BUSAN METROPOLITAN CITY ORDINANCE ON SUPPORT FOR CREATION OF 15-MINUTE CITY

  • Article 1 (Purpose)
  • The purpose of this Ordinance is to prescribe matters necessary to create and support a 15-minute city, thereby contributing to the improvement of the citizens' quality of life and the revitalization of communities.
  • Article 2 (Definitions)
  • The terms used in this Ordinance are defined as follows:
    • 1. The term “15-minute city” means a city where every citizen of Busan can live together through communication and interaction with each other, while conveniently using amenities necessary for daily life in close proximity to their residences by walking or cycling, etc.;
    • 2. The term "amenities" means facilities provided to residents so that they can conveniently and safely use services necessary for daily life;
    • 3. The term "living zone index" means a quantitative indicator to measure the degree of accessibility, solidarity, ecology, etc. in a living zone for the creation of a 15-minute city;
    • 4. The term "community" means a group of residents who interact and share a sense of fellowship based on common interests in a living zone.
  • Article 3 (Relationship to Other Ordinances of Busan Metropolitan City)
  • Except as otherwise provided in other Ordinances of Busan Metropolitan City, the creation of a 15-minute city shall be governed by this Ordinance.
  • Article 4 (Action Plans)
  • (1) The Mayor of Busan Metropolitan City (hereinafter referred to as the "Mayor") shall formulate, every four years, an action plan for the 15-minute city of Busan (hereinafter referred to as "action plan") including the following, in order to create the 15-minute city:
    • 1. The objectives and basic direction of the 15-minute city;
    • 2. Strategies and major tasks for each field for the creation of the 15-minute city;
    • 3. Mid- to long-term plans for the creation of the 15-minute city;
    • 4. Surveys of the current status and analyses of conditions for the creation of the 15-minute city;
    • 5. Other matters that the Mayor deems necessary in relation to the creation of the 15-minute city.
  • (2) The Mayor may request related institutions, organizations, etc. to submit relevant materials, if necessary to formulate an action plan. In such cases, the related institutions, organizations, etc. shall endeavor to cooperate with such request, except in special cases.
  • (3) Other matters necessary to formulate an action plan under paragraph (1) shall be separately determined by the Mayor.
  • Article 5 (Projects for Creation)
  • (1) The Mayor may conduct the following projects to create the 15-minute city:
    • 1. Projects for the creation of pilot areas;
    • 2. Various public competitions and contest projects for the creation of the 15-minute city;
    • 3. Community recovery and revitalization projects, such as the establishment of communities and sharing platforms;
    • 4. Projects for publicity to citizens;
    • 5. Other projects that the Mayor deems necessary to create the 15-minute city.
  • (2) The Mayor may provide administrative or financial assistance to an institution, an organization, or an individual that participates or cooperates in the projects specified in the subparagraphs of paragraph (1).
  • (3) When subsidizing projects pursuant to paragraph (2), the methods and procedures, etc. for the subsidization shall be governed by the Busan Metropolitan City Ordinance on the Management of Local Subsidies.
  • (4) The Mayor may award a prize to a project selected in a public competition under paragraph (1) 2, within the budget.
  • (5) Details of the projects specified in the subparagraphs of paragraph (1), the promotion procedures therefor, etc. shall be separately determined by the Mayor.
  • Article 6 (Designation of Pilot Areas)
  • (1) In order to conduct projects under Article 5 (1) 1, the Mayor may designate a pilot area for the 15-minute city of Busan (hereinafter referred to as "pilot area").
  • (2) Where a site, a facility, etc. in a pilot area become a subject-matter of the projects under Article 5 (1) 1, the Mayor may conduct the projects through the purchase of the relevant site, facility, etc. or through an agreement on use with the owner of the relevant site or facility.
  • (3) Where the Mayor has made an agreement on use with the relevant owner under paragraph (2), he or she may provide financial assistance or pay fees, etc. to the owner, etc. in accordance with the terms and conditions of the agreement.
  • (4) If necessary in connection with the projects under Article 5 (1) 1, the Mayor may designate and operate them as social performance compensation projects under the Busan Metropolitan City Ordinance on the Management of Social Performance Compensation Projects.
  • (5) Details, such as the methods and procedures, etc. for the designation of pilot areas, shall be separately determined by the Mayor.
  • Article 7 (Inspection and Management of Progress)
  • (1) The Mayor may develop and utilize data-based evaluation methods, such as a living zone index, for the inspection and management, etc. of the progress of the 15-minute city.
  • (2) The Mayor may produce and distribute 15-minute living zone maps to enable citizens to find and use information about amenities, community programs, etc. on-line in real time.
  • Article 8 (Establishment of Committee)
  • The Mayor shall establish an Advisory Committee for the 15-Minute City of Busan (hereinafter referred to as the "Committee") in order to deliberate and render advice on the following, regarding the creation of the 15-minute city:
    • 1. The formulation of action plans under Article 4;
    • 2. Projects under the subparagraphs of Article 5 (1);
    • 3.The designation of pilot areas under Article 6 (1);
    • 4. The development and utilization of evaluation methods and the development and operation of 15-minute living zone maps, etc. under Article 7;
