BUSAN METROPOLITAN CITY FRAMEWORK ORDINANCE ON GENDER EQUALITY

[Effective December 30, 2020] [Busan Metropolitan City Or_ No. 6286, Partially revised December 30, 2020]

CHAPTER ⅠGENERAL PROVISIONS

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to realize gender equality in all areas such as politics, economy, society, and culture by prescribing matters necessary for the implementation of gender equality policies in accordance with the Framework Act on Gender Equality, and other statutes and regulations relating to gender equality.
  • Article 2 (Definitions)
  • The terms used in this Ordinance shall be defined as follows: <Amended by Ordinance No. 5793, Aug. 1, 2018>
    • 1. The term "gender equality" means a state that ensures the equal enjoyment of human rights by women and men, and equal participation and treatment in all fields, without any discrimination, prejudice, depreciation or violence based on gender, pursuant to subparagraph 1 of Article 3 of the Framework Act on Gender Equality (hereinafter referred to as the "Act");
    • 2. The term "affiliated institution" means the main office of Busan Metropolitan City (hereinafter referred to as the "City"), an institution under the direct control of the City, a business place of the City, or the Secretariat of the Busan Metropolitan Council;
    • 1. The term "City-financed institution" means a public corporation or agency established by the City in accordance with the Local Public Enterprises Act or a City-invested or -funded institution designated and publicly notified by the Minister of the Interior and Safety in accordance with the Act on the Operation of Local Government-Invested or -Funded Institutions. <Amended by Ordinance No. 5793, Aug. 1, 2018>
  • Article 3 (Rights and Obligations of Citizens)
  • All citizens are entitled to the right to receive gender-equal treatment in all domains including family and society and live life in gender equality, and shall recognize the importance of gender equality and strive for the realization thereof.
  • Article 4 (Responsibilities of City)
  • The City shall actively implement policies for the realization of gender equality and faithfully fulfill its responsibilities prescribed in statutes and regulations relating to gender equality.

CHAPTER II COMPREHENSIVE PLANS FOR GENDER EQUALITY AND SYSTEM FOR PROMOTION THEREOF

  • Article 5 (Formulation of Comprehensive Plans for Gender Equality)(1) The Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") shall formulate a comprehensive plan for gender equality of the City (hereinafter referred to as "comprehensive plan") every five years based on the master plan for gender equality policies under Article 7 of the Act.
  • (2) Each comprehensive plan shall include the following matters:
    • 1. Basic objectives and direction-setting for gender equality policies;
    • 2. Tasks and methods to pursue gender equality policies;
    • 3. Matters concerning major gender equality policies;
    • 4. Methods for securing financial resources for the promotion of gender equality policies;
    • 5. Other matters deemed necessary by the Mayor for gender equality.
  • Article 6 (Formulation of Action Plans)(1) The Mayor shall formulate and implement annual action plans (hereinafter referred to as "action plans") according to the comprehensive plan under Article 5.
  • (2) Where necessary for the formulation and implementation of the comprehensive plan and action plans, the Mayor may request for cooperation from Gus, Guns, corporations, organizations, etc. related to gender equality and any person in receipt of such request shall cooperate therewith unless there is a compelling reason not to do so.
  • Article 7 (Evaluation of Implementation Results)
  • The Mayor may evaluate the results of the implementation of gender equality policies by affiliated institutions and City-financed institutions and reflect such results in evaluating the management performance, etc. of City-financed institutions.
  • Article 8 (Establishment of Gender Equality Committee)
  • The Mayor shall have the Busan Metropolitan City Gender Equality Committee (hereafter called “Committee”) in place to examine and coordinate the matters of the following subparagraphs on gender equality pursuant to the Act Article 11-2.
    • 1. 1. Matters concerning comprehensive plans and action plans;
    • 2. 1. Matters concerning the inspection of results of implementing action plans and other gender equality policies;
    • 3. 1. Matters concerning the coordination of and cooperation in projects related to gender equality policies;
    • 4. 1. Matters concerning gender mainstreaming, such as evaluating gender equality policies and improving relevant systems;
    • 5. 1. Matters concerning international cooperation in the field of gender equality;
    • 6. 1. Matters concerning the management and operation of the Childbirth Encouragement and Gender Equality Fund of Busan Metropolitan City;
    • 7. Matter mandated for voting by the Committee pursuant to the Act Article 21 Paragraph 2 Subparagraph 2

