Busan Metropolitan City Ordinance on the Establishment, Operation, and Support of the Social Welfare Facility

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe the matters necessary to establish, operate, and support the Social Welfare Facilities for promoting the regional balance of the social welfare facility, establishing a consumer-centered welfare service delivery system, and ensuring the rationality of the financial support on the social welfare facility.
  • Article 2 (Scope of Application)
  • This Ordinance shall apply to the following social welfare facilities (hereinafter referred to as the “facility”) by aiding in the purchase costs, the construction costs, and reinforcement costs for the operation of the facility (hereinafter referred to as the “subsidy”):
    • 1. The social welfare house under Article 34 of the Social Welfare Services Act;
    • 2. The welfare hall for the disabled under Article 59 of the Welfare of Disabled Persons Act
    • 3. The welfare center for the aged under Article 37 of the Welfare of the Aged Act
  • (2) This Ordinance shall apply to the facility prescribed in paragraph (1) except as provided by Acts and subordinate statutes and Municipal Ordinances.
  • Article 3 (Guarantee of Voluntary Operation)
  • The Mayor of Busan Metropolitan City (hereinafter referred to as “the Mayor”) shall guarantee the voluntary establishment and operation of the facility for vitalizing citizens’ participation and enhancing the expertise and effectiveness of the social welfare services.
  • Article 4 (Validity Evaluation) (1) A person who wishes to establish and operate the facility with a subsidy from the Busan Metropolitan City shall in advance request a validity evaluation of installment for a facility with a project plan including the purpose and content of the project, the cost of the project, and other necessary matters.
  • (2) The head of the Gu who have received a request for a validity evaluation under paragraph (1), shall draw up a written opinion on installment for the facility considering the regional balances of the facility and the demand for local welfare services.
  • (3) The head of the Gu shall submit the project plan under paragraph (1) and the opinion letter under paragraph (2) to the Mayor within one month from the day on which they received such a request of validity evaluation.
  • (4) The Mayor, reviewing the submitted documents under paragraph (3), may reflect the results in providing subsidies under the Busan Metropolitan Ordinance on the Management of Subsidies.
  • (5) The Mayor may entrust the preliminary evaluation according to the validity evaluation, etc. to a nonprofit corporation related to the examination and evaluation of the social welfare work.
  • (6) The Mayor shall separately prescribe the standards of evaluation for the validity evaluation, the method of evaluation, and other necessary matters.
  • Article 5 (Project District)
  • The Mayor may recommend the head of the Gu to establish a project district by the facility considering the local community characteristics and the demand for the social welfare services, etc.
  • Article 6 (Project Plan, etc))(1) The head of the facility shall establish a project plan annually considering the residents’ welfare demand and shall submit the project plan to the head of the Gu through the deliberation of the company committee under Article 36 of the Social Welfare Services Act.
  • (2) The head of a Gu may recommend an adjustment of the project plan submitted under paragraph (1) to ensure no shortage in the social welfare services by region.
  • (3) The head of a Gu shall submit the project plan submitted for the facility to the Mayor before the head of a Gu applies for the first subsidy annually.
  • Article 7 (Public Notice of the Project Plan) (1) The head of a Gu shall post a service supply plan based on the project plan under Article 6 (1) and (2) on the Internet homepage and the bulletin board, etc.
  • (2) The Mayor shall standardize and integrate the main points of the matters posted under paragraph (1) for easy understanding and publish them on the Internet homepage.
  • Article 8 (Customer’s Charter)(1) The head of the facility may establish and declare a customer’s charter including the following matters:
    • 1. Basic duty;
    • 2. Contents and desired levels of the provided services;
    • 3. Management of complaints about the provided services and its corrective procedure; and
    • 4. Effort and plan for enhancing the provided services
  • Article 9 (Evaluation of the Facility) (1) The Mayor may evaluate annually the results of the project plan of the facility, the adequacy of the amount of subsidy enforcement, and customer satisfaction, etc: Provided, that the Mayor may omit the evaluation in a year when the facility evaluation is done under Article 43 (1) of the Social Welfare Services Act.
  • (2) The Mayor may perform the evaluation under paragraph (1) by entrusting it to a nonprofit corporation related to the deliberation and evaluation of the social welfare project.
  • Article 10 (Graded Support of Subsidy)
  • The Mayor may support subsidies of the facility differently, considering the evaluation results of the facility, the size of the facility, the number of employees, local characteristics, and the revenue by the project.
