BUSAN METROPOLITAN CITY ORDINANCE ON REGULATORY REFORM COMMITTEE

CHAPTER Ⅰ GENERAL PROVISIONS

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to contribute to the realization of a sustainable knowledge and information society and the enhancement of the quality of life of citizens by providing for the basic direction for the efficient promotion of the informatization of the Busan Metropolitan Government and matters necessary for the establishment and enforcement of relevant policies.
  • Article 2 (Definitions)
  • The terms used in this Ordinance shall be defined as follows:
    • 1.“Informatization”means to enable activities in various areas of society by producing, distributing, or utilizing information or to promote the efficiency of such activities;
    • 2.“Knowledge and information resources”means the resources defined in subparagraph 7 of Article 3 of the Framework Act on National Informatization;
    • 3.“Spatial data” means the data defined in subparagraph 1 of Article 2 of the National Spatial Data Infrastructure Act;
    • 4.“Managing agency” means an agency defined in subparagraph 4 of Article 2 of the National Spatial Data Infrastructure Act;
    • 5.“Information and communication network” means a communication network defined in subparagraph 11 of Article 3 of the Framework Act on National Informatization;
    • 6.“Busan Information Expressway” means the high-speed information and communication network that interconnects the Metropolitan Government, each affiliated agency, each Si/Gun/Gu/, and each Eup/Myeon/Dong by using fiber-optic cables and electric telecommunications systems installed through public-private partnership projects for the informatization of the Busan Metropolitan Government (hereinafter referred to as the “Metropolitan Government”).
    • Article 3 (Basic Principles)
    • When the Mayor of the Busan Metropolitan Government (hereinafter referred to as the “Mayor”) promotes informatization, he/she shall take the following principles into consideration:
      • 1. To develop local society and enhance competitiveness;
      • 2. To enhance efficiency in administration and improve services to citizens;
      • 3. To collect and diffuse citizens' opinions and increase exchanges with citizens;
      • 4. To enhance the quality of life of citizens and alleviate information gaps;
      • 5. To prevent adverse effects of informatization and take countermeasures against such effects.

