Busan Metropolitan City Ordinance on the Request of Enactment, Revision and Repeal of Municipal Ordinances and on the Request of Audit and Inspection by Residents
- Article 1(Purpose)
- The purpose of this Ordinance is to prescribe the necessary matters for the request of enactment, revision and repeal of Municipal Ordinances and on the request of audit and inspection by residents under Article 15, Paragraph 1 and Article 16, Paragraph 1 of Local Autonomy Act and Article 26, Paragraph 8of Enforcement Decree of Local Autonomy Act and for the management of Busan Metropolitan City Deliberation Committee for Residents' Request of Audit and Inspection.
- Article 2(Number of Requesting Residents)(1) The number of residents needs to
request under the joint signature for the enactment, revision and repeal of
municipal ordinances to the Busan Metropolitan City Mayor according to Article
15, Paragraph 1 of Local Autonomy Act is 1/85 of the total of the resident of
not less than 19 years of age.
- (2) The number of residents needs to request under the joint signature for the audit and inspection to the competent Minister is 300.
- Article 3(Busan Metropolitan City Deliberation Committee for Residents' Request
of Audit and Inspection)(1) Busan Metropolitan City Deliberation Committee for
Residents' Request of Audit and Inspection(hereinafter referred to as the
"Committee") under Article 26, Paragraph 8 of the Enforcement Decree of
Local Autonomy Act shall consist of 11 members including one and one vice
chairman.
- (2) The Committee shall have one executive secretary and the deputy director who is in charge of request of audit and inspection by residents.
- Article 4(Terms of Committee Member)
- Appointed members of the Committee holds office for 2 years, and the consecutive appointment may be permitted. Yet, the term of office for a committee member who filled the vacancy shall be the remainder of the predecessor.
- Article 5(Duties of the Chairman)(1) The chairman shall represent the
Committee and exercise the overall control of the Committee.
- (2)The vice chairman shall assist the chairman and act on behalf of the chairman when the chairman inevitably can not perform his/her duties.
- Article 6(Meeting)(1) The chairman convokes a meeting and becomes the
chairman of the meeting.
- (2) The chairman shall convoke a meeting if more than one third of the registered Committee members request with signature.
- (3)The chairman must inform all committee members on matters regarding the date and the place of a meeting, and the agenda to be deliberated in the meeting 3 days before the actual meeting takes place. However, this does not apply in case of emergency.
- Article 7(Exclusion of Committee Member)(1) A Committee member shall be excluded from the deliberation and resolution of the Committee if he/she falls
under any of the following subparagraphs:

- 1. When the Committee deals with an item concerning the Committee Member himself/herself;
- 2. When the Committee deals with an item concerning anyone who works in the same branch of the Committee Member concerned; or
- 3. When the Committee deals with an item concerning anyone who is a relative or who was relative of the Committee Member concerned.
- (2) A Committee member who is excluded from the deliberation and resolution of the Committee shall be excluded from the calculation of the number of registered members under Article 26, Paragraph 8 of Enforcement Decree of Local Autonomy Act.
- Article 8(Allowance etc.)
- Allowance and traveling expenses may be provided within the limit of the budget to the appointed Committee members.
- Article 9(Prohibition of Divulgence of Classified Information)
- Anyone who were present at the meeting shall not reveal any classified information obtained during the process of performing their duties.
- Article 10(Managerial Rules)
- The chairman shall decide on necessary matters other than that regulated in this Ordinance with the consent of the Committee.