    • 10. Other matters deemed necessary by the Chairperson of the Committee for implementing gender equality policies.
  • Article 9 (Composition)① The Council shall consist of up to thirty members, including two chairpersons and one vice chairperson.
  • ② The Mayor and an elected member from the appointed members shall act as the chairperson, and an official ranked director general or higher in charge of the gender equality policy shall act as the vice chairperson.
  • ③ The Mayor shall designate or appoint the members of the Committee, in consideration of gender, out of the officials ranked director general or higher in charge of planning, budget, human resources, and welfare and those with an abundance of professional knowledge and experiences on the gender equality policy.
  • Article 9-2 (Subcommittee)① The Committee may form and have in place up to three subcommittees, by professional category, to examine, coordinate, consult, and discuss the matters under the Committee.
  • ② The subcommittee shall consist of the appointed members from the members of the Committee.
  • ③ The chairperson of the subcommittee shall oversea the works of the subcommittee and be elected from the members of the subcommittee.
  • ④ The chairperson shall determine, with the decision of the Committee, the requirements to operate the subcommittee, other than the stipulation in the ordinance.
  • Article 10 (Term of Office of Members)
  • Commissioned members shall hold office for a term of two years and may be commissioned consecutively only once: Provided, That any member filling a vacancy shall hold office for the remainder of his or her predecessor's term of office.
  • Article 11 (Decommission)
  • The Mayor may decommission a member where the member falls under any of the following:
    • 1. Where he or she is sentenced to imprisonment without labor or a heavier punishment;
    • 2. Where he or she is unable to perform his or her duties due to long-term mental or physical weakness;
    • 3. Where he or she fails to perform his or her duties faithfully;
    • 4. Where he or she divulges confidential information learned in the course of deliberations;
    • 5. Where he or she is deemed unfit to serve as a member due to injury to dignity or any other cause.
  • Article 12 (Disqualification of, Challenge to, or Refrainment by, Members)
  • (1) Any member of the Committee who falls under any of the following subparagraphs shall be disqualified from the Committee's deliberations and decisions:
    • 1. Where the member or his or her current or former spouse is either a party to the relevant agenda item or a joint right holder or joint obligor with the party to the relevant agenda item;
    • 2. Where the member is or was a relative of a party to the relevant agenda item;
    • 3. Where the member has rendered advice, conducted research, or provided service with regard to the relevant agenda item;
    • 4. Where the member or a corporation, organization, etc. to which the member belongs is or was an agent of a party to the relevant agenda item.
  • (2) If the circumstances indicate that it would be impracticable to expect fair deliberations and decisions of a member, any party may file a request for a challenge to the member with the Committee, and the Committee shall make a decision thereon by resolution. In such case, the member to whom the request for a challenge is filed shall not participate in the relevant resolution.
  • (3) Any member who falls under the grounds for disqualification referred to in the subparagraphs of paragraph (1) shall refrain from deliberations and decisions on the relevant agenda item.
  • Article 13 (Duties of Chairpersons)
  • The Chairperson shall represent the Committee and exercise general supervision over its affairs: Provided, That, where the Chairperson is unable to perform his or her duties due to any unavoidable cause, the Vice Chairperson shall act on behalf of the Chairperson.
  • Article 14 (Meetings) (1) The chairperson shall convene a meeting of the committee if deemed necessary by the chairperson or with the request from one third of the registered members or more.
  • (2) When the Chairperson intends to convene a meeting, he or she shall determine the date, time and venue of the meeting, the matters to be referred thereto, etc. and notify each member thereof at least seven days before the meeting is held: Provided, That the same shall not apply in urgent cases or extenuating circumstances.
  • (3) A majority of the members of the Committee shall constitute a quorum, and any decision thereof shall require the concurring vote of a majority of those present.
  • Article 15 (Hearing of Opinions)
  • If necessary in relation to deliberations on agenda items, the Committee may require relevant public officials or experts, etc. to attend its meeting in order to hear their opinions or may request them to submit necessary data.
  • Article 16 (Allowances)
  • Allowances and travel expenses may be paid to the commissioned members who have participated in the committee meetings, relevant experts, and others within the budget.
  • Article 17 (Executive Secretary and Clerk)
  • The Committee shall have one executive secretary and one clerk to handle its affairs, and the executive secretary shall be the head of a division in charge of gender equality affairs while the clerk shall be an official in charge of gender equality affairs.
  • Article 18 (Operating Rules)
  • Except as provided in this Ordinance, matters necessary for the operation of the Committee shall be determined by the Chairperson after resolution by the Committee.

