BUSAN METROPOLITAN CITY ORDINANCE ON THE ORGANIZATION AND OPERATION OFNEGOTIATING PARTIES AND COMMITTEES OF THE COUNCIL

    Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe ethical standards and ethical practice regulations of Busan Metropolitan Council members (hereinafter referred to as the "members") under Article 34-3 of the Local Autonomy Act.
    Article 2 (Observance of Ethical Standards)
  • The members must adhere to ethical standards during their tenure of office.
    Article 3 (Duty to Maintain Dignity)
  • The members must avoid any act detrimental to their dignity while performing their duties.
    Article 4 (Obligation to be Clean-Handed)
  • The members must perform their duties fairly and impartially and refrain from committing any act of corrupting themselves or losing their dignity.
    Article 5 (Prohibition of Abuse of Official Authority)(1) No members may exercise inappropriate influence by using their positions, and may receive quid pro quo in connection with their duties.
  • (2) No members may take property rights or interests or get a position through mutual agreements or dealings with Busan Metropolitan City, public organizations, and enterprises in an improper way. No members may aid other persons to get similar benefits aforementioned.
  • (3) No members may make lucrative business dealings with Busan Metropolitan City and public organizations, and may be transferees or trustees of any facilities or properties in connection with business dealings.
    Article 6 (Prohibition of Taking Money and Valuables in Connection with Duties)
  • No members may give or receive directly or indirectly money, valuables or any other property interests from interested persons in connection with bills or other proposals.
    Article 7 (Duty of Confidentiality)
  • No members may disclose the secret becoming aware of in the course of carrying out their duties without just cause.
    Article 8 (Prohibition of Taking Rewards)
  • No members may take any reward, or remuneration which is out of the ordinary bounds from individuals, groups, or institutions in connection with lecture, contribution, and other similar activities.
    Article 9 (Recusal)
  • The members must recuse themselves where they have personal bias or financial interests in a proceeding such as deliberation of bills, administrative investigation or audit.
    Article 10 (Registration and Disclosure of Assets)
  • The members must discharge their duties to register and disclose assets and properties under the provisions of Public Service Ethics Act.
    Article 11 (Prohibition of Contributions, etc.)(1) No members may compliment anyone with a wreath or a flowerpot for congratulations or condolences at a ceremony of marriage, funeral and ancestral worship or for events of constituency, etc..
  • (2) No members may offer the money or goods beyond the ordinary scope for congratulations or condolences at a ceremony of marriage, funeral and ancestral worship or for events of constituency, etc..
  • (3) No members may send New Year's cards and offer calendar or other presents(excluding greeting cards as a means of reporting parliamentary activities) to the electorate.
    Article 12 (Report on Overseas Parliamentary Activities, etc.)
  • The members must report overseas parliamentary activities to the Council.
    Article 13 (Duty to attend Session) (1) The members must attend every session on time unless they submit applications for leave or reports of absence or they are on an overseas parliamentary trip, and they must be present during the session.
  • (2) No members may be absent from sessions by reason of political events or activities at the constituency.
