Busan Metropolitan City Ordinance on Groundwater

- Article 1 (Purpose)
- The purpose of this Ordinance is to prescribe matters delegated by the Groundwater Act and its Decree and matters necessary for its enforcement.

- (2) The head of a Si/Gun shall at least one time publicly notify the announcement plan obtained from the Mayor on the Busan Metropolitan City Gazette, Internet homepages of the Busan Metropolitan Si/Gun/Gu, and at least one local daily newspaper within 10 days, and announce it for at least 14 days so that the residents may read it.
- (3) The Mayor shall consider whether to reflect the opinions submitted under paragraph (1) 3 in the designation or alteration of designation of a groundwater preservation area, and notify the result to the person who submitted the opinion concerned within 30 days from the date of completion of perusal.
- 1.1. Article 4 (Exemption from the Inspection Fees of Water Quality of Measuring Facilities of Water Quality)
- In cases that the person who develops and utilizes groundwater requests that the Busan Metropolitan City Health Environment Institute or the Office of Waterworks of Busan Metropolitan City make a regular inspection of water quality under Article 29 (1) of the Decree on facilities designated and/or publicly announced as the quality measuring networks of groundwater under Article 9 of the Rule on the Preservation, etc. of Water Quality of Groundwater, the inspection fees may be exempted despite Article 3 of the Busan Metropolitan City Ordinance on the Operation of the Health Environment Institute and Article 5 of the Busan Metropolitan City Ordinance on the Collection of the Inspection Fees of Water Quality.
- Article 5 (The Busan Metropolitan City Groundwater Management Committee) (1) The Busan Metropolitan City Groundwater Management Committee (hereinafter referred to as the “Committee”) shall be established to advise the Mayor.
- (2) The Committee shall consist of less than 20 members including one chairman and one vice chairman.

(3) The chairperson and vice chairperson of the Committee shall be elected out of the members, and the Mayor shall designate or appoint the members, in consideration of gender, out of persons who are qualified for any one of the following subparagraphs:
- 1. Public officers in charge of businesses related to groundwater; and
- 2. Persons having profound knowledge and experience in groundwater.
- (4) The Committee shall constitute upon the incidence of an agenda and dissolve automatically after deliberation and decision.

- (6) The deliberation of a meeting of the Committee shall start by the attendance of a majority of all incumbent members, and its resolution shall require the consent of a majority of those present.
- (7) For dealing with businesses of the Committee, the Committee shall have a secretary and a clerk respectively. The former shall be the deputy director in charge of water quality preservation and the latter shall be the person in charge of water quality preservation.
- (8) The allowances and travel expenses may be paid to the commissioned members within the limit of the the budget.
- (9) Matters necessary for the operation of the Committee, other than those provided in this Ordinance, shall be determined by the chairman through a resolution of the Committee.

- The ordinance shall be in effect on and after July 1, 2011.