CHAPTER III BASIC MEASURES OF GENDER EQUALITY POLICIES

  • SECTION 1 Promotion of Gender Equality Policies
  • Article 19 (Measures for Gender Mainstreaming)
  • The Mayor shall take measures for gender mainstreaming through which perspectives on gender equality can be integrated in the course of enacting, amending, applying, and interpreting any municipal ordinances, planning policies, compiling and implementing budgets, and performing other duties; and shall proactively develop various methods and tools to enhance the effectiveness of measures for gender mainstreaming.
  • Article 20 (Gender Impact Assessment)
  • The Mayor shall assess the impact of a policy on gender equality in the process of formulating or implementing the policy, and matters necessary therefor shall be governed by the Busan Metropolitan City Ordinance on Gender Impact Assessment. <Amended by Ordinance No. 5862, Feb. 6, 2019>
  • Article 21 (Gender Responsive Budgeting)
  • The Mayor shall analyze the impact of budget on women and men and implement gender responsive budgeting which reflects such impact in the financial operation of the City.
  • Article 22 (Gender Responsive Statistics)
  • Where the Mayor compiles population statistics, he or she shall differentiate between genders in the statistics that provide information on the current conditions and characteristics of each gender; and shall distribute them to the relevant institutions.
  • Article 23 (Gender Responsive Education)
  • The Mayor shall provide education to public officials under his or her jurisdiction, etc. to increase their ability to recognize the impact of statutes and regulations, policies, customs, all types of systems, etc. on men and women in all areas such as politics, economy, society and culture.

SECTION 2 Gender-Equal Participation

  • Article 24 (Proactive Measures)
  • The Mayor shall strive to take proactive measures, such as provision of administrative or financial assistance, as prescribed by relevant statutes and regulations, in order for the affiliated institutions and City-financed institutions to accomplish substantial gender equality by facilitating participation of a particular gender within a reasonable extent in the fields where the participation of such gender is conspicuously low.
  • Article 25 (Participation in City Administration) (1) The Mayor shall strive to ensure the equal participation of women and men in city administration through various methods.
  • (2) When organizing various committees, the Mayor shall ensure that the members of any particular gender do not exceed 6/10 of the number of commissioned members: Provided, That the same shall not apply where the resolution referred to in the proviso of Article 21 (2) of the Act has been adopted.
  • Article 26 (Access to Public Positions)
  • The Mayor shall prepare policies for the equal access of women and men to public positions and provide equal opportunities to women and men in employment, assignment to positions, promotion, rewards, education, training, etc. of public officials under his or her jurisdiction.
  • Article 27 (Participation in Economic Activities and Creation of Environment Therefor) (1) The Mayor shall actively implement policies to ensure the equal participation of women and men in economic activities.
  • (2) To encourage the participation of career-interrupted women, etc. in economic activities pursuant to Article 24 (4) of the Act, the Mayor may partially subsidize expenses incurred in women's employment, business start-up or enterprise activities within the budget.
  • (3) The Mayor shall implement various projects to spread awareness of gender equality in employment from May 25 to May 31 of each year, the period to emphasize equal employment for both genders under Article 4 of the Enforcement Rule of the Equal Employment Opportunity and Work-Family Balance Assistance Act.
  • Article 28 (Guarantee of Rights of Maternity and Paternity)
  • The Mayor shall guarantee maternal and paternal rights with respect to pregnancy, childbirth, breast feeding, and child care and shall not put them at a disadvantage at home, in workplaces, or in the regional community on such grounds.
  • Article 29 (Support for Work-Family Balance)
  • The Mayor shall actively prepare policies on the following to ensure that the employees of affiliated institutions and City-financed institutions can maintain a harmonious balance between work and family life:
    • 1. Expanding facilities for child care and early childhood education;
    • 2. Revitalizing after-school child care;
    • 3. Expanding a child care leave system and securing substitute workers;
    • 4. Other matters deemed necessary by the Mayor to support work-family balance.
  • Article 30 (Development of Female Workforce) (1) To realize a gender-equal society, the Mayor shall actively implement policies necessary for the development of female workforce.
  • (2) The Mayor shall strive to support and foster social education institutions for women, female workforce development centers, etc.
  • (3) The Mayor shall actively implement policies for the development of women's careers by life cycle and the training of female managers.

