Busan Metropolitan City Ordinance on the Establishment of Traffic Business Special Account
- Article 1 (Purpose)
- The purpose of this Ordinance is to prescribe the matters required for the establishment and management of the Traffic Business Special Account (hereinafter referred to as the "Account") for the clear management of the revenue and expenditure under the Urban Traffic Improvement Promotion Act，the Parking Lot Act，the Passenger Transport Service Act，Truck Transport Business Act，and the Ordinance on the Establishment of the Busan Metropolitan Corporation (hereinafter referred to as the "Corporation").
- Article 2 Deleted.
- Article 3 (Annual Revenue) (1) This Account shall manage the following revenues related to parking lots and other traffic businesses:

- 1. The parking fee (related to Article 9 (1), (2) and 14 (1) of the Parking Lot Act)
- 2. The charges of the parking lot management consignee (related to Article 8 (1) and 13 (2) of the Parking Lot Act)
- 3. Deleted.
- 4. The payment amount for the installation of an attached parking lot (related to Article 19 (5)
- 5. The occupation and use fees of parking purpose and the fines for negligence (related to Article 30)
- 6. The charges for causing traffic congestion (related to Article 18 of the Urban Traffic Improvement Promotion Act)
- 7. Deleted.
- 8. The penalty surcharges and the fines for negligence (related to Article 79 (1) and 85 (1) of the Passenger Transport Service act, related to article 19 (1) and 50 (1) of the Truck Transport Business Act)
- 9. The State subsidies
- 10. The funds from other accounts
- 11. The revenue under the other Act and subordinate statute or the ordinance；
- 12. Deleted.
- 13. The final account surplus of the Corporation；
- 14. The fines for negligence of the violation of exclusive lanes collected by the Mayor as prescribed in Article 115-2 of the Road Traffic Act
- 15. Other miscellaneous revenues.
- (2) (1) 10 shall contain 10 percents of city planning taxes for the pertinent year collected under Article 15 of the Enforcement Decree of the Parking Lot Act，and the difference between the budget amount and expenditure amount shall be calculated and shall be appropriated in the next year .
- (3) Deleted.
- Article 4 (Annual Expenditure) (1) Annual expenditure of this Account shall be appropriated for the following expenses:

- 1.Road business undertaking necessary to be enforced from the special account；
- 2. Traffic system control business as prescribed in the Urban Traffic Improvement Promotion Act
- 3. Expansion and improvement, and maintenance of the traffic safety facilities
- 4. Investigation and research business related to urban traffic；
- 5. Expenses necessary for expansion and installation of parking lot facilities；
- 6. Management operating costs or management entrustment fees to the entrusted person for the management of the public parking lots
- 7. Subsidies or financing to the installer of parking lot;
- 8. Investment of the fund under the Ordinance on the Establishment and Management of Public Traffic Transport Business Promoting Fund；
- 9. Expenses as prescribed in the subparagraphs of Article 19 ④ of the Truck Transport Business Act；
- 10. Matters as prescribed in the subparagraphs of Article 79 ④ of the Passenger Transport Service Act
- 11. Pedestrian environment improvement business under the Ordinance on the Guarantee of Pedestrian Rights and Improving Environment for Pedestrians and
- 12. Other businesses to solve the urban traffic problem
- (2) the revenue under Article 3 (1) 1-5 and 13，the funds from other accounts under Article 3 (2) and other designated revenue shall not be used other than parking lot related businesses.
- Article 4
- 2 Deleted.
- Article 5 (Disposal of Surplus)
- Final surplus of this Account shall be entered to the next annual revenue.
- Article 6 (Reserve Fund)
- The Mayor shall publicly announce the minimum number of buses for registration differently which is at least three as determined by the Mayor in islands, backwoods，and other special areas pursuant to the attached table 2 ① the Decree.
- Article 7 (Provisions Applicable Mutatis Mutandis)
- Except as provided in this Ordinance, the provisions concerning the practices of general account shall apply mutatis mutandis to the management and operation of this Account.
- Article 8 (Municipal Rule)
- Necessary matters concerning the management and operation to enforce this Account shall be prescribed by the rule of Busan Metropolitan City.
