Qualification of Auction Manager

• Auction Manager shall be the passed Auction Manager Qualification Exam and not be applicable to each of the following clauses (The Law, Article 27, Clause 2)
  • One who is not reinstated from bankruptcy abjudication, incompetent or quasi-incompetent
  • One who was sentenced to imprisonment or more and when it is not over 2 years since the execution of the sentence is terminated or the execution is exempted
  • One who is in probation or deferred sentence of imprisonment or more
  • Market Wholesaler, intermediary wholesaler, distributers at the place of production or the staff of the corresponding Wholesale Market

Roles and Duties of Auction Manager (The Law, Article 31)

• Decides priority of auction for listed Fisheries products.
• Assesses the price of listed Fisheries products.
• Decides successful bidder for listed Fisheries products.

  ※ Auction Manager is viewed as public official in the application of Penal Code Article 129 or 132.

  • Penal Code Article 129 : Bribery, advance bribery
  • Penal Code Article 130 : Bribe Provision to 3rd party
  • Penal Code Article 131 : Unlawful behavior after bribery, Post Bribery
  • Penal Code Article 132 : Influence Paddling

  ※ The designated Auction Manager shall take a training course by Agro-Fisheries Trade Corporation once in every 5 years. (Enforcement Regulations Article 50, Clause 2)

• Wholesale Market Company and Auction Manager shall not refuse or evade the trust of arrived Fisheries products or the sale of entrusted Fisheries products, or not treat with unjust discrimination without any justifiable reasons. (The Law, Article 38)
