BUSAN METROPOLITAN CITY ORDINANCE ON THE SUPPORT FOR THE DEVELOPMENT OF UNIVERSITIES AND COLLEGES AND REGIONAL HUMAN RESOURCES

CHAPTER I GENERAL PROVISIONS

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to promote the creation of jobs and the boosting of the regional economy through the development of human resources by prescribing matters necessary for formulating and implementing policies on the provision of support for the development of universities, colleges and regional human resources in Busan Metropolitan City.
  • Article 2 (Responsibilities) (1) The Busan Metropolitan City Government (hereinafter referred to as the "City") shall establish policy measures and a budget required for developing universities, colleges and regional human resources and shall prepare schemes for administrative and financial support therefor.
  • (2) Enterprises and public entities shall endeavor to increase the employment of regional human resources and shall fully cooperate with the City Government in implementing policy measures therefor.
  • Article 3 (Formulation and Implementation of Master Plans) (1) The Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") shall formulate five-year master plans for supporting the development of universities, colleges and regional human resources (hereinafter referred to as "master plans") and shall formulate and execute annual implementation plans.
  • (2) The Mayor may request universities, colleges and related institutions to provide data necessary for formulating and executing master plans and implementation plans.

CHAPTER II COUNCIL FOR SUPPORTING DEVELOPMENT OF UNIVERSITIES, COLLEGES AND REGIONAL HUMAN RESOURCES IN BUSAN METROPOLITAN CITY

  • Article 4 (Establishment)
  • For discussion and coordination on important issues concerning the development of universities, colleges and regional human resources, the Mayor shall establish the Council for Supporting the Development of Universities, Colleges and Regional Human Resources in Busan Metropolitan City (hereinafter referred to as the "Council"), comprised of members from universities, colleges, enterprises, research institutes, etc.
  • Article 5 (Functions)
  • The Council shall discuss and coordinate on the following matters:
    • 1. The formulation and implementation of master plans under Article 3;
    • 2. The evaluation of policy measures for supporting the development of universities, colleges and regional human resources and the improvement of systems therefor;
    • 3. Projects for supporting the development of universities, colleges and regional human resources and cooperation in such projects;
    • 4. The analysis and evaluation of the status of employment of regional human resources;
    • 5. Support for organizations related to supporting the development of universities, colleges and regional human resources;
    • 6. Other matters presented to a meeting by either of the chairpersons of the Council for supporting the development of universities, colleges and regional human resources.
  • Article 6 (Composition) (1) The Council shall be comprised of a maximum of 40 members, including two chairpersons. ‹Amended by Ordinance No. 5633, Sep. 27, 2017›
  • (2) The Mayor shall serve as a chairperson of the Council, and the other chairperson shall be elected by and from among commissioned council members. ‹Amended by Ordinance No. 5633, Sep. 27, 2017›
  • (3) The Chief Officer of Growth Strategy Headquarters shall serve as a council member, and the rest of council members shall be commissioned by the Mayor, from among the following persons, taking into account the legal gender quota: ‹Amended by Ordinance No. 5331, Jun. 8, 2016; Ordinance No. 5633, Sep. 27, 2017; Ordinance No. 5848, Jan. 9, 2019›
    • 1. Presidents of universities and colleges in the Busan Metropolitan area;
    • 2. Heads of education-related institutions in the Busan Metropolitan area;
    • 3. Representatives from economy-related organizations or enterprises in the Busan Metropolitan area;
    • 4. Heads of specialized research institutes in the Busan Metropolitan area;
    • 5. Persons recommended by the Busan Metropolitan City Council;
    • 6. Other persons with extensive knowledge and experience in developing universities, colleges and regional human resources.
  • Article 7 (Term of Office)
  • Each council member shall hold office for a term of two years and may be commissioned consecutively only for one additional term: Provided, That the term of office of a council member commissioned to fill a vacancy shall correspond to the remaining term of office of his or her predecessor.
  • Article 8 (Duties of Chairpersons) (1) Each chairperson shall represent the Council and administer all affairs of the Council. ‹Amended by Ordinance No. 5633, Sep. 27, 2017›
  • (2) If both of the chairpersons are unable to perform their duties due to any unavoidable cause, the council member designated in advance by the Mayor serving as a chairperson shall act on behalf of the chairpersons. ‹Amended by Ordinance No. 5633, Sep. 27, 2017›
  • Article 9 (Meetings) (1) The chairpersons shall convene and preside over meetings of the Council.
  • (2) Meetings of the Council shall be divided into annual meetings and special meetings; an annual meeting shall be held once a year, and a special meeting shall be convened by either of the chairpersons when he or she deems necessary or at the request of a minimum of 1/3 of current council members. ‹Amended by Ordinance No. 5633, Sep. 27, 2017›
  • (3) A majority of the current members of the Council shall constitute the quorum of a meeting, and any decision thereof shall require the concurring vote of a majority of those present at the meeting.
  • Article 10 (Hearing of Opinions)
  • If necessary, the Council may summon relevant public officials or experts to the Council to hear their opinions or may request related institutions or organizations to provide data and cooperate with the Council in any other manner, as necessary.
  • Article 11 (Executive Secretary and Others)
  • For the purpose of executing administrative affairs of the Council, the Council shall have one executive secretary and one clerk; the Director in charge of cooperation with universities and colleges shall serve as the executive secretary, and the Grade V public official in charge of cooperation with universities and colleges shall serve as the clerk.
  • Article 12 (Allowances)
  • Allowances, travel expense, etc. may be paid to commissioned council members and relevant experts for attending a meeting of the Council within the budget.
  • Article 13 (Operating Rules)
  • Except as otherwise provided in this Ordinance, matters necessary for the operation of the Council shall be determined by the chairpersons of the Council after resolution by the Council.