CHAPTER Ⅱ SYSTEM FOR ESTABLISHMENT AND IMPLEMENTATION OF INFORMATIZATION PLAN

  • Article 4 (Establishment of Basic Plan for Informatization) (1) The Mayor shall establish a basic plan for the informatization of the Busan Metropolitan City (hereinafter referred to as the “basic plan”) every five years, in order to promote informatization efficiently and systematically.
  • (2) The basic plan shall be finally established through the deliberation by the Busan Metropolitan Government Informatization Committee under Article 6.
  • (3) The basic plan shall include the following matters:
    • 1. Basic direction setting for policies on informatization;
    • 2. Objectives and strategy of informatization;
    • 3. Promotion of projects for informatization of each area;
    • 4. Interconnection and utilization of information systems;
    • 5. Invigoration of development and use of applied services through information and communication networks;
    • 6. Creation and diffusion of a robust information culture;
    • 7. Protection of personal and administrative information;
    • 8. Alleviation of information gaps and the prevention of and relief from Internet addiction;
    • 9. Procurement and management of financial resources;
    • 10. Other matters necessary for informatization.
  • (4) The Mayor shall establish the basic plan in accordance with the guidelines for the preparation of plans for each sector of each local government, as prescribed by the Minister of Public Administration and Safety pursuant to Article 6 (4) of the Framework Act on National Informatization.
  • Article 5 (Establishment and Implementation of Implementation Plan for Informatization) (1) The Mayor shall establish and implement an implementation plan for the informatization of the Busan Metropolitan Government (hereinafter referred to as the “implementation plan”) each year in accordance with the basic plan.
  • (2) The Mayor shall endeavor to prepare financial resources necessary for the implementation plan.
  • Article 6 (Informatization Committee) (1) The Mayor shall establish the Committee on Informatization of the Busan Metropolitan Government (hereinafter referred to as the “Committee”) to have the Committee deliberate on the following matters in regard to the promotion of informatization:
    • 1. Establishment of the basic plan and the implementation plan;
    • 2. Analysis and monitoring performance of implementation of the implementation plan;
    • 3. Other important matters related to informatization.
  • (2) The Committee shall be comprised of not more than 25 members, including one chairperson and one vice chairperson.
  • (3) The Director General of the Policy Planning Office shall serve as the chairperson of the Committee, and the vice chairperson shall be elected by and from among committee members, while committee members shall be appointed or commissioned by the Mayor from among the following persons:
    • 1. Class-Ⅳ or higher-ranking public officials from the Metropolitan Government;
    • 2. Persons recommended by the Busan Metropolitan Council;
    • 3. Persons who have sound expertise and experience in informatization.
  • (4) The term of office for each commissioned member shall be two years but may be renewed only once: Provided, That the term of office for a member filling a vacancy shall be the remaining term of his/her predecessor.
  • (5) The chairperson shall represent the Committee and shall have overall control over its affairs.
  • (6) If the chairperson is unable to perform his/her duties due to extenuating circumstances, the vice chairperson shall act on behalf of the chairperson, but if both the chairperson and the vice chairperson are unable to perform their duties due to an unavoidable cause or event, the committee member designated in advance by the chairperson shall act on behalf of the chairperson.
  • (7) The chairperson shall convene and preside over meetings of the Committee.
  • (8) A meeting of the Committee shall be duly formed with the attendance of the majority of incumbent committee members and shall adopt a resolution by a concurrent vote of a majority of committee members present at the meeting.
  • (9) The Committee shall have one secretary to have him/her carry out administrative affairs of the Committee, and the officer in charge of the basic plan for informatization shall serve as the secretary.
  • (10) Commissioned members may be reimbursed for allowances and travel expense within budgetary limits.
  • (11) Except as otherwise provided for in this Ordinance, matters necessary for the operation of the Committee shall be determined by the chairperson of the Committee, subject to prior resolution of the Committee.
    • Article 7 (Officer Responsible for Informatization) (1) The Mayor shall designate an officer responsible for overall administration of informatization (hereinafter referred to as the “officer responsible for informatization”) in order to establish and enforce policies on informatization efficiently and coordinate informatization projects.
    • (2) The head of the division responsible for overall administration of informatization shall serve as the officer responsible for informatization.
    • (3) The head of a division who intends to implement a project related to informatization shall consult thereon in advance with the officer responsible for informatization.
    • (4) The officer responsible for informatization shall carry out the following works:
      • 1. Overall administration, coordination, assistance, and evaluation in regard to informatization projects;
      • 2. Interconnection and coordination between policies on informatization and other polices and plans;
      • 3. Consolidation, coordination, and systematic management in regard to the acquisition, distribution, and use of information resources;
      • 4. Assistance in administrative affairs by using information technology;
      • 5. Spread of information culture and alleviation of information gaps;
      • 6. Introduction and utilization of information technology architectures;
      • 7. Education for the enhancement of capability of informatization.

CHAPTER Ⅲ PROMOTION OF INFORMATIZATION, MANAGEMENT OF INFORMATION DATA, ETC.

  • Article 8 (Promotion of Informatization of each Area) (1) The Mayor shall promote informatization of each sector, including public administration, residents' living, industries, welfare, education, and culture, in order to enhance the efficiency of administrative works and increase citizens' benefits.
  • (2) In promoting informatization, the Mayor shall secure compatibility to enable the common use of administrative information and information resources and standardize work in order to prevent budget wastage.
  • (3) The Mayor may entrust a legal entity or an organization with the operation of an information project, an information system, or such.
  • Article 9 (Cooperation with Private Institutions, etc.) (1) In promoting informatization, the Mayor may invite investment from the private sector actively and may provide necessary assistance to related private business entities, institutions, and organizations.
  • (2) The Mayor may promote cooperation with institutions and organizations related to informatization and foreign institutions, organizations, governments in order to promote informatization efficiently.
  • Article 10 (Establishment and Operation of Information and Communication Networks, etc.) (1) When the Mayor intends to establish and operate an information and communication network, he/she shall utilize the Busan Information Expressway first in order to avoid double investment in information and communication networks and then shall utilize the national information and communication services provided by the Minister of Public Administration and Safety, if it is impossible or inefficient to utilize the Busan Information Expressway.
  • (2) The Mayor may establish and operate an integrated information center in order to systematically manage and efficiently utilize various knowledge and information resources.
  • Article 11 (Provision and Utilization of Knowledge and Information Resources) (1) The Mayor shall provide citizens with information and communication services necessary for them to access and utilize various knowledge and information resources managed by the Mayor.
  • (2) If the Mayor considers it necessary to improve or supplement information and communication services, he/she shall collect opinions from users of such information and communication services and take appropriate measures therefor.
  • (3) The Mayor shall establish and enforce policies necessary for encouraging citizens to use information and communication services and may reward exemplary users within budgetary limits.
  • Article 12 (Establishment of Spatial Information, Provision of Information Data, etc.) (1) The Mayor shall prepare policies necessary for the efficient establishment and comprehensive utilization and management of a spatial information system so that citizens can easily access and use the spatial information of the Busan Metropolitan Government (hereinafter referred to as “spatial information”).
  • (2) The Mayor may duplicate or publish and distribute the whole or part of the spatial information database or provide information users with data from the database. In such cases, a person who intends to use information shall file an application for the provision of information data in the form attached hereto.
  • (3) When the Mayor provides data about spatial information pursuant to paragraph (2), he/she shall collect fees for providing spatial information in accordance with Table 2 attached hereto, as determined in accordance with the guidelines for the determination of fees for providing spatial information in attached Table 1.
  • (4) Notwithstanding paragraph (3), a person may be exempted from fees fully or partially in any of the following cases:
    • 1. Where the central government, a local government, or a managing agency uses information for its affairs: Fully exempted;
    • 2. Where an educational or research institute uses information for education or research: Reduced by 50/100.
  • Article 13 (Education on Informatization) (1) The Mayor shall conduct educational programs on informatization for citizens and public officials in order to enhance their capabilities of utilizing information and promoting informatization.
  • (2) The Mayor shall secure facilities and equipment necessary in permanent educational facilities or educational and training institutions of the Metropolitan Government in order to conduct educational programs on informatization efficiently.
  • (3) The Mayor may provide educational facilities of public and private institutions with facilities, equipment, budget, and other assistance necessary in expanding bases for education on informatization.