SECTION 3 Protection of Human Rights and Promotion of Welfare

  • Article 31 (Prohibition of Gender Discrimination and Measures to Prevent Sexual Harassment) (1) The Mayor shall strive to prepare policies for prevention of gender discrimination.
  • (2) The Mayor shall provide education to employees under his or her jurisdiction at least once a year for prevention of the occurrence of sexual harassment cases and take other precautionary measures, and, where such case arises, he or she shall take appropriate action for or against the persons involved therein.
  • (3) The Mayor shall provide education to employees under his or her jurisdiction for prevention of crimes of sexual violence, domestic violence, and sex trafficking, as prescribed by the relevant Acts, and may integrate each relevant education and education for prevention of sexual harassment under paragraph (2).
  • (4) The Mayor shall establish and operate a desk for counseling of sexual harassment grievances in order to protect sexual harassment victims.
  • (5) The Mayor shall proactively develop and implement policies to prevent crimes of sexual violence, domestic violence, and sex trafficking and protect the victims thereof.
  • Article 32 (Promotion of Women's Welfare and Health) (1) The Mayor shall increase the number of the necessary facilities to enhance equal social participation by, and welfare of, women in disadvantaged classes, such as persons with disabilities, single parents, North Korean refugees, and international marriage immigrants, and actively support their education, job training, independence, and rehabilitation.
  • (2) The Mayor shall strive to guarantee gender-equitable access to health and medical services and shall prepare health promotion policies based on women's life cycle, including maternity health.
  • Article 33 (Assistance to Organizations Related to Gender Equality Policies)
  • The Mayor may render administrative or financial assistance necessary for the activities that relevant non-profit corporations or non-profit private organizations perform for projects, etc. to promote gender equality, protect women's human rights, and enhance women's welfare.

SECTION 4 Expansion of Gender Equality Culture

  • Article 34 (Gender-Equal Education) (1) The Mayor shall implement and support relevant projects so that education designed to raise awareness of gender equality can be conducted in families, schools, and lifelong education.
  • (2) The Mayor shall strive to ensure that educational courses designed to raise awareness of gender equality are included in education and training plans, etc. under Article 12 of the Education and Training of Local Public Officials Act.
  • Article 35 (Creation of Culture of Gender Equality) (1) The Mayor shall develop and promote effective projects for the creation of a culture of gender equality.
  • (2) The Mayor shall provide support for the improvement of gender-based discrimination in the content of mass media and shall strive to ensure that awareness of gender equality can be promoted through mass media.
  • Article 36 (Events for Gender Equality Week) (1) The Mayor may conduct or support a celebratory event for the Gender Equality Week pursuant to the Act Article 38 Paragraph 1 and the Framework Act for Gender Equality Enforcement Decree Article 23.
  • (2) The Mayor may conduct or support a celebratory event for the First Korean Women's Rights Announcement Day pursuant to Article 38 Paragraph 2.
  • Article 37 (Women-Friendly Cities) (1) The Mayor shall strive to develop a women-friendly city which enables women and men to equally participate in regional policies and development processes and ensures the empowerment of women, their safety, and care for them.
  • (2) The Mayor may render administrative or financial assistance for a Gu/Gun to be designated as a women-friendly city.
  • Article 38 (Busan Women's Award) (1) The Mayor shall annually select women who have contributed to the realization of a gender-equal society, the promotion of women's rights and interests, and the development of the regional community, and confer the Busan Women's Award on such women.
  • (2) The Busan Women's Award shall be conferred on the following women of distinguished service who are selected pursuant to paragraph (1): Provided, That the Award may not be conferred when no one is eligible for such conferment as a result of screening therefor:
    • 1. A woman who has contributed to the promotion of gender equality and women's social participation;
    • 2. A woman who has contributed to the promotion of women's rights and interests;
    • 3. A woman who has set a good example for other women in Busan by devoting her lifetime to rendering service to the development of the regional community;
    • 4. Any other woman who has made a great contribution to the enhancement of women's status, etc.
  • (3) Women qualified to receive the Busan Women's Award shall be those who have resided in the City for at least five consecutive years as of the date the recommendation of candidates for the Award is publicly announced, and who are recommended by the heads of affiliated institutions or City-financed institutions, the representatives of non-profit organizations or corporations, the joint signature of at least 20 ordinary citizens, etc.; and detailed matters necessary for the conferment of the Award shall be separately determined by the Mayor.
  • Article 39 (Citations for Persons of Distinguished Service)
  • The Mayor may annually award citations to the following persons who have contributed to promoting gender equality, expanding women's social participation, enhancing women's rights and interests, or conducting other similar activities:
    • 1. Persons or institutions that have contributed to gender equality;
    • 2. Model enterprises that have employed men and women equally;
    • 3. Married couples who are equal respectively.
  • Article 40 (Support for International Cooperation) (1) The Mayor shall support the equal participation of women and men in international bodies or international conferences, and prepare policies for gender equality in undertaking activities for international development cooperation.
  • (2) The Mayor shall strive to ensure that women and men can equally participate in the promotion of peace loving mind in and out of Korea and in the process of promoting reunification of Korea.