CHAPTER III IMPLEMENTATION OF PROJECTS FOR DEVELOPING UNIVERSITIES, COLLEGES AND REGIONAL HUMAN RESOURCES

  • Article 14 (Projects for Developing Universities, Colleges and Regional Human Resources)
  • The Mayor shall implement the following projects to develop universities, colleges and regional human resources, with cooperation of the industries, academia and research institutes: ‹Amended by Ordinance No. 5633, Sep. 27, 2017›
    • 1. Projects for enhancing educational capabilities of universities and colleges and for strengthening their global competitiveness;
    • 2. Projects for implementing measures for promoting the development of regional human resources and for fostering related organizations;
    • 3. Projects for establishing a foundation for the development of regional human resources and projects for survey and research thereon;
    • 4. Projects for increasing the employment of regional human resources by enterprises and public entities;
    • 5. Projects for establishing a foundation for the settlement of regional human resources in the region by providing student loans, subsidies for dormitory charges, etc.; ‹Amended by Ordinance No. 5633, Sep. 27, 2017›

    • 7. Other projects implemented to facilitate the development of universities, colleges and regional human resources.
  • Article 15 (Subsidization of Expenses) (1) The Mayor may grant subsidies to universities, colleges or organizations for expenses incurred to them in the process of performing any of the projects referred to in Article 14, within the budget, so as to develop universities, colleges and regional human resources.
  • (2) The Busan Metropolitan City Ordinance on the Management of Local Subsidies shall apply to matters necessary for the procedure, methods, etc. for the grant of subsidies for expenses under paragraph (1).
  • Article 16 (Entrustment of Administrative Affairs) (1) The Mayor may entrust administrative affairs, in whole or in part, to corporations and organizations related to the development of regional human resources so as to efficiently implement the projects for developing universities, colleges and regional human resources under Article 14.
  • (2) Except as otherwise provided in this Ordinance, the Busan Metropolitan City Framework Ordinance on Entrustment to the Private Sector shall apply where administrative affairs are entrusted under paragraph (1). ‹This Article Wholly Amended by Ordinance No. 5633, Sep. 27, 2017›
  • Article 17 (Establishment of Cooperation System)
  • If the Mayor deems necessary for smooth implementation of projects for developing universities, colleges and regional human resources, he or she may implement a project jointly with related institutions and non-governmental organizations.
  • Article 18 (Support and Awards for Increasing Employment) (1) The Mayor shall make every effort to provide administrative and financial support to enterprises and public entities falling under any subparagraph of Article 13 (3) of the Act on the Development of Local Universities and Colleges and Regional Human Resources.
  • (2) The Mayor may give awards in accordance with the Busan Metropolitan City Ordinance on Awards to persons who are recognized to have made significant achievements in any field related to projects for developing universities, colleges and regional human resources.