CHAPTER Ⅳ PREVENTION OF ADVERSE EFFECTS OF INFORMATIZATION

  • Article 14 (Establishment and Operation of Information Culture Center) (1) The Mayor may establish and operate the Busan Metropolitan Information Culture Center (hereinafter referred to as the “Center”) in order to authorize the Center to conduct the following activities:
    • 1. Development and promotion of information culture;
    • 2. Counselling, education, and public relations activities for preventing and eliminating adverse effects of informatization;
    • 3. Training of professional human resources for preventing and eliminating adverse effects of informatization;
    • 4. Operation of other programs related to the prevention of internet addiction.
  • (2) The Center shall have experts who have expertise and experience in relevant fields in order to efficiently conduct the activities falling under the subparagraphs of paragraph (1) in operating the Center.
  • (3) In order to operate the Center efficiently, the Mayor may entrust the operation of the Center to a nonprofit legal entity or an organization established to carry out projects for preventing and eliminating adverse effects of informatization.
  • (3) In order to operate the Center efficiently, the Mayor may entrust the operation of the Center to a nonprofit legal entity or an organization established to carry out projects for preventing and eliminating adverse effects of informatization.
  • (4) If the Mayor entrusts a legal entity or organization with the operation of the Center pursuant to paragraph (3), he/she may subsidize the legal entity or organization, within budgetary limits, for expenses incurred in the operation of the Center.
  • (5) Except as otherwise provided for in this Ordinance, the Busan Metropolitan Government Framework Ordinance in Entrustment to Private Sector shall apply to the entrustment of the Center mutatis mutandis.
  • Article 15 (Alleviation of Information Gaps)
  • Pursuant to Article 34 of the Framework Act on National Informatization, the Mayor may fully or partially subsidize a person who provides an information and communication product, for consideration or without consideration, for operating expenses, such as telecommunications expenses incurred in using the information and communication product or information and communication services.
  • Article 16 (Entrustment of Education for Alleviation of Information Gaps) (1) In order to efficiently carry out works related to education for the alleviation of information gaps, the Mayor may entrust such works to a legal entity or an organization that has human resources and facilities necessary for education on informatization.
  • (2) If the Mayor entrusts a legal entity or an organization with works related to education for the alleviation of information gaps pursuant to paragraph (1), he/she may subsidize the legal entity or organization, within budgetary limits, for expenses incurred in carrying out the entrusted works.
  • Article 17 (Protection of Information) (1) The Mayor shall establish and enforce the following measures necessary for protecting information:
    • 1. Physical security measures for information resources, such as the authority for accessing the data center that operates and manages an integrated information system;
    • 2. Management of personal and administrative information at each stage of collection, processing, utilization, and destruction of such information;
    • 3. A supervision system for preventing information from being leaked;
    • 4. Other measures necessary for protecting information.
  • (2) The Mayor shall establish guidelines for the protection of personal information and publish the guidelines through the Metropolitan Government's web-site.