CHAPTER IV CHILDBIRTH ENCOURAGEMENT AND GENDER EQUALITY FUND

  • Article 41 (Establishment and Classification of Fund)
  • (1) The Mayor shall establish the Childbirth Encouragement and Gender Equality Fund of Busan Metropolitan City (hereinafter referred to as the "Fund") to realize gender equality, support single-parent families, encourage childbirth, and support the nurturing of youth, and shall classify and operate the Fund according to the following accounts: <Amended by Ordinance No. 5241, Nov. 4, 2015>
    • 1. Gender equality account;
    • 2. Childbirth encouragement account;
    • 3. Youth nurture account.
  • (2) The Fund shall be raised from the following financial resources:
    • 1. Contributions from the City;
    • 2. Profits from the operation of the Fund;
    • 3. Other revenues.
  • Article 42 (Use of Fund)
  • (1) The Fund in the gender equality account shall be used for the following purposes:
    • 1. Assisting projects for the realization of gender equality;
    • 2. Assisting organizations, etc. related to gender equality policies under Article 33;
    • 3. Assisting projects related to international cooperation under Article 40;
    • 4. Expenses necessary for providing support under the subparagraphs of Article 7 (1) of the Busan Metropolitan City Ordinance on Single-Parent Family Support;
    • 5. Other projects deemed by the Mayor necessary for the realization of gender equality, such as protecting women's human rights, promoting their welfare, and assisting their families.
  • (2) The Fund in the childbirth encouragement account shall be used for the following purposes: <Amended by Ordinance No. 5623, Aug. 9, 2017>
    • 1. Subsidizing educational expenses for the encouragement of childbirth;
    • 2. Assisting organizations, etc. related to projects to encourage marriage and childbirth;
    • 3. Creating an environment for the encouragement of marriage, pregnancy, childbirth, and child care; and providing support therefor;
    • 4. Housing loan and interest support for newly weds
    • 5. Other matters necessary to support the encouragement of marriage and childbirth.
  • (3) The Fund in the youth nurture account shall be used for the following purposes:
    • 1. Assisting youth activities;
    • 2. Assisting the establishment and operation of youth facilities;
    • 3. Assisting the training of certified youth leaders;
    • 4. Assisting the activities of youth organizations and councils;
    • 5. Subsidizing educational expenses for exemplary youth and youth in financial difficulties;
    • 6. Assisting youth exchange;
    • 7. Survey, research, and publicity concerning the nurturing, etc. of youth;
    • 8. Youth welfare, protection, guidance, and counseling;
    • 9. Promotion of youth sports and culture;
    • 10. Reward and encouragement for youth;
    • 11. Other projects for the nurturing of youth.