CHAPTER IV BUSAN METROPOLITAN CITY FUND FOR DEVELOPMENT OF UNIVERSITIES, COLLEGES AND REGIONAL HUMAN RESOURCES

  • Article 19 (Establishment and Raising of Fund) (1) In order to attain the purpose of this Ordinance, the Mayor shall establish the Busan Metropolitan City Fund for the Development of Universities, Colleges and Regional Human Resources (hereinafter referred to as the "Fund") under Article 142 of the Local Autonomy Act.
  • (2) The Fund shall be raised with the following resources:
    • 1. Subsidies from the National Treasury;
    • 2. Contributions from the City Government;
    • 3. Profits from the operation of the Fund;
    • 4. Other contributions, subsidies, loans, etc.
  • Article 20 (Uses of Fund)
  • The Fund shall be operated for the following uses:
    • 1. The implementation of the projects referred to in Article 14;
    • 2. Other expenses necessary for supporting the development of universities, colleges and regional human resources.
  • Article 21 (Committee for Deliberation on Fund Operation)(1) The Busan Metropolitan City Committee for Deliberation on the Operation of the Fund for the Development of Universities, Colleges and Regional Human Resources (hereinafter referred to as the "Committee") shall be established in order to deliberate on the following matters concerning the operation of the Fund. In this regard, the Committee shall be deemed a committee for deliberation on fund operation under Article 13 (1) of the Framework Act on the Management of Local Government Funds. ‹Amended by Ordinance No. 5232, Nov. 4, 2015›
    • 1. The raising of the Fund and the procurement of financial resources;
    • 2. The formulation of and amendment to the fund operation plan;
    • 3. The settlement of the Fund;
    • 4. Matters prescribed in Article 7 (1) of the Busan Metropolitan City Ordinance on the Subsidization of Interest on Student Loans for University Students; ‹Newly Inserted by Ordinance No. 5232, Nov. 4, 2015›
    • 5. Other matters necessary for the management and operation of the Fund.
  • (2) The Committee shall be comprised of a maximum of 15 members, including one chairperson and one vice-chairperson.
  • (3) The Chief Officer of Growth Strategy Headquarters shall serve as the chairperson of the Committee; the vice-chairperson shall be elected by and from among committee members; and the rest of committee members shall be appointed or commissioned by the Mayor, from among the following persons, taking into account the legal gender quota: ‹Amended by Ordinance No. 5331, Jun. 8, 2016; Ordinance No. 5633, Sep. 27, 2017; Ordinance No. 5793, Aug. 1, 2018; Ordinance No. 5848, Jan. 9, 2019›
    • 1. Grade IV or higher-ranking public officials of the City;
    • 2. Persons recommended by the Busan Metropolitan City Council;
    • 3. Other persons with abundant knowledge and experience in projects for developing universities, colleges and regional human resources.
  • (4) For the purpose of executing administrative affairs of the Committee, the Committee shall have one executive secretary, and the Grade V public official in charge of cooperation with universities and colleges shall serve as the executive secretary.
  • (5) Articles 7 through 10, 12 and 13 shall apply mutatis mutandis to matters concerning the operation of the Committee, including the term of office of commissioned members and meetings of the Committee.
  • Article 22 (Guidance and Supervision)(1) The Mayor may inspect, guide and supervise universities, colleges and related institutions and organizations to make sure that the subsidies granted to them for expenses are used for the prescribed purposes.
  • (2) If the Mayor finds any violation of law or unfair practice as a result of the guidance and supervision under paragraph (1), he or she mayissue an order to take corrective measures or may take necessary measures.
  • Article 23 (Public Officials in Charge of Accounting)
  • For the purpose of executing administrative affairs related to the revenue and expenditure of the Fund, the Mayor shall designate public officials in charge of accounting as follows: ‹Amended by Ordinance No. 5793, Aug. 1, 2018; Ordinance No. 5848, Jan. 9, 2019›
    • 1. Fund Operation Officer: Chief Officer of Growth Strategy Headquarters;
    • 2. Assistant Fund Operation Officer: Director in charge of the Fund;
    • 3. Fund Accounting Officer: Grade V public official in charge of the Fund.

ADDENDA

  • Article 1 (Enforcement Date)
  • This Ordinance shall enter into force on the date of its promulgation: Provided, That the amended provisions of Chapter IV (Articles 19 through 22) shall enter into force on January 1, 2016.
  • Article 2 (Transitional Measure concerning Fund)
  • The "Busan Metropolitan City Fund for the Development of Human Resources and the Promotion of Science and Technology" existing under previous provisions as at the time this Ordinance enters into force shall be deemed the "Busan Metropolitan City Fund for the Development of Universities, Colleges and Regional Human Resources" under this Ordinance.
  • Article 3 (Period of Validity of Fund)
