BUSAN METROPOLITAN CITY ORDINANCE ON REGULATORY REFORM COMMITTEE

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to provide for matters concerning the organization and operation of the Regulatory Reform Committee of Busan Metropolitan City (hereinafter referred to as the "Committee") which shall be established under Article 3 (3) of the Framework Act on Administrative Regulations to enhance citizens' life quality and that City's competitiveness by promoting the regulatory reform in administration. <Amended by Ordinance No. 3984, Feb. 16, 2005>
  • Article 2 (Functions)
  • The Committee shall deliberate on those matters which fall under any of the following subparagraphs:
    • 1. Matters concerning the review of existing regulation and the establishment and implementation of a comprehensive plan for regulatory improvement;
    • 2. Matters concerning the review of the imposition of new regulation, the intension of existing regulation, etc.;
    • 3. Matters concerning the registration and promulgation of regulation;
    • 4. Matters concerning the hearing and handling of opinions concerning regulatory reform;
    • 5. Matters concerning the inspection and evaluation of the actual conditions of regulatory reform; and
    • 6. Other matters which the Chairperson refers to the Committee for deliberation and coordination and with respect to which he/she deems it necessary to do so in connection with regulatory reform.
  • Article 3 (Composition)(1) The Committee shall be composed of fifteen or less members including one Chairperson, and 1/2 of them shall not be public officials.:
  • (2) The Chairperson of the Committee shall be the Deputy Mayor for Administrative Affairs of Busan Metropolitan City.
  • (3) Members of the Committee shall be commissioned by the Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") from among members of the Busan Metropolitan Council and other persons who have much knowledge and experience or appointed by him/her from among Grade or higher public officials belonging Ⅲ to Busan Metropolitan City (hereinafter referred to as the "City").
  • (4) The members of the Committee who are not public officials shall hold office for a term of two years and may be commissioned consecutively for a further term.
  • Article 4 (Duties of Chairperson)(1) The Chairperson shall represent the Committee when required and exercise general supervision and control over its affairs.
  • (2) If the Chairperson is unable to perform his/her duties for any unavoidable reason, a member who is nominated in advance by the Chairperson shall act on behalf of the Chairperson.
  • Article 5 (Meeting)(1) The Chairperson shall convene and preside over meetings of the Committee.
  • (2) A majority of the members of the Committee shall constitute a quorum, and all decisions of the Committee shall be taken by a simple majority of those present.
  • (3) If the Chairperson intends to convene a meeting of the Committee, he/she shall determine the date, time and place of the meeting as well as the matters to be referred thereto and notify every member at least seven days before the meeting is held: Provided, That this shall not apply in case of emergency.
  • (4) The meetings of the Committee shall be made public: Provided, That they may not be made public when deemed necessary for the protection of the public interest, etc. by the Chairperson and decided by the Committee.
  • (5) The Chairperson may have public officials related to matters referred to the Committee for deliberation attend a meeting thereof and present their opinions.
  • (6) The Chairperson may have the representatives of organizations related to matters referred to the Committee for deliberation, other relevant experts, etc. attend a meeting thereof and present their oral opinions.
  • Article 6 (Secretary, etc.)(1) There shall be one secretary and one clerk in the Committee, and the secretary shall be the Director of Legal Affairs of the City and the clerk shall be a legislative officer thereof. <Wholly Amended by Ordinance No. 3854, Jul. 10, 2003>
  • (2) The secretary shall deal with general affairs of the Committee by order of the Chairperson, and the clerk shall assist the secretary in doing so. <Newly Inserted by Ordinance No. 3854, Jul. 10, 2003>
  • (3) The secretary may attend a meeting of the Committee and present his/her oral opinions.
  • Article 7 (Establishment of Regulation Report Center)
  • Under the Committee, there shall be established a Regulation Report Center to collect citizens' opinions concerning regulatory reform.
  • Article 8 (Allowances, etc.)
  • Allowances as well as necessary expenses including travel expenses may be paid to the members of the Committee who are not public officials of the City and other persons who attend a meeting of the Committee to present their oral opinions, to such an extent as the relevant budget permits.