    • 5. Other matters referred to a meeting by the Mayor or the chairperson of the Committee in relation to the creation of the 15-minute city.
    [This Article shall remain effective until November 30, 2027 pursuant to Article 2 of the Addenda to Ordinance No. 6808 (Dec. 28, 2022)]
  • Article 9 (Composition of Committee)
  • (1) The Committee shall be comprised of up to 30 members, including one chairperson and one vice chairperson.
  • (2) The chairperson and the vice chairperson of the Committee shall be elected from among and by members.
  • (3) The Chief Officer for Balanced Urban Development shall be an ex officio member, and other members shall be commissioned by the Mayor from among the following persons:
    • 1. Persons who have extensive knowledge and experience in relation to the creation of the 15-minute city;
    • 2. Persons recommended by an institution or organization related to the creation of the 15-minute city;
    • 3. Persons recommended by the Busan Metropolitan Council.
  • (4) The chairperson shall represent the Committee and exercise general supervision over its duties.
  • (5) Where the chairperson is unable to perform his or her duties due to any unavoidable cause, the vice chairperson shall act on behalf of the chairperson; and where both the chairperson and the vice chairperson are unable to perform their duties due to any unavoidable cause, a member designated in advance by the chairperson shall act on behalf of them.
  • Article 10 (Term of Office of Members)
  • The term of office of a commissioned member shall be two years and may be renewed consecutively: Provided, That a member who is a public official shall serve for the period during which he or she holds the relevant position.
  • Article 11 (Dismissal of Members)
  • The Mayor may dismiss a member in any of the following cases:
    • 1. Where the member becomes unable to perform his or her duties due to a long-term mental or physical disability;
    • 2. Where the member commits misconduct in connection with his or her duties;
    • 3. Where the member is deemed unsuitable to continue to serve as a member due to neglect of duties, injury to dignity, or any other reason;
    • 4. Where the member voluntarily declares that it is impracticable for him or her to perform his or her duties.
  • Article 12 (Exclusion or Recusal of Members)
  • (1) A member who has an interest in the relevant agenda item shall be excluded from the deliberation and rendering of advice on the agenda item.
  • (2) Where a member finds that he or she has an interest in the relevant agenda item, the member shall recuse from the deliberation and rendering of advice on the agenda item.
  • Article 13 (Meetings)
  • (1) The chairperson shall convene and preside over meetings of the Committee.
  • (2) A majority of the members of the Committee shall constitute a quorum, and any resolution thereof shall require the concurring vote of a majority of those present.
  • (3) The Committee shall have one executive secretary to deal with its business affairs, and the head of the division in charge of creating the 15-minute city shall serve as its executive secretary.
  • (4) Where necessary to perform its duties, the Committee may require relevant experts, etc. to attend its meetings and present their opinions or may request related institutions or organizations to submit materials and provide other necessary cooperation.
  • (5) The commissioned members or relevant experts, etc. who attend a meeting of the Committee may be provided with allowances and reimbursed for travel expenses within the budget.
  • Article 14 (Operating Rules)
  • Except as provided in this Ordinance, matters necessary for the operation of the Committee shall be determined by the chairperson after resolution by the Committee.
  • Article 15 (Consensus Policy Group)
  • (1) The Mayor may organize and operate a Consensus Policy Group for the 15-Minute City of Busan (hereinafter referred to as the "Consensus Policy Group") in order to hear opinions of citizens and increase opportunities for citizens' participation in the creation of the 15-minute city of Busan.
  • (2) The Mayor may hold or support relevant events, such as workshops for the Consensus Policy Group, in order to operate and promote the Consensus Policy Group.
  • Article 16 (Establishment of Cooperation System)
  • The Mayor shall establish a continuous cooperation system with Gus, Guns, and related institutions and organizations, etc. to efficiently and systematically implement policy measures for the creation of the 15-minute city.
  • Article 17 (Entrustment of Business Affairs)
  • (1) In order to efficiently promote the creation of the 15-minute city, the Mayor may fully or partially entrust the projects specified in the subparagraphs of Article 5 (1) to a corporation, an institution, or an organization with expertise and human resources.
  • (2) Where entrusting business affairs under paragraph (1), the Mayor may provide subsidies to cover the necessary expenses, within the budget.
  • (3) Except as provided in this Ordinance, the entrustment of business affairs under paragraph (1) shall be governed by the Busan Metropolitan City Ordinance on Entrustment of Business Affairs to, or Vicarious Execution Thereof or by, Public Institutions and the Busan Metropolitan City Framework Ordinance on Entrustment to the Private Sector.
  • Article 18 (Awards)
  • The Mayor may give an award to an institution, an organization, or an individual that has made an outstanding contribution to the creation of the 15-minute city in accordance with the Busan Metropolitan City Ordinance on Awards.

ADDENDA

  • Article 1 (Enforcement Date)
  • This Ordinance shall enter into force on the date of its promulgation.
  • Article 2 (Period of Existence of Committee)
  • The Advisory Committee for the 15-Minute City of Busan under Article 8 shall continue to exist until November 30, 2027.