  • Article 43 (Management and Operation) (1) The Fund's account shall be separately opened and managed, and the Fund shall not be included in revenue and expenditure budgets.
  • (2) The Fund shall be deposited, at a high interest rate, and managed in the treasury of the City.
  • (3) In principle, the Fund shall be disbursed within the extent of profits accrued from the operation of the Fund: Provided, That the same shall not apply to the childbirth encouragement account. <Amended by Ordinance No. 5623, Aug. 9, 2017>
  • (4) The following matters concerning the management and operation of the Fund shall undergo deliberation by the Committee:
    • 1. Formulation of Fund management plans, and preparation of a report on the settlement of accounts of the Fund;
    • 2. Analysis of the results of Fund management;
    • 3. Other matters necessary for the management and operation of the Fund, which are referred to a meeting of the Committee by the Mayor.
  • Article 44 (Fund Management Plan)
  • The Mayor shall annually formulate a Fund management plan including the following matters:
    • 1. 1. Matters concerning the revenue and expenditure of the Fund;
    • 2. 1. Matters concerning project plans and fund plans for the relevant year;
    • 3. 1. Matters concerning the assets of the Fund;
    • 4. 1. Other matters deemed necessary for the management of the Fund.
  • Article 45 (Accounting Public Officials)
  • (1) The following accounting public officials shall be designated to manage and operate the Fund efficiently: <Amended by Ordinance No. 5241, Nov. 4, 2015>
    • 1. The Fund management officer: The Director-General of Women and Family Affairs Bureau;
    • 2. Officers in charge of divided fund management:
      • (a) Gender equality account: The Director of Women and Family Affairs Division;
      • (b) Childbirth encouragement account: The Director of Childbirth and Child Care Division;
      • (c) Youth nurture account: The Director of Child and Youth Policy Division;
    • 3. Clerks in charge of accounts of the Fund:
      • (a) Gender equality account: The Manager in charge of affairs regarding gender equality;
      • (b) Childbirth encouragement account: The Manager in charge of affairs regarding the encouragement of childbirth;
      • (c) Youth nurture account: The Manager in charge of affairs regarding the nurturing of youth.
  • (2) The Fund management officer and clerks in charge of accounts of the Fund shall keep necessary account books and separately manage evidential documents concerning the Fund.
  • Article 46 (Settlement of Accounts of Fund)
  • A report on the settlement of accounts of the Fund shall include the following:
    • 1. Documents relating to any summary and analysis of the settlement of accounts of the Fund;
    • 2. Specifications relating to the management of reserves;
    • 3. Specifications relating to the management of the Fund for the relevant year;
    • 4. Documents clarifying any cash revenue and expenditure, such as revenue and expenditure statements.
  • Article 47 (Application Mutatis Mutandis of Relevant Provisions)
  • Matters that are not prescribed by this Ordinance with regard to the management and operation of the Fund shall be governed by the practices of general accounting.

ADDENDA

  • Article 1 (Enforcement Date)
  • This Ordinance shall enter into force on January 1, 2004.
  • Article 2 (Repeal of Other Municipal Ordinances)
  • The Busan Metropolitan City Ordinance on the Advisory Committee on Women's Policy and the Busan Metropolitan City Ordinance on the Establishment and Operation of Women's Development Fund are hereby repealed respectively.
  • Article 3 (Transitional Measures) (1) The members of the Advisory Committee on Women's Policy of Busan Metropolitan City commissioned in accordance with the previous Ordinance before this Ordinance enters into force shall be deemed the members of the Committee commissioned in accordance with this Ordinance.
  • (2) The Women's Development Fund of Busan Metropolitan City established in accordance with the previous Ordinance before this Ordinance enters into force shall be deemed to have been established in accordance with this Ordinance.
  • Article 4 (Effective Period)
  • Articles 36 through 43 shall be effective until December 31, 2015. <Newly Inserted by Ordinance No. 4088, May 10, 2006; Ordinance No. 4483, Mar. 3, 2010>

ADDENDUM <Ordinance No. 3984, Feb. 16, 2005>

  • This Ordinance shall enter into force on the date of its promulgation.

  • (1) The Single-Parent Family Support Fund of Busan Metropolitan City established under Article 8 of the previous Busan Metropolitan City Ordinance on Single-Parent Family Support and the Busan Metropolitan Gender Equality Fund established under Article 41 of the Busan Metropolitan City Framework Ordinance on Gender Equality at the time this Ordinance enters into force shall be respectively deemed the gender equality account of the Childbirth Encouragement and Gender Equality Fund of Busan Metropolitan City under the amended provisions of Article 41.
  • (2) The Busan Metropolitan Childbirth Encouragement Fund established under Article 12 of the previous Busan Metropolitan City Ordinance on the Measures to Boost Low Birth Rate and Support to Encourage Childbirth at the time this Ordinance enters into force shall be the childbirth encouragement account of the Childbirth Encouragement and Gender Equality Fund of Busan Metropolitan City under the amended provisions of Article 41.
  • (3) The Busan Metropolitan Youth Nurture Fund established under Article 18 of the previous Busan Metropolitan City Ordinance on the Nurture of and Support for Youth at the time this Ordinance enters into force shall be deemed the youth nurture account of the Childbirth Encouragement and Gender Equality Fund of Busan Metropolitan City under the amended provisions of Article 41.
