know of Busan citizens.
  • (2) The Mayor shall designate and operate a department responsible for operating the homepage (hereinafter referred to as "operating department") and a data-managing department. In such cases, when intending to establish or improving the homepage, the head of the operating department shall consult in advance with the head of a department exercising general supervision over the homepage of the City.
  • (3) The Mayor shall operate the homepage 24 hours each day; and the head of the operating department shall formulate measures for information security and maintenance of the homepage system to ensure it operates stably.
  • (4) The Mayor shall continuously endeavor to improve the homepage system by surveying opinions of its users.
  • (5) If necessary, the Mayor may outsource the development, maintenance and operation of the homepage system to an external specialized institution.
  • Article 5 (Merger of Homepages) (1) The Mayor may merge homepages separately operated by the main Office, directly controlled institutions and business establishments of the City, comprehensively based upon their operating purposes and usage, and characteristics of the affairs for which such homepages are used.
  • (2) Other necessary matters, such as methods for merging the homepages referred to in paragraph (1), shall be separately prescribed by the Mayor.
  • Article 6 (Operation of Foreign Language Homepage) (1) The Mayor may operate a homepage translated into a foreign language to publicize the City's municipal affairs.
  • (2) The homepage referred to in paragraph (1) shall be built so as to provide information on international cooperation, tourism attraction and international trade and make it possible to exchange opinions with the users.
  • (3) In order to efficiently operate the homepage referred to in paragraph (1), the Mayor may outsource translating into foreign languages, editing of the translation, and the development, maintenance and operation of such homepage to an external specialized institution.

CHAPTER III MANAGEMENT OF DATA ON HOMEPAGE

  • Article 7 (Management of Data)(1) The Mayor shall publish most recent information on the homepage and create an environment to allow the users to directly access detailed information.
  • (2) The Mayor shall inspect the status of inputted information occasionally and take measures to ensure the information is properly updated.
  • Article 8 (Management of Postings)
  • In order to operate the homepage soundly, the Mayor may delete any of the following postings published by the users on the homepage, and then clearly state the grounds for such deletion: Provided, That this shall not apply where the Mayor gives notice of such grounds to the persons who have posted the relevant information because their telephone numbers or email addresses are clear and correct:
    • 1. A posting with content violating any statute related to national safety or security;
    • 2. A posting with a political purpose or a posting libelling any particular institution or organization;
    • 3. A posting slandering or likely to defame a third person;
    • 4. A posting with a profit-making purpose such as commercial advertisement or a posting likely to infringe a copyright;
    • 5. An offensive posting, such as one containing abusive language or obscene materials;
    • 6. A posting repeatedly made by the same person with the same content;
    • 7. Other postings undermining a public interest or inconsistent with the purpose of the homepage bulletin board.
  • Article 9 (Operation of Electronic Reference Library) (1) To inform citizens about the City's municipal affairs properly, the Mayor shall operate an electronic reference library so that every Busan citizen can easily and rapidly inspect administrative materials produced or managed by the City.
  • (2) The electronic reference library shall establish a management system for electronic records containing the following and shall provide information through the homepage:
    • 1. Business plans and polices for the City's major municipal affairs of the City;
    • 2. Various reports of entrusted research, books for publicity, and statistical materials;
    • 3. Other publications published periodically or occasionally.
  • (3) Other necessary matters such as methods for operating the electronic reference library referred to in paragraph (1), shall be separately prescribed by the Mayor.

CHAPTER IV OPERATION OF WINDOW FOR ELECTRONIC CIVIL PETITIONS

  • Article 10 (Establishment and Operation of Window for Electronic Civil Petitions) (1) The Mayor shall establish and operate a window for electronic civil petitions referred to in Article 9 (2) of the Electronic Government Act so as to process Internet civil petitions.
  • (2) A window for electronic civil petitions shall provide services for settling Internet civil petitions, disclosing the processing of civil petitions and counselling about Internet civil petitions; and the department in charge of civil petitions shall generally supervise such window.
  • (3) The Mayor may, with respect to civil petitions under his/her jurisdiction, publish a table for standards for settling affairs of civil petitions and manual on civil petitions through the homepage.
  • Article 11 (Disclosure of Treatment of Civil Petitions)
  • With respect to civil petitions subject to disclosure, the Mayor shall disclose the entire process from receipt to processing of such civil petitions, including the results of processing: Provided, That if the relevant civil petitioners does not wish such process to be disclosed, it shall not be disclosed.
  • Article 12 (Internet Counselling about Civil Petitions) (1) The Mayor may provide counselling services about civil petitions at the window for electronic civil petitions so as to process various kinds of recommendations and requests presented by civil petitioners, and may operate a system of designating officials in charge of counselling about civil petitions by field.
  • (2) Details of counselling about civil petitions shall be disclosed in principle; but shall not be disclosed, if the relevant civil petitioners does not wish them to be disclosed.

CHAPTER V PARTICIPATION OF USERS THROUGH HOMEPAGE

  • Article 13 (Operation of Events for Participation of Users) (1) The Mayor may hold events for participation of the users on the homepage in any of the following cases:
    • 1. Where intending to publicize the major policy projects, plans and businesses of the City;
    • 2. Where intending to publicize and hold cultural events of the City;
    • 3. Where intending to support various activities of Internet affinity clubs, etc.;
    • 4. Where intending to publicize the City's municipal affairs or invigorate Busan citizens' participation therein.
  • (2) In holding an event referred to in paragraph (1), the Mayor may provide money or goods such as gift cards to the selected persons eligible to be provided, within budgetary limits pursuant to the standards specified in attached Table 1: Provided, That the standards specified in attached Table 1 referred to in paragraph (2), shall not apply to separately awarding prizes at an exhibition contest pursuant to the guidelines determined by the Mayor.
  • (3) Before holding an event, the Mayor shall publicly notify through the homepage, Busan citizens of the kinds and amounts of money or goods provided pursuant to paragraph (2) and other matters necessary for holding the event.
  • Article 14 (Operation of Mileage Program) (1) The Mayor may give mileage points to the users of the homepage based upon their purposes of use, their number of uses, etc. pursuant to the standards specified in attached Table 2.
  • (2) The mileage points referred to in paragraph (1) may be used for the following:
    • 1. Mobile phone text messaging services;
    • 2. Donating mileage points and providing gift certificates;
    • 3. Other services determined by the Mayor available for using public services.
  • (3) Methods for using mileage points referred to in paragraph (1) and other matters necessary for operating the mileage system shall be separately prescribed by the Mayor.
  • Article 15 (Operation of Window for Conversation with Mayor) (1) The Mayor may operate a ‘window for conversation with the Mayor' for exchanging opinions with the users of the homepage on the Internet to induce the participation of such users in the City's municipal affairs and realize open administration through the homepage.
  • (2) The window for conversation with the Mayor referred to in paragraph (1) may be operated in public or in private; and where it is necessary to reply to an opinion, such opinion shall be treated as a civil petition under the Civil Petitions Treatment Act.
  • Article 16 (Operation of Participation Plaza)
  • The Mayor may operate a participation plaza on the homepage so that users can freely express and exchange opinions.
  • Article 17 (Provision of Email Service) (1) The Mayor may provide email services on the homepage to invigorate local informatization and provide efficient services for civil petitions.
  • (2) The Mayor shall publish matters concerning email services referred to in paragraph (2) on the homepage.
  • (3) Necessary matters such as methods for operating email services shall be separately prescribed by the Mayor.

ADDENDUM

  • This Ordinance shall enter into force on the date of its promulgation.
