BUSAN METROPOLITAN CITY ORDINANCE ON SUPPORT FOR ENTERPRISES PARTICIPATING IN RE100

  • Article 1 (Purpose)

  • The purpose of this Ordinance is to prescribe matters necessary to promote participation in RE100 by enterprises in Busan Metropolitan City and to support the activities of such enterprises, thereby contributing to the expansion of renewable energy use and dissemination and to enhancing corporate competitiveness for regional economic development.

  • Article 2 (Definitions)

  • The terms used in this Ordinance are defined as follows:

  • 1. The term “RE100” means the Korean-style RE100 scheme established to support the implementation of the Global RE100, voluntary campaign in which enterprises declare that they will use 100 percent renewable electricity by 2050.

  • 2. The term “certificate of supply of new and renewable energy” means a certificate evidencing that a power generation business operator has generated and supplied electricity using new and renewable energy facilities.

  • 3. The term “verification of the use of renewable energy” means verifying the use of renewable electricity by an enterprise through such means as entering into a power purchase agreement(PPA) via an electricity sales business operator, purchasing certificates of supply of new and renewable energy, entering into contracts for the purchase of electricity and certificates of supply of new and renewable energy through equity participation, or installing renewable energy facilities for self-consumption, and obtaining from the Korea Energy Agency a certificate evidencing the use of renewable electricity.

  • 4. The term “enterprise participating in RE100” means an enterprise whose headquarters (meaning a place of business located at the location of the principal office or head office stated on the enterprise’s establishment registration) is located within Busan Metropolitan City, which participates in RE100 and has obtained verification of the use of renewable energy from the Korea Energy Agency.

  • 5. Terms used in this Ordinance, other than those defined in subparagraphs 1 through 4, shall be as defined in Article 2 of the Act on the Promotion of the Development, Use and Diffusion of New and Renewable Energy and Article 2 of the Electricity Utility Act.

  • Article 3 (Responsibilities of the Mayor)

  • The Mayor of Busan Metropolitan City (hereinafter referred to as the “Mayor”) shall endeavor to expand the use and dissemination of renewable energy , as well as to secure a support budget in order to promote and support the activities of enterprises participating in RE100.

  • Article 4 (Scope of application)

  • This Ordinance shall not apply to any enterprise participating in RE100 that falls under any of the following:

  • 1. An enterprise presumed to be a market-dominant enterprise under Article 6 of the Monopoly Regulation and Fair-Trade Act;

  • 2. An enterprise that does not meet the requirements for a small or medium enterprise under Article 3 of the Enforcement Decree of the Framework Act on Small and Medium Enterprises.

  • Article 5 (Formulation and implementation of implementation plan)

  • The Mayor shall formulate and implement an implementation plan to promote and support the activities of enterprises participating in RE100, which shall include the following:

  • 1. Strategies and targets to expand participation by enterprises in RE100;

  • 2. Support for funds, information, technologies, and human resources for enterprises participating in RE100;

  • 3. Managerial support for enterprises participating in RE100;

  • 4. Domestic and overseas publicity for enterprises participating in RE100;

  • 5. Other matters the Mayor deems necessary to promote and support the activities of enterprises participating in RE100.

  • Article 6 (Support projects)

  • (1) To promote the activities of enterprises participating in RE100, the Mayor may support the following projects:

  • 1. Support for network usage fees for power purchase agreements where electricity is supplied by a renewable electricity supply business operator under Article 20 of the Enforcement Decree of the Electricity Utility Act;

  • 2. Consulting support related to applications for RE100 and the preparation of progress reports on implementation;

  • 3. Support concerning certificates of supply of new and renewable energy;

  • 4. Other matters the Mayor deems necessary to promote the activities of enterprises participating in RE100.

  • (2) Where an enterprise participating in RE100 applies for any of the following projects, the Mayor may give preferential support:

  • 1. Loans to small and medium enterprises through the Busan Metropolitan City Small and Medium Enterprise Support Fund established under the Busan Metropolitan City Ordinance on the Small and Medium Enterprise Support Fund, and support for subsidizing interest differentials thereon;

  • 2. Support for reducing guarantee fees where guarantees are obtained from the Busan Credit Guarantee Foundation established under the Regional Credit Guarantee Foundation Act;

  • 3. Other matters the Mayor deems necessary to support enterprises participating in RE100.

  • Article 7 (Financial support)

  • To implement the projects under Article 6, the Mayor may subsidize all or part of the necessary expenses, within budgetary limits, to enterprises, institutions, or organizations.

  • Article 8 (Awards)

  • The Mayor may grant awards to institutions, organizations, or individuals with distinguished merit in promoting the activities of enterprises participating in RE100, in accordance with the Busan Metropolitan City Ordinance on Awards.

  • This Ordinance shall enter into force on the date of its promulgation.
